Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report
Co-Chair Ed Reynolds opened the meeting at 4:02 pm.

Steve Durkee of the Wellfleet Historical Commission presented three alternative locations for the clam/oyster shack donated by Roger Burgess.  Potential locations are on Commercial Street where the old fire house was located, Mayo Beach and at the Harbor.  The Commission agreed it would be a worthwhile cultural landscape for people to visit.  Andrew Petty suggested Durkee contact John Riehl who heads up the Harbor Management Plan and get advice on how to proceed with the paperwork involved in locating the shack within the resources.

Andrew Petty asked the Commission’s views regarding the parking lot (site of old firehouse) on Commercial Street, and if it should be repaired where there is some erosion along the bank.  He also sought our views on painting a strip for a sidewalk on the water side of Commercial Street.  The scour at Uncle Tim’s Bridge is getting worse and Petty questioned if it should be repaired or wait.  Terry Gips suggested getting an opinion from experts regarding the overall issues of bank erosion in this section of Duck Creek.  

Agent Greenberg informed the Commission that the Community Garden project on Hamblin Farms property will have 20 plots available to the public.  The Commission stated they would like to make a site visit.

Jurisdictional Opinions:

104 Chequessett Knolls: prune 37 trees and remove 13 trees (ground level).  Ginie Page moved to approve the Jurisdictional Opinion; seconded by Terry Gips, passed 6-1.

105 5th Avenue:  prune trees with the removal of one scrub tree.  Cyndi Moe moved to approve the Jurisdictional Opinion; seconded by Dottie Dolan; passed 7-0.

Field Point Association: pruning / brush back along King Phillip Road, Billingsgate, and Omaha Roads.  Ed Reynolds moved to approve the Jurisdictional Opinion; seconded by Cyndi Moe; passed 7-0.

Cyndi Moe moved to approve the 11/5/08 meeting minutes as amended; seconded by Ed Reynolds; passed 7-0.

Agent Greenberg suggested the Commission make another site visit to the Gilmore property because there is a tent on the property.  She informed the Commission the Building Inspector would also make a site visit.

After being informed the fiber rolls have come loose at the Yankelovitch property, Andrew Petty agreed to call EZ Doze It.

Public Hearings 5:00 pm:
Pyles, Bayberry Lane, Map 41, Parcels 121and 122:  Request for Extension.  (Cont’d from 12/03/08).  At the request of the applicant, Cyndi Moe moved to continue the hearing to 1/7/09; seconded by John DiBlasio; passed 7-0.

Hess, 34 Old Pier Rd., Map 23, Parcel 202, RDA, (after the fact) installation of underground utilities.  Chet Lay of Slade Associates stated the installation of the underground utilities was not intentionally done without getting permission from the Commission.  John DiBlasio moved to identify this project as a Negative 3; seconded by Cyndi Moe; passed 7-0.

Sterling, 36 Marsh End, Map 8, Parcel 264, Amended Order of Conditions, reduction in size of addition and removal of fuel tank.  Gordon Peabody and Joy Cumming gave an overview of the proposed changes, identifying the cantilevered section of the dwelling, the reduction of the structure and foundation, the reduction in the excavation, and the use of sono tubes four feet below the frost line.  Cyndi Moe moved to approve the amendment of the Order of Conditions; seconded by Terry Gips; passed 7-0.

Simpson, 780 Ocean View Dr., Map 17, Parcel 3, NOI, move dwelling from eroding coastal bank.  Ed Simpson represented himself and gave an overview of the project.  He stated he has permission from the National Seashore to move the dwelling and is working with the ZBA.  He explained he would like to have a walk-out basement and add an additional bedroom and bathroom in the cellar area.  He explained the existing foundation materials will be crushed up, the well and septic will be relocated, and any excess dirt/sand may be relocated temporarily to White Crest beach parking area during the moving process.  Dottie Dolan moved to approve the NOI; seconded by John DiBlasio; passed 7-0 with conditions.  Supervisor:  John DiBlasio    

Cyndi Moe moved to adjourn at 5:40 pm; seconded by John DiBlasio; passed 7-0.
