Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report  

Ed Reynolds opened the business meeting at 4:00 pm.  

Jan Plaue and Lynn Southey of the Open Space Committee requested the Commissioners support a conservation restriction for Map 28, parcels 82, 80 and 239.  Ms. Plaue and the Commission discussed access for the shell fishermen and de-water dredging on the property.  Concern regarding if DEP would allow the dredging spoils on the land was discussed.  Plaue will go to the Town and DEP to get additional information and report back to the Commission her findings.

Meeting Minutes:

Cyndi Moe moved to approve the June 20, 207 meeting minutes as amended; seconded by PersonNameJohn DiBlasio; passed 5-0.

Ginie Page moved to approve the July 18, 2007 meeting minutes as amended; seconded by Cyndi Moe; passed 4-0.

Harborside PlaceTypeVillage Co-Operative:  Meeting minutes of 10/19/05 states that no sheds will be allowed with the replaced trailers.  There was discussion as to how to interpret the condition placed on the approved NOI for the replaced trailers regarding hazardous materials.    The Commission determined grandfathered sheds are allowed on the property and will be removed when a trailer is replaced.  After answering several questions from trailer owners regarding sheds and the control of hazardous materials, Agent Greenberg recommended an amendment be made to the conditions stating that the co-operation would monitor the hazardous materials in the grandfathered sheds and the communal shed for the 17 replaced trailers.  This will be added to a future agenda.   

Mortensen, 25 Heron Point Rd., Map 40, Parcels 5.0 and 5.1  Agent Greenberg stated a drift fence was erected without a proper filing.  Mr. Mortensen stated a fence was originally approved in 2001 and was destroyed by weather.  He did not realize he had to come back to the Commission and to get permission to rebuild the fence.  Mr. Mortensen has filed a new NOI.  Cyndi Moe moved to dismiss a fine without prejudice; seconded by Ginie Page; passed 5-0.      

Public Hearings:

5::03 pm   Goldman, 266 King Phillip Rd., Map 34, Parcel 8, Amended Order of Conditions:  relocate steps and entry walkway, add enclosure and steps to outdoor shower.  Gordon Peabody and Joy Cummings represented the applicant.  placeCityPeabody stated work had begun without approval from the Commission.   The owners changed the design of the walkway several times.  The footprint will not change, but it will swing around for a more aesthetic look.  Agent Greenberg gave approval for the shower to be installed prior to this hearing.  Ginie Page moved to approve the amended plans; revised 8/15/07, seconded by Dottie Dolan; passed 5-0.  The conditions will remain the same, with the revised cover letter to be noted.  The supervisor is John DiBlasio

5:18   Capuano, 35 Holden Ave., Map 20, Parcel 138, RDA, septic upgrade and construction of retaining wall and stone driveway.  George Riley represented the applicant and explained that a tight tank is proposed.   The Board of Health has already approved this project.  The construction will take one day.  Cyndi Moe moved to identify this as a Negative 2; seconded by John DiBlasio; passed 5-0.  

5:24 pm   Malone (Housing Authority), 120 Paine Hollow Rd., Map 29, Parcel 300, NOI, construct driveway and drainage for proposed residential affordable dwellings (Cont’d from 07/18/07).  Tim Brady of East Cape Engineering represented the applicant.  Discussion took place regarding alternative sites for wells.  Brady reported water storage tanks will be provided in each building to hold one day’s worth of water (110 gpd per bedroom).  Abutters expressed concern about the impact on their wells.  Brady stated should the abutters have problems with their wells, they are to contact the Housing Authority for assistance.  There should be no impact on water 30 feet away from the proposed well according to tests.  David Bennett of Bennett & O’Reilly, acknowledged he approved of the plan and feels the storage capacity is a solution.   He stated the Town is comfortable with the calculations provided.  Cyndi Moe moved to approve the project to construct a driveway and drainage with conditions; seconded by Dottie Dolan: passed 5-0.  Supervisor:  Agent Hillary Greenberg

