Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report  
Co-Chair Ed Reynolds opened the meeting at 4:02 pm.  

Jurisdictional Opinions:

Baldini, Harborside PlaceTypeVillage, replace shed with a higher door.  Dottie Dolan moved to issue a positive Jurisdictional Opinion and allow replacement of a shed the same size with an increase in height; seconded by John DiBlasio9; passed 5-0.

Risch, Billingsgate Road, construct 8’ x 12’ shed.  John DiBlasio moved to issue a positive Jurisdictional Opinion; seconded by Dottie Dolan; passed 5-0.

Lloyd, 1728 State Hwy, test well for potable water.  If the water tests potable, a RDA will be filed for installation of well.  Ginie Page moved to issue a positive Jurisdictional Opinion; seconded by John DiBlasio; passed 5-0.

Shimko,5 Samoset Ave., replace d-box and add a riser.  Cyndi Moe moved to issue a positive Jurisdictional Opinion; seconded by Dottie Dolan; passed 5-0.

Garrison, 550 Cahoon Hollow Rd., remove pine tree. John DiBlasio moved to issue a positive Jurisdictional Opinion; seconded by Ginie Page; passed 5-0.

AGENT REPORT:

Agent Greenberg reported the following:
·       New plans for the Currier stairs
·       Open Space request for the Whitman property.  She spoke with Mike Flanagan who told her the property was made of dredged spoils from the 1950’s.  When the town purchased the land, it was not used for spoils.  He would still like to use the land for dredge spoils and dewatering in the future.  Mark Robinson of Cape Cod Compact of Conservation Trust   stated a restriction could be put on the land and specify that dredge spoils could be put on it.
·       There is an opportunity for a Land Management Grant with a deadline of Oct. 1, 2007.
·       The Order of Conditions for 120 Paine Hollow Road has been appealed.  Administrative changes need to be made to the Order of Conditions.  The August 15, 2007 letter was not included in the conditions.  The attorney and David Bennett will come to the hearing later in the meeting.
·       The DPW supplied a listing of roads to be paved.  The Commissioners were requested to make a site visit  to the roads and list their concerns.  The results need to be reported at the next meeting, October 3, 2007.
·       There is $24,000 + / - money available for use with a consultant or engineer for reviews or project, etc.

MISC.

·       John DiBlasio referenced an editorial in the Cape Codder regarding clear cutting and the various fines in different towns.  The Cape Cod Times wrote an article about reducing phosphates, typically using correct detergents, etc.
·       There was discussion how to get information out to the public and a flyer was suggested as well as an article in the Cape Codder.
·       Dottie Dolan reported Uncle Tim’s Bridge is going to cost more than the original budget.  Dottie wondered if we could apply for the Land Management grant for the bridge.  Agent Greenberg stated other towns have town gardens, park benches, fruit patches, etc.

Dottie Dolan moved to approve the meeting minutes of 09/05/07 as corrected; seconded by Ginie Page; passed 5-0.

Attorney Peter Koff sent Agent Greenberg a letter regarding 120 Paine Hollow Road.  Agent Greenberg stated many issues in the letter were incorrect.  Acting Town Administrator, Rex Peterson, advised Hillary not to respond to the letter and put it in the file should legal action be taken.

Greenberg reported Danforth’s house should be lowered by the end of the week.

Public Hearings 5:00 pm:

5;00 pm  Brown, 290 Blue Heron Road, Map 42, Parcel 123, NOI, construct new dwelling (Cont’d from 09/05/07).  Katelyn Merrill of East Cape Engineering represented the applicant.  At the request of the applicant, Cyndi Moe moved to continue to 710/03/07; seconded by Dottie Dolan; passed 5-0.

5:01 pm  Central Wharf Assoc., LLC, 3 Kendrick Ave., Map 21, Parcel 112, NOI, Construct pier, ramp and float over a coastal beach.  Per Katelyn Merrill of East Cape Engineering, the applicant requested to withdraw without prejudice.  Dottie Dolan moved to allow the applicant to withdraw without prejudice; seconded by John DiBlasio; passed 5-0.

5:03 pm  Currier-McCormick – Trustee, 1025 Chequessett Neck Rd., Map 19, Parcel 19-2, NOI, Installation of stairway over coastal bank.  Katelyn Merrill of East Cape Engineering represented the applicant and gave an overview of the project.  The revised plan is 09/12/07, relocating the path to avoid removing vegetation and allowing the area with no beach grass to remain the same for the Diamondback Terrapins.  The work will be hand done.  Merrill stated all vegetation would be replaced if it was removed.  To date, no DEP number had been assigned and there was no response from Natural Heritage.  Cyndi Moe moved to continue to October 3, 2007; seconded by John DiBlasio; passed 5-0.

5:17 pm  Huge, 264 King Phillip Rd., Map 34, Parcel 9, Certificate of Compliance.  John Huge, son of the applicant, stated his parents would like to renourish while the work is being done on the stairway.  Agent Greenberg stated a condition would be put on the Certificate of Compliance regarding renourishment.  Huge stated he was reluctant to sign up for perpetuity of the renourishment.  Cyndi Moe moved to continue to 10/03/07 at the applicant’s request, seconded by John DiBlasio; passed 5-0.

5:22 pm  Huge, 264 King Phillip Rd., Map 34, Parcel 9, NOI, replacement of existing stairway over coastal bank.  Katelyn Merrill of East Cape Engineering and John Huge, son of the applicant, gave an overview of the project.  This will be an elevated stairway, with a slight change in footprint of the original stairway.  This is exempt from MESA review because the footprint is not changing much.  No DEP number had been received.  Dottie Dolan moved to continue the hearing to 10/03/07; seconded by John DiBlasio; passed 5-0.

5:30 pm  Stossel, 85 Billingsgate Rd., Map 34, Parcel 6, Request for Amended Order of Conditions for Access Stairs.  Mark Burgess of Coastal Engineering gave an overview of the project.  The revetment will be built per the original approved Order of Conditions and plans; however, since it was permitted, the bank has shifted dramatically so additional sand needs to be put at the base of the bank.  The Stossel’s want to revegetate the entire bank with beach grass.  There was discussion regarding the ownership of the property at the beach area.  Dottie Dolan moved to approve the amendment for the access stairs (SS77-1053); seconded by Ginie Page; passed 5-0.

5:47 pm  Malone (Housing Authority) 120 Paine Hollow Rd., Map 29, Parcel 300, Amended Order of Conditions, construct driveway and drainage for proposed residential affordable dwellings.  Agent Greenberg advised the Commissioners the letter of 08/15/07 from East Cape Engineering needs to be incorporated as a condition.  Cyndi Moe moved to include the August 15, 2007 East Cape Engineering letter as a condition to the Original Order of Conditions; seconded by John DiBlasio; passed 5-0.

Dottie Dolan moved to adjourn at 5:50 pm; seconded by John DiBlasio; passed 5-0.
