Minutes of Conservation Commission Public Meeting

        Discussion:  ACEC Regulations
Agent Greenberg distributed ACEC photographs which identified buffer zones and the floodplain.  She stated the Commission needs to clarify its intentions: do we want the revision to the Wellfleet Environmental Protection Regulations to specify a 50 foot buffer zone or a 100 foot buffer zone beyond the 100 year flood zone and the ACEC line?  As currently written, they call out a no-touch buffer zone of an additional 50 feet landward.   There was discussion and clarification that the new regulations would not only put into place restrictions on the previously unregulated ACEC but on a buffer zone beyond the ACEC and beyond the 100 year flood zone.  (The ACEC line is 100 feet landward from the 10 foot contour above sea level).  Agent Greenberg also clarified that since the areas delineated by the state Wetlands Protection Act, the ACEC, and LSCSF do not coincide, the most restrictive would apply in any given case. The Commission discussed the recommendations from Griswold Draz regarding Section 4A, performance standards, and 4B.  There was discussion regarding the relationship of variances to the revised regulations.  Agent Greenberg reviewed the areas of the regulations that may require revisions to improve clarification.  Agent Greenberg will work on a draft to present to the Commission with changes.  There will be another public hearing on July 1, 2009.

Terry Gips moved to approve the June 3, 2009 meeting minutes as amended; seconded by John DiBlasio; passed 4-0.
 
Jurisdictional Opinion:  Juno Beach, LLC, 28/109, 107 Samoset Ave. The stairs which need repair have been in existence for over 20 years even though the Commission never approved them through an NOI.  A NOI will be filed after the fact, and the stairs will be repaired on the same footprint.  Agent Greenberg stated an NOI would be required.  Agent Greenberg will request a plan and description of work and present the Jurisdictional Opinion at the July 1, 2009 meeting.

Winslow, RDA, Shellfish Grant (Cont’d from 6/03/09).  At the request of the applicant for a continuation due to lack of response from Army Corps of Engineers, Terry Gips moved to continue to 7/1/09; seconded by John DiBlasio; passed 4-0.

Austin, RDA, Shellfish Grant (Cont’d from 6/03/09).  Awaiting response from Army Corps of Engineering, the applicant requested a continuation to 7/01/09.  Terry Gips moved to continue to 7/01/09; seconded by John DiBlasio; passed 4-0.

Chequessett Yacht & Country Club, 675 Chequessett Neck Rd., Map 19, Parcel 115, NOI, construct 10’ x 30’ shed (Cont’d from 6/03/09).  Barbara Boone stated they will be using the shed for the masts, sails and rudders for sailboats.  The Commission was concerned with the steepness of the proposed primary location as well as the vegetation.  The second location will require more difficult maneuvering around other buildings;  in addition this is a busier area.  Boone stated they previously used the boat house for storage but now they use it for summer camp and several other events.  

The Commission discussed the second part of the application for drainage repairs and reviewed a 1996 elevation map of the golf course. The underground pipe is not draining, perhaps because it has been there for over 25 years and is clogged. The proposal presented was replacing the pipe with a ditch, and possibly augmented by a pump. Barbara Boone will have a licensed surveyor provide new elevations to better determine the capacity for water flow.  Andrew Petty suggested having the mosquito control people come and look at the property regarding potential clearing of the creeks through the golf course and into the adjacent marshes.    DEP wrote a letter stating they would prefer “daylighting” streams, that is, having flowing water in ditches/streams rather than through buried pipes.  It was recommended that the current piping be removed.  Boone stated core testing had been done and they didn’t hit sand until 22 feet.  John DiBlasio moved to approve the 10 x 30 shed to be located at the alternate site location; seconded by Terry Gips; passed 4-0.

Thayler, 250 Meadow Ave West, Map 40, Parcel 158, NOI, installation of sandbags and sand drift fencing (Cont’d from 6/03/09)  John DiBlasio moved to continue to 7/01/09 at the request of the applicant; seconded by Terry Gips; passed 4-0.

Coser, 250 Commercial Street (Pearl), Map 21, Parcel 106:  Amended Order of Conditions:  create rainwater collection system.  Steve Swain identified the location of fencing and will ask the engineer to write a letter reviewing the fencing plan and indicating if it will be ok for the installation of the posts. This letter is to be submitted to Agent Greenberg before commencing work on the fence.  Steve Swain stated he is working with the designers of the water collection system and there will be a filter system.  The system will be drained during the off season and the water will be diverted away from the system.  The Conservation Commission will require a dry well for the overflow of water.  Terry Gips moved to approve the AOOC; seconded by Patrick Winslow; passed 4-0.  

John DiBlasio moved to adjourn at 6:03 pm; seconded by Patrick Winslow; passed 4-0.
