Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report
Co-Chair Edwin Reynolds opened the meeting at 4:00 pm.

Ginie Page moved to approve the July 2, 2008 minutes as amended; seconded by Cyndi Moe; passed 6-0.

Agents Report:
Jurisdictional Opinion:  Yankelovitch,  King Phillip Rd., Map 35, Parcel 182, reprune Japanese black pine; Dottie Dolan moved to approve the Jurisdictional Opinion; seconded by Cyndi Moe; passed 6-0.

·       There will be a public scoping meeting on August 14, 2008 at 2:00 pm at the Sr. Center on the Herring River Restoration Project.  A publication identifying findings is available to the public..  

·       Woods Hole Group Beach Renourishment proposal:  Ginie Page moved to proceed with the proposal to perform an assessment of Wellfleet’s beaches; seconded by Dottie Dolan; passed 6-0.  Ginie Page moved that a retainer be paid, followed by payments as each task is satisfactorily completed; seconded by Cyndi Moe; passed 6-0.  

·       An educational bulletin board called The “Green Team” will provide materials to the public and be located at the Harbor.  

·       A tentative meeting is scheduled for August 8, 2008 at 6:30 pm for Harborside Village and other abutters and the applicants for the Mayo Creek Restoration project.  Agent Greenberg reported Jeff Roger’s funding runs out in August and he wants to install the by-directional valve before the funds run out.  He will submit a RDA.

·       Agent Greenberg stated Humphries requested removing the top of a dune on the Stossel property and she told him no.

John DiBlasio stated the Beach and Pond Access Committee is meeting with the Town Administrator on July 21, 2008 at 9:00 am to discuss vehicle access to the Boat House area and from Meadow Avenue to the shell fishing area.  There is a list called “Access to the Sea” and it was recommended it be posted on the educational board at the harbor.

5:00 pm  Shactman, 30 Riverside Rd., Map 8, Parcel 212:  Certificate of Compliance.  Dottie Dolan stated the project is complete.  Ginie Page moved to issue the Certificate of Compliance; seconded by Cyndi Moe; passed 7-0.

5:02 pm Goodman, 55 Coors Way, Map 13, Parcel 154:  Certificate of Compliance.  A site visit was made and the project is complete.  Ginie Page moved to issue the Certificate of Compliance; seconded by Terry Gips; passed 7-0.  

5:05 pm Emmett, 13 Second St., Map 30, Parcels 162 and 184, NOI, construct new dwelling.  Katelyn Siddell, of East Cape Engineering, gave an overview of the project.  She stated the owners will keep the property as natural as possible.  The owners want to locate a large portion of the house within the 100’ buffer zone in order to maintain a view.  Ginie Page stated she would like to see the house moved back out of the buffer zone.  Ed Reynolds suggested the garage be rotated to give a straight driveway which would allow the house to be moved back further.  Hillary Greenberg told Katelyn she will have to provide an alternative analysis if the dwelling is located within the 100’ buffer zone.  An abutter located on Parcel 434 stated she would like to see the driveway come in from addressStreet1st street because there are already three driveways on Second Street.  Katelyn requested a continuation to August 6, 2008 in order to have a discussion with the owners.  Dottie Dolan moved to continue to August 6, 208 at the request of the applicant; seconded by John DiBlasio; passed 7-0.
    
5:24 pm  Thayler, 250 Meadow Ave West, Map 40, Parcel 158, NOI, use of sandbags and sand drift fencing (Cont’d from 04/02/08).  Katelyn Siddell of East Cape Engineering represented the applicant.  Natural Heritage stated it would be a take to move forward with this proposal because of the evidence of diamondback terrapin nesting on the property.  She gave an overview of the proposed project, stating equipment would access the beach through a path, which would be replanted to its natural state.  There is accelerated erosion on the bank.  Discussion took place regarding the sand bag location on the property, side setbacks, and where sand would build up.  There is limited soft erosion control available due to the regulations.  Don Lewis stated he would not be in favor of using drift fencing and would prefer to see the people use additional sand for the erosion issue; if bags were used, there would have to be a minimum of 8 inches of sand over them in order for the turtles to lay their eggs.  He also stated there has to be moisture in the sand.  Lewis stated there are other soft alternatives such as building up with sand and creating a marshland.  Since the turtles are nesting in the existing path, perpetual renourishment through the path would be a negative issue.  Lewis suggested blowing the sand from the landward side.  Dottie Dolan moved to continue the hearing to August 6, 2008; seconded by Cyndi Moe; passed 7-0.    

5:50 pm Sterling/Zigmond, 36 Marsh End, Map 8, Parcel 264, NOI, addition to residence (Cont’d from 7/02/08).  A revised plan was submitted and the oil tank issue was addressed.  Dottie Dolan moved to approve the NOI with a revised plan dated 7/10/08; seconded by Cyndi Moe; passed 7-0.  Supervisor:  Cyndi Moe
5:55 pm  Lee, 50 Ridge View Dr., Map 13, Parcel 136, RDA, Septic Upgrade  Rick Judd represented the applicant and gave an overview of the project describing the location of the work within the 100’ buffer zone.  The current system has failed.  John DiBlasio moved to identify this as a Negative 3; seconded by Dottie Dolan; passed 7-0.

6:04 pm   Lt. Island Association, 5th Ave to Meadow Ave., NOI, Install electrical cable (Cont’d from 6/04/08).  At the request of the applicant, Cyndi Moe moved to continue to 8/20/08; seconded by Dottie Dolan; passed 7-0.

Cyndi Moe moved to adjourn at 6:15 pm; seconded by Dottie Dolan; passed 7-0.
