Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report
Co-Chair Ginie Page opened the meeting at 4:00 pm.  

Ginie Page reported the McCarthy house on Pine Point Way has cleared some trees and Andrew Petty will do a site visit.

Terry Gips distributed pictures she had taken of the shellfish debris in Blackfish Creek off Field Point.  The Commission had a discussion on ways to remove the debris and Patrick suggested physically cutting it into pieces and dragging itout.  Andrew Petty will talk with Andrew Koch regarding removing the debris.  Petty will talk to the Shellfish Advisory Board at their meeting on March 17, 2009 at 4:00 pm at the Sr. Center.  There is concern because it is not visible during high tide and boat activity this spring and summer could be dangerous to boaters.

John DiBlasio reported fishermen were driving on the beaches off Old wharf Road and on property under the Conservation Trust, including the Chipman’s Cove area.  Petty stated maps have been made identifying where people can drive and need to be distributed.  

Jurisdictional Opinion:  

Ruth Olson, Sea Oaks Way, S. Wellfleet:  remove damaged oak tree and tree stumps.  John DiBlasio moved to approve the Jurisdictional Opinion; seconded by Patrick Winslow; passed 5-0.

David Agger, Lt. Island:  remove two pine trees infected with pine borers.  There was discussion about the removal of the infected wood from a site and the need to educate people how damage to additional trees could happen if not removed properly.  Cyndi Moe moved to approve the Jurisdictional Opinion; seconded by Terry Gips; passed 5-0.  




Cyndi Moe moved to approve the 2/18/09 meeting minutes as amended; seconded by Terry Gips; passed 5-0.

There was discussion regarding getting an Americorps person for the Conservation/Health Department which will be shared with Conservation Trust.

Petty stated he is working on a bluebird project at the Transfer Station with the Audubon and Boy Scouts.  The local cub scouts will build 25 houses.  Petty will work with Bob Prescott to determine where the houses will be located.  

Osprey and Wood Duck nest boxes will be placed in the Herring River.

O’Connor, 90 LeCount Hollow, Map 30, Parcel 9, Certificate of Compliance.  John DiBlasio stated the work was completed and moved to approve the Certificate of Compliance; seconded by Cyndi Moe; passed 5-0.

Sharp, 43 East Commercial St., Map 15, Parcel 111, NOI, Septic Upgrade, addition of deck and renovations to dwelling.  Katlyn Sidell of East Cape Engineering gave an overview of the project.  The house is not within the ACEC; however the septic is located within the ACEC and buffer zone.  The cesspools will be filled with sand.  There will be interior remodeling and a new section of deck.  The studio does not have a bedroom nor running water per the Board of Health.  The water in the existing well reveals an elevated nitrate level but an alternate site showed even worse levels.  When the Town water line is run in this section of Commercial Street, Sharp will be advised to connect. Terry Gips moved to approve the NOI; seconded by Cyndi Moe; passed 5-0.  Supervisor: Cyndi Moe

Glucksman, 165 Commercial St., NOI, Map 21, Parcel 118, Septic upgrade and deck construction on shed/studio.  Attorney Ben Zehnder gave an overview of the project, stating the owners received a building permit from the Building Inspector to renovate the shed into a studio.  The family was unaware they had to come to the Conservation Committee for review of additions to the studio.    Zehnder stated they recently received approval from the Board of Health for a Title 5 septic upgrade and a bedroom was established in the studio.  The studio is located within the 50 foot buffer zone.  Zehnder distributed photographs of how the area near the studio has been used over the past 40 years showing gardens in the wood storage, etc.  After a lengthy discussion, it was determined the Glucksman would remove the roof and wall framing on the deck so that it would not be covered and enclosed;  they also agreed that the finished decking will be pervious.  Cyndi Moe moved to approve the NOI with the condition that the roof  be eliminated and the decking be pervious; seconded by John DiBlasio;  passed 5-0.  Supervisor:  Andrew Petty and Cyndi Moe.

Makely (owner Steven Anthony), 149 Hamblen Farm Rd, Map 12, Parcel 47, RDA, Establish community garden (Cont’d from 02/18/09).  Petty reported the location for the garden will be moved to the COA.  Cyndi Moe moved to allow the application to withdraw without prejudice; seconded by Terry Gips; passed 5-0.

Rispoli/Grabowski, 15 LeCount Hollow Rd., Map 30, Parcel 22, NOI, Parking Redevelopment (Cont’d from 2/18/09).  Reggie Donoghue of Coastal Engineering provided new landscaping plans with detailed planting notes and survivability of the plants.  All paperwork from the State was received.  Cyndi Moe moved to approve the NOI; seconded by Patrick Winslow; passed 5-0.  Supervisor:  John DiBlasio

Town Of Wellfleet, Maps 14, 20 and 21, Holbrook and Kendrick Aves, NOI, Installation of water mains (Cont’d from 2/18/09).  Natural Heritage responded with some concerns regarding the Spade foot Toads and recommend establishing critter gaps in the straw bales.  Cyndi Moe moved to approve the NOI; seconded by John DiBlasio; passed 5-0.  Supervisors:  Petty and Greenberg.

MA Audubon, Amendment to Order of Conditions, oyster reef (Cont’d from 2/18/09).  At the request of the applicant, Cyndi Moe moved to continue to March 18, 2009; seconded by Patrick Winslow passed 5-0.

Woods, 150 3rd St., Map 40, Parcel 101, NOI, Installation of sand drift fencing with beach nourishment (Cont’d from 2/18/09).  At the request of the applicant, Cyndi Moe moved to continue to 3/18/09; seconded by Terry Gips, Passed 5-0.