5:45 pm  Krasting, 180 Cliff Rd., Map 24, Parcel 84, NOI, Relocate dwelling and reconstruct decking (Cont’d from 07/18/07).  David Lyttle and Melinda Krasting represented the project.  No broom crowberry was found in the survey.  Therefore, Natural Heritage had no problems with the project.  Lyttle stated he would like to install snow fencing around the decking after completion.  Agent Greenberg  suggested an amendment for the drift fencing.  Dottie Dolan moved to approve the NOI; seconded by Ginie Page; passed 5-0. with conditions:  Supervisors  PersonNameJohn DiBlasio and Agent Greenberg and Assistant Agent Andrew Petty.
5:55 pm  Sorrell (Pleasant Water Inc.), Intersection of Pond Rd and Pleasant Point Rd, Map 35, several parcels, NOI, excavation and removal of PWS mains, construct new Public Water Supply mains
(Cont’d from 7/18/07).  David Bennett and Liz Sorrell stated they held a public hearing for owners of the property, giving a brief update on the plan.  A small amount of the trenching will be in the buffer zone which corresponds with the roads in the area.  There is a vegetation and stabilization plan in place.  The work must be performed between Oct and April.  Bennett gave an overview of disinfection of the water lines.  Mike Quink informed Agent Greenberg that it would be better to leave the materials in place and not disturb the environment.  If old materials are found, they will be removed.   The new water lines will be placed in the location of least resistance, backfilled, and reseeded.  A brief discussion took place regarding fire safety issues.   Cyndi Moe moved to approve plan B0064453 dated 6/14/07; seconded by John DiBlasio; passed 5-0.  Agent Greenberg and Assistant Agent Petty are supervisors.   

6:10 pm  Reilly, 165 3rd St., Map 40, Parcel 104, NOI, remodel dwelling and install walkways and landscaping.   Cyndi Moe moved to continue this hearing to 9/05/07 because of the late filing; seconded by John DiBlasio; passed 5-0.

6:11 pm  McNamara, 80 Designers Rd., Map 23, Parcel 68, NOI, construct addition and install new well:  Cyndi Moe moved to continue to 9/05/07 because of the late filing; seconded by Dottie Dolan; passed 5-0.

6:12 pm  Hill, 20 and 30 Ryder Court, Map 14, Parcels 11 and 12, NOI, Septic Upgrade and installation of new well.  Cyndi Moe moved to continue to 9/05/07 because of the late filing; seconded by John DiBlasio; passed 5-0.

Other Business:

Ditoro, 170 Blue Heron, Map 42, Parcel 133:  the Commission requested Agent Greenberg make a site visit to inspect the construction.  

Jurisdictional Opinion:  Paul Banner, 325 King Phillip Rd, Map 35, Parcel 196: permission to plant placerosa rugosa in a bare area.  John DiBlasio moved to approve the Jurisdictional Opinion; seconded by Ginie Page; passed 5-0.

Massari, 244 King Phillip Rd., Map 34, Parcel 13:  Agent Greenberg recommended an Amendment to Ongoing Condition #9 for the Certificate of Compliance.  Agent Greenberg recommended changing the renourishment criteria to 108 cubic yards (plus or minus) and give him an option to have a survey performed to determine if it is required.  Dottie Dolan moved to approve amended condition #9 for the Certificate of Compliance; seconded by Cyndi Moe; passed 5-0.

Further discussion took place regarding the conservation restriction and the de-watering of conservation land.  Agent Greenberg stated the Town would have to file an NOI for the de-watering.

Ginie Page expressed concern about the DPW widening Old High Toss Road.  Agent Greenberg made a site visit with NPS staff and DPW.

Cyndi Moe moved to adjourn the meeting at 6:25 pm; seconded by Dottie Dolan; passed 5-0.
