Minutes of Conservation Commission Public Meeting

Commissioners Present:  Co-Chair Ed Reynolds, Co-Chair Ginie Page, Dottie Dolan, Patrick Winslow, Cyndi Moe, Terry Gips and John DiBlasio.

4:00 - Business Meeting & Conservation Agent's Report
Ed Reynolds opened the meeting at 4:00 pm.  

Denny O’Connell gave a Power Point presentation on the Zoning Articles that will come before Wellfleet Special Town Meeting on October 27 – proposals to control “big houses.”  Griswold Draz also participated in the presentation on behalf of Selectmen/Petitioned Articles 4 and 5. Peter Watts spoke as a representative of homeowners in the National Seashore.  

Denny O’Connell identified three Conservation Restriction properties that will come before the Conservation Commission.  

Stan Humphries discussed the Stossel stairway, showing the original plan and a new plan, which is larger in size and moved slightly in its position on the coastal bank.  The Commission requested he file an amended Order of Conditions.  

The ACEC floodplain draft regulations were distributed.  A public hearing will be scheduled for one of the December meetings due to the large number of hearings already planned for the November meetings.

Jurisdictional Opinion:  Box Lunch, remove large willow trees using A-Z Tree Service.  Ginie Page moved to approve the Jurisdictional Opinion; seconded by Terry Gips; passed 6-1.
     
Public Hearings 5:00 pm:

Belko, 290 Blue Heron Road, Map 42, Parcel 123, Certificate of Compliance.  Katlyn Siddell stated an Order of Conditions was granted in December 2007, and at the site review it was observed a shed and patio were built which were not in the approved plan.   Siddell stated that the new owners would remove the wood patio and place shells in an area; she also stated that they would like to keep the shed for storage.  The Commission expressed concern with the hay bales and mulch, and questioned the amount of regarding or filling that had been done.  Siddell asked if the portion of the wooden deck that serves as a landing for the door could be retained.  Dottie Dolan moved to continue to November 5, requesting that the wooden patio be removed, (except for the section in front of the door), the mulch be re-distributed, and pre- and post- construction photographs and pre- and post-elevations, be provided to the Commission.  In addition, she asked that a new plan identifying the as-built shed be provided and that Siddell file a Jurisdictional Opinion for the shed; seconded by Cyndi Moe; passed 7-0.

Murphy, 20 Pine Point, Map 15, Parcel 132, NOI, Build Decking.  At the request of the applicant, Ginie Page moved to continue to 11/5/08; seconded by Terry Gips; passed 7-0.

Magierski/Romanczak, 15 Heron Point Rd, Map 40, Parcel 6, NOI, replace decking & install underground propane tank.  David Lajoie represented the applicant and gave an overview of the project.  The proposed decking will stay in the same footprint as the existing deck located within the 50’ buffer zone.  Terry Gips moved to approve the NOI; seconded by John DiBlasio; passed 7-0.  Supervisor:  Ed Reynolds

Santos Lord, 121 Indian Neck Rd., Map 28, Parcel 138, NOI, Construct 2nd story and septic upgrade.  Stephanie Sequin from Ryder and Wilcox, gave an overview of the project, stating it is within the 100 year flood zone.  An Advantex system will be installed for the septic upgrade.  The dwelling will remain a two bedroom dwelling with the construction taking place within the existing footprint.  Agent Greenberg requested a revised plan identifying the ACEC.  A letter from abutter Gozola, objected to the 2nd story construction.  The patio will remain.  The Commission requested house plans.  John DiBlasio moved to continue to 11/5/08; seconded by Dottie Dolan; passed 7-0.

Brand, 344 King Phillip Rd., Map 35, Parcel 178, NOI, new timber and stone stairway and new plantings.  Katlyn Siddell and Emily Beebe represented the applicant and gave an overview of the work proposed for the bank.  There will be removal of dead vegetation, and black pines (which will be flush cut), removal of old snow fencing, placement of post and rail fencing at the north border of the property.  Siddell identified t five areas that will be replanted on the coastal bank and on the top of the bank.  Siddell stated they want to incorporate stone steps into the revetment, and described their design and construction.  There will be renourishment of the bank.  Siddell read a letter from the Division of Marine  Fisheries with their recommendations regarding the project.  Dottie Dolan moved to continue to 11/19/08 in order to receive a response from Natural Heritage and a DEP number; seconded by Terry Gips; passed 7-0.

