Minutes of Conservation Commission Public Meeting

4:00   Meeting & Conservation Agent's Report
·       Co-Chair John DiBlasio called the meeting to order at 4:05.  

Agent Hillary Greenberg:

·       Pilcher’s filings were for fencing and renourishment.  There were no filings for burying a whale.  Agent Greenberg suggested getting in touch with Alfred Pickard and Paul Murphy.

·       Paperwork was received requesting permission to use an ATV on addressStreetLeCount Hollow Road down to the beach.   The individual had an injury which resulted in the loss of a leg, and is requesting the use of the ATV to transport him from his home to the beach.  The Commissioners are concerned because the dune is very fragile.  Agent Greenberg will forward the request to the Selectmen for their advice and direction.    

Jurisdictional Opinion:  Peg Andre, erect a shed 75’ from the wetland.  Dottie Dolan moved to approve the JO; seconded by Ed Reynolds; passed 4- 1 – 1 abstain.    

·       Gordon Peabody, who is performing work at 266 King Phillip Rd., informed Agent Greenberg he will be filing an amended order of conditions for a field change for the stairs.  

·       Warren Woods contacted Agent Greenberg and requested the Commission review photographs of erosion he has taken.  He is available June 20th for the Commissioners to visit him.  

·       Agent Greenberg sent a letter to McDonald stating her property had been cleaned up.

·       NSTAR will be spraying for brush along the roads with power lines.  They did file with Natural Heritage


·       Due to concerns of Ritter, the Jurisdiction Opinion for Lt. Island Trail will require Agent Greenberg to file with MESA.  Ritter requested a copy of the tape of the meeting minutes.  A letter addressed to John DiBlasio from Gallston, an abutter, requested a response from him directly regarding the trail.  

·       Agent Greenberg went to court and the judge has given Audrey Danforth until August 21, 2007 for a final judgment

·       Agent Greenberg will try to locate Lonnie’s letter of resignation and submit it to the Selectmen

Paul Banner expressed concern about people in the audience making statements not relative to our jurisdiction during public hearings which could be false statements or personal remarks.  

John DiBlasio thanked Paul Banner for his dedicated service to the Commission.

Footit has finished his project and John DiBlasio and Andrew Petty will make a site visit.

Dottie Dolan moved to approve the meeting minutes of April 18, 2007 as amended; seconded by Ginie Page, passed 6-0.     
         
Public Hearings:

5:05 pm  Malone (Housing Authority), 120 Paine Hollow Rd., Map 29, Parcel 300, NOI, construct driveway and drainage for proposed residential affordable dwellings, Cont’d from 06/06/07.  The applicant requested a continuation to July 18, 2007.  Cyndi Moe moved to continue to 07/18/07; seconded by Dottie Dolan; passed 6-0.

5:08 pm Town of Wellfleet, Powers Landing, Map 19, Parcel 157, RDA, designated area for small craft storage.  A site visit was made.  Ginie Page moved to identify this as a Negative 2; seconded by Dottie Dolan; passed 6-0.  A sign will be placed between the designated area stating “Boat Storage permitted only between signs.   Boats are permitted between April 30 and October 31”.  Ginie Page will supervise.  The Commission will review the project again next year to discuss the success or issues of the designated area.

5:10 pm  Town of Wellfleet, End of Nauset Rd, Map 22, Parcel 36, RDA, designated area for small craft storage.  .  Dottie Dolan moved to identify this as a Negative 2; seconded by Ed Reynolds; passed 6-0.   A sign will be placed between the designated area stating “Boat Storage permitted only between signs.  Boats are permitted between April 30 and October 31.  The Commission will review the project again next year to discuss the success or issues of the designated area.  
 
