Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report

Co-Chair Dottie Dolan called the meeting to order at 4:15 pm.

Business Meeting and Agent’s Report

Agent Greenberg asked the Commission if she should respond to a letter received from Orissa Viza.  It was the consensus of the Commission not to respond to the newspaper editorial.  

Gordon Peabody reported Danforth’s septic electrician will be completing the project today and plumbers and electricians and septic installers are communicating.  He completed the soil profile and did not find an excessive amount of fill on the property.  

Dottie Dolan called MACC and they said applications could still be mailed in for the conference.  

John DiBlasio reported on the NRAB meeting he attended and their concerns:
·       Lack of regulations for the ACEC.  
·       Number of revetments.  Greenberg stated there is no Harbor Management Plan in place             and the Commission is protecting the environment by placing conditions on properties                    and following regulations.  
·       They recommend the Mayo Creek Restoration be completed in two to three years and                are looking at the Commission to head it up.  
·       They are concerned about the large homes being constructed
·       They think we are not being stringent enough regarding pervious driveways,
·       They are happy about the oyster reef
·       Paperwork for parcels for Conservation Restrictions are being written up at this time
·       Four parcels have been approved for Affordable Housing of Long Pond Road and they               are concerned about the environment at that location
·       They are planning on starting a “friends of the Harbor” group for fund raising  
The next meeting is April 7, 2008.  Greenberg suggested having the NRAB come to a business meeting or come to Greenberg’s office to discuss their concerns and have an open discussion.  

DiBlasio reported the Coastal Ponds & Access Committee may not continue due to lack of members.  They suggested merging with the Conservation Commission.  Due to our charge, they cannot become a part of the regulatory commission.  Dolan suggested they talk with NRAB.     

Public Hearings t5:00 pm:
5:00 pm  Koff, a230 Bayberry Lane, Map 21, Parcel 126, Certificate of Compliance.  A site visit was made and it was built per plan.  John DiBlasio moved to issue a Certificate of Compliance; seconded by  Cyndi Moe; passed 4-0.  

5:03 pm  Yankelovich, 374 King Phillip Rd., Map 35, Parcel 182, Request for 3 year extension.  Agent Greenberg stated they are requesting an extension in order to monitor the project and renourish it.  Andrew Petty stated a site visit will be done in March.  Cyndi Moe moved to grant the 3 year extension; seconded by Terry Gips; failed 3-1.  After discussion, Cyndi Moe moved to grant the 3 year extension; seconded by Terry Gips; passed 4-0.

5:07 pm  Reilly, NOI, 165 3rd St., Map 40, Parcel 104, Septic Upgrade (Cont’d from 02/06/08).  Jason Ellis represented the application and stated the commission was lacking the DEP number, which has been assigned.  Cyndi Moe requested Ellis submit a new plan delineating the ACEC.  Cyndi Moe moved to approve the revised plan of 02/20/08 and issue the NOI; seconded by John DiBlasio; passed 4-0.  

5:12 pm  Mortenson, NOI, 45 Heron Point Rd., Map 4, Parcel 5.1, Adjust sand drift fence and allow ongoing repairs (Cont’d from 01/16/08).  The applicant requested a continuation to March 5, 2008.  John Diblasio moved to continue to 03/05/08 at the request of the applicant; seconded by Cyndi Moe;
passed 4-0.

5:14 pm  Keller, NOI, 855 Chequessett Neck Rd., Map 19, Parcel 104, Extend revetment (Cont’d from 01/02/08).  David Lajoie of Felco stated they revised the plan to provide access to the sand drift fence from the existing driveway.  The revetment will not be extended.  Natural Heritage recommended a timeframe for the work which he believes is incorrect.  Andrew Petty stated he talked with Lauren McLean of the National Seashore and she advised him the Seashore wanted the applicant to access through their own property.  Cyndi Moe moved to approve the revised site plan dated 12/31/07, Job 07099 to install a sand drift fence; seconded by Terry Gips; passed 4-0 with conditions.  Supervisor:  Ginie Page.        

