Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report

Meeting called to order by Co-Chair John DiBlasio at 4:00 pm.  
  
·       Agent Greenberg distributed information from the MACC handbook on the conditions for storm water management for consideration of 250 Gull Pond Road.  

·       The Herrring River Technical Committee is working on a 2nd MOU to be presented to the Selectman within the next 6 months for the conceptual plan.  Brochures have been distributed to Town people.

·       Kandell property:  the Conservation Restriction was sent to Environmental Affairs and a letter was sent to Mark Burgess advising him the Commission was not in favor of an application being sent in.  

·       The Commissioners were requested to pick up their packages for the meetings in a timely manner.

·       The Pearson project is going to start within the next week and construction could last a month.  

·       Audrey Danforth had her survey completed and is going forward to the ZBA for the shed.  

·       Andrew and Hillary waiting to meet with the Harbormaster regarding the boats on town land.

Brochure from Coastal Studies asking for volunteers to monitor the bay.

·       There was discussion regarding cleaning out catch basins on private roads.  Agent Greenberg will try to locate additional contractors and talk with the DPW.  The Conservation Commission has the authority to enforce the cleaning of catch basins by sending letters to residents living on a private road.  

Meeting Minutes:   Ginie Page moved to accept the 02/07/07 meeting minutes as amended; seconded by Lonni Briggs; passed 4-0.      

·       Agent Greenberg discovered a letter from 1976 regarding the issues of boats being left on Town Land and shared it with the Commission.
·       Data are being collected atWhite Crest Beach for the possibility of a wind mill.
Gordon Peabody distributed a letter from Emily Beebe requesting a withdrawal of a RDA for Frank Caulfield, Neighborhood Auto and Coach, and recommending a working meeting between herself, Gordon Peabody and the Conservation agents.  Agent Greenberg stated she made a site visit and informed Caulfield he was directing storm water into a wetland area.  Agent Greenberg stated an enforcement order would result in a NOI.  Peabody disagreed and recommended working together to come to a resolution.  Andrew Petty stated he felt the Commission should be included.  Further discussion took place regarding if the wetland is recognized by the state.  Due to the start of public hearings, Agent Greenberg advised Peabody he could come back to discuss this matter further after the hearings were complete.  
  
Public Hearings 5:00 pm:

5:00  Community Housing Resource, 250 Gull Pond Rd., Map 8, Parcel 38: NOI, Construct driveway and drainage for proposed affordable dwellings.  Ted Malone, Community Housing, Eric Larson and  Chris Wickson of East Cape Engineering gave an overview of the project.  The Zoning Board of Appeals will review the project as well.  An overview of the Storm Water Management was presented.  Ginie questioned the driveway and safety and Ted stated it is an acceptable slope at 14.3%.  The upper part of the hill will maintain the trees and there will be limited views of the units.  At the present time, there is no written maintenance plan for the storm water, and Larson suggested taking a measurement of sediment to schedule maintenance.  The dwellings will be under condo ownership so maintenance will be taken into consideration in their deed.  Discussion took place about alternatives available for access to the property.  An abutter expressed concern with erosion.  Larson stated the greatest portion will remain in its natural state and will be revegetated and stabilized.  The abutter questioned whether his well water would be affected and Malone responded no. Dick Lay stated he owns the wetland by Eel Creek and is concerned with the access.  His concerns include “1 to 1” side slopes and sediment and salt running into Eel Creek.  He anticipated the 50’ filter strip would be destroyed and there will be a disturbance of 6,000 sq. ft.  He would like to see a written alternative analysis.  He questioned if Oakdale Road, Old Gull Pond Road, eminent domains or easements from private land owners could serve as an alternative access.  Agent Greenberg requested a draft alternative analysis plan and a remediation with planting plan.  It was recommended a sample of Eel Creek be taken now to obtain  baseline data.  Wickson is concerned with the accuracy of a sample based on the salt runoff from Gull Pond Road.  MESA and Natural Heritage letters had not been received.  Paul Banner moved to continue to March 7, 2007; seconded by John DiBlasio; passed 4-0.  Elaine LaChappelle will check into eminent domain and Elaine McIlroy stated they will do further research regarding properties on Gull Pond Road.              

5:45  Town of Wellfleet, TheHerring  River “Gut”, NOI, install snow fencing to protect the dunes.  The applicant requested a continuation.  Ginie Page moved to continue 3/7/07; seconded by Paul Banner; passed 4-0.   

5:48  Sayre, 111 Wiles Lane, Map 16, Parcel 629, RDA, septic upgrade.  Chris Wickson of East Cape Engineering represented the applicant.  He gave an overview of the project.   Agent Greenberg requested a monolithic tank be used.  Ginie Page moved to identify this as a Negative 3; seconded by Paul Banner; passed 4-0.  

5:54  LaPoint, RDA, Shellfish License.  Approval has been received from the Selectmen and the State.   The Army Corp is reviewing his application.  Access will be through addressStreetOmaha Road.  Ginie Page moved to approve the application for the grant and identified it as a Negative 2; seconded by Paul Banner; passed 4-0 with the following conditions:  access from Omaha Road,  no storage of materials on any banks, beach or dune, and boats can only be stored on the grant.   

6:04  Kratky, 105 Billingsgate Rd., Map 28, Parcel 194: RDA, septic installation.  A Certificate of Compliance was issued for several projects, including the septic.  However, the septic was never installed.  Agent Greenberg stated the plan is still valid, as approved.  Ginie Page moved to approve the RDA as a Negative 3 to complete the installation of the septic; seconded by John DiBlasio; passed 4-0.

6:05 pm  Maxson, 915 Chequessett Neck Rd., Map 19, Parcel 102, NOI, septic upgrade (cont’d from 02/07/07 )  John Schnaible represented the applicant and gave an overview of the project.  Lonni Briggs moved to approve the NOI; seconded by John DiBlasio; passed 4-0.

Becausse Peabody did not return to the meeting, Agent Greenberg will send a letter to Mr. Caulfield, Emily Beebe and PersonNameGordon Peabody requesting them to attend the
March 7, 2007 meeting.  

John DiBlasio moved to adjourn at 6:30 pm, seconded by Lonni Briggs; passed 4-0.