5:13  Town of Wellfleet, Mayo PlaceTypeBeach, Map 20, Parcel 9, RDA, designated area for small craft storage.  A site visit was made.  Ginie Page moved to identify as a Negative 2; seconded by Cyndi Moe; passed 6-0.   A sign will be placed between the designated area stating “Boat Storage permitted only between signs.  Boats are permitted between April 30 and October 31.  The Commission will review the project again next year to discuss the success or issues of the designated area.  

t5:15 pm  Town of Wellfleet, Omaha Beach,  Map 28, Parcel 234, RDA, designated area for small craft storage.  Agent Greenberg reported the location will be changed to the west edge of the north side of the road.  Ginie Page moved to identify as a Negative 2; seconded by Cyndi Moe; passed 6-0.  A sign will be placed between the designated area stating “Boat Storage permitted only between signs.  Boats are permitted between April 30 and October 31.  The Commission will review the project again next year to discuss the success or issues of the designated area.  

5:18   placeAdams, Lot 29, Rte 6, Map 36, Parcel 262.1, Request for Extension to Order of Conditions.  Agent Greenberg stated the applicant requires additional time.  Cyndi Moe moved to extend the Order of Conditions for 2 years; seconded by Dottie Dolan; passed 6-0.  Ed Reynolds will supervise.

t5:19 pm  Ender, 145 Samoset Ave., Map 28, Parcel 104, Request for Extension to Order of Conditions.  Agent Greenberg advised the Commission this is the sea wall and landscaping project and will require a new nourishment condition.  Cyndi Moe moved to extend for another 2 years with conditions; seconded by Dottie Dolan; passed 6-0.  New supervisor is Cyndi Moe.

5:20 pm  Harborside Village, Map 20, Parcel 19, Amendment to Order of Conditions, identify egresses.  Anne Marie Zerega represented the Association.  Agent Greenberg stated she had met with the current President of the Association and advised her each replaced trailer requires an additional egress under the building code.  Some of the egresses will have landings.  A letter was sent to the owners that there is to be no storage under the trailers.  Cyndi Moe stated there is a condition there are to be no sheds on the property, only one communal shed.  This is due to toxic materials.    Cyndi Moe moved to approve the Amendment to the Order of Conditions; seconded by Ed Reynolds; passed 6-0.   

5:30 pm  Murray, 410 King Phillip Rd., Map 35, Parcel 186, Amendment to Order of Conditions,  vegetation.  David Lajoie represented the applicant and stated there is a revised landscaping plan.  Dottie Dolan moved to approve the Amended Order of Conditions; seconded by Paul Banner; passed 6-0, with the condition that organic materials be utilized.  Ginie Page is the supervisor
5:35 pm Moore, 975 Chequessett Neck Rd., Map 19, Parcel 96, NOI, repair existing concrete revetment.  A site visit was made.  Tom Dickey represented the applicant and gave an overview of the project.  He stated the whole wall would be recoated.  The wall is made of cinder blocks with a concrete footing.  Cyndi Moe noted the top of the wall appeared to require repair as well.  Dickey will repair all areas and will plant some vegetation as well.  Ed Reynolds moved to approve the NOI; seconded by John DiBlasio; passed 6-0 with conditions:  Ginie Page is the supervisor.

5:45 pm  O’Connor, 90 Lecount Hollow Road, Map 30, Parcel 9, AOOC, addition of screened porch and enlargement of footprint for stairs (Cont’d from 06/06/07).  Emily Beebe represented the applicant.  The amendment is to allow the brick foundation be removed and rebuild the kitchen and add a sun porch supported by sonotubes.  DiBlasio, the supervisor, is to be advised of all phases of construction so he can be in attendance.  Beebe stated the proposed second story stairs have received a different design than was originally approved for safety issues.  Dottie Dolan moved to approve the AOOC and vegetation plan; seconded by Cyndi Moe; passed 6-0.           


Ginie Page moved to approve the meeting minutes of 06/06/07 with amendments; seconded by Cyndi Moe; passed 6-0.

Cyndi Moe moved to adjourn the meeting at 6:15 pm; seconded by Ed Reynolds; passed 6-0.