5:24 pm  Nash, NOI, 80 George’s Way, Map 16, Parcel 160, Septic Upgrade.  Jason Ellis represented the applicant and gave an overview of the project.  John DiBlasio moved to continue to 03/05/08 awaiting DEP number; seconded by Cyndi Moe; passed 4-0.

5:28 pm  Stossel, NOI, 85 Billingsgate Rd., Map 34, Parcel 16, Reconstruct angle and support of coastal bank, construct wood stairway and plant vegetation.  Stan Humphries of LEC and Paul Kreuger, Architect represented the applicant.  Erosion occurred at the site presenting a steep angle of repose and the project would allow the bank to extend out to the neighboring banks, which would allow for plantings, along with the construction of a wood stairway.  Humphries proposed adding a splash pad on top of the revetment and gabion baskets, which would be covered by sand with beach grass planted on them.  The 11 x 17 planting plan would compliment the existing beach grass.  The construction access will be through the existing driveway, with a 10’ wide access road by the east side of the house.  There will be no heavy equipment on the bank, a temporary conveyor and chute will be placed on the bank to transport materials, and a dingo will move materials at the bank area from left to right.   Humphries stated he does not anticipate renourishment for the gabions.  It was recommended a condition be set for replanting the bank.  Agent Greenberg stated NOI’s would have to be filed for the abutters.  There was discussion regarding rocks being placed on the bank which could potentially destabilize it, as well as gabion placement, renourishment on the bank with plantings on it, and renourishment of the revetment and mattress splash pad.  Greenberg requested photographs of the gabion baskets and mattress splash pad.  Humphries stated that due to the erosion, the bank needs to be built up to meet the abutter’s properties as additional scouring could take place.  Biodegradable jute netting will be used on the bank.  Cyndi Moe requested a revised plan identifying the ACEC.  Cyndi Moe moved to continue to 03/19/08, allowing the abutters to submit NOI’s, the engineers to present a revised site plan identifying the ACEC and location of the new dwelling, and photographs of the site for submission to the Commission; seconded by John DiBlasio; passed 4-0.  

6:10 pm  Shactman, 30 Riverview Way, Map 8, Parcel 212, NOI, Install gazebo and ramp (Cont’d from 02/06/08).  A DEP number was assigned.  Terry Gips moved to approve the NOI; seconded by John DiBlasio; passed 4-0.  Supervisor:  Dottie Dolan

6:15 pm  MA Audubon, NOI, off Lt. Island, create oyster reef.   Bob Prescott of the MA Audubon and Dennis Merlin gave an overview of the project and the various materials that would be used.  Prescott stated this is not an oyster grant because no oysters will be sold but will be a controlled scientific oyster reef.   The area is less than one acre with rocks in the area which will prevent navigational issues with boats, as well as any dragging over the area.  Shell bags will be set out in triangles and filled with cultch and spat blocks may be used as well.  The height is restricted to 18” or lower.  Several organizations and state agencies are involved in this project.   The meeting with the Division of Marine Fisheries is scheduled for March 2008.  Chet Lay will survey the triangles in July 2008.  Access is either foot or boat.  There will be control sites set up to do research on the fish population, disease of the oysters, growth of the oysters, birds sitings, etc.   The other agencies will be working with MA Audubon in the future to determine the materials to be used.  All materials will be floated to the site by barge and installed in place.  Cyndi Moe moved to continued to April 2, 2008 to receive a DEP number and allow the applicant to gather additional information from other agencies; seconded by PJohn DiBlasio; passed 4-0.     

Other Business:

Cyndi Moe moved to accept the February 6, 2008 meeting minutes as corrected; seconded by John DiBlasio; passed 4-0.

Agent Greenberg will draft a letter to the NRAB to request a meeting between two members of their Committee and two members of our Commission to have an open discussion.

Cyndi Moe Moved to adjourn at 7:00 pm; seconded by Terry Gips; passed 4-0.