Wenick, 120 Aunt Sarah’s Way, Map 42, Parcel 60, NOI, addition with porch.  Gordon Peabody, Joy Cumming and Anna Jenkowitz Conlin gave an overview of the project.  Cumming stated it is an existing dwelling  which the owners want to expand; she gave an overview of the proposed expansion.  The driveway will remain in the same location.  The existing dwelling is on a full foundation and the expansion will also have a full foundation.  Cyndi Moe recommended they cut back either on the decking or the sitting area off the bedroom which are both located in the buffer zone.  There was discussion about solar energy, how that influenced the design of the addition, and how it might require pruning of trees.  The proposed addition, including the deck, is slightly more than 1400 square feet.  Cyndi Moe moved to continue to d11/19/08; seconded by John DiBlasio; passed 7-0.

Macgregor Hay, 91 and 95 Commercial St., Map 21, Parcels 129 and 128, NOI, septic upgrade and replace walk-in cooler.  Patrick Winslow recused himself.  PersonNameEmily Beebe and Mac Hay gave an overview of the project which will serve Mac’s Shack and the Moody Building, now known as the Duck Creek Creative Center.  The walk-in cooler will be relocated inland, away from the water, and will be placed on a concrete slab.  This project will take approximately two weeks to complete.  All the tanks for the septic system will be water proof, water tight.  Beebe will provide a detailed  construction protocol.  There was discussion about whether two separate NOI filings were required because there are two parcels; Beebe stated they wanted the same Order of Conditions on both properties.  Betty Allison (abutter) asked if the septic was going to be closer to her well; Beebe identified the locations, showing that it was not.  Terry Gips moved to continue to 11/5/08; seconded  by Ginie Page; passed 6-0.

Malcynsky, 115 Kendrick Ave., Map 10, Parcel 10, RDA, construct screened porch and detached deck.  Emily Beebe represented the applicant, stating the porch and deck would be placed on sono-tubes.  There was discussion about the location of the decking and screened porch, the relocation of the outdoor shower, the roof over the porch and the lack of a good site plan identifying elevations.  Dottie Dolan moved to continue to 11/5/08; seconded by Terry Gips; passed 7-0.

Catuccio, 174 Pleasant Pt., Map 35, Parcel 113, RDA, Septic Upgrade.  Keith Fernandez represented the applicant and gave an overview of the project.  John DiBlasio moved to identify this as a Negative 3; seconded by Ginie Page; passed 7-0.

Vulliet, 65 Samoset Ave,, Map 28, Parcel 116, NOI, septic upgrade, construct sunroom, 2 car garage, front porch, rear deck and foundation repairs.  Matt Farrell represented the applicant and gave an overview of the project, identifying revegetation that would be done as mitigation, additional decking, and the location of the ACEC through the property and the work area.  Greenberg suggested there be a detached garage out of the buffer zone.  Greenberg asked what the amount of disturbance was in the buffer zone and requested an alternative analysis plan.  The Commission felt there was too much proposed construction inside the buffer zone.  Terry Gips moved to continue to 11/19/08; seconded by Ginie Page; passed 7-0.

Kohn, 100 Way 26, Map 18, Parcel 3, NOI, remove structure and replace with new dwelling out of the buffer zone.  Matt Farrell represented the applicant and gave an overview of the project.  He stated they want to move the existing dwelling away from the  coastal bank because it is eroding quickly.  A letter from the US Dept of Interior National Seashore expressed concern about the size of the proposed dwelling, the re-vegetation plan and the need for a MESA review.  Greenberg requested a vegetation management plan, identifying a 75% survival rate.  Dottie Dolan moved to continue to 811/19/08; seconded by Ginie Page; passed 7-0.

Business:

The Commission determined they do not feel that zoning Articles 4, 5, 6, 7, and 8 in the upcoming Town Warrant are in their purview; therefore they will make no recommendations.  Greenberg will forward that decision to Administration.

Cyndi Moe moved to adjourn at 7:25 pm; seconded by Dottie Dolan; passed 7-0.
