4:00 - Business Meeting & Conservation Agent's Report  
Dottie Dolan, Co-Chair, called the meeting to order at 4:03.  

Shellfish Advisory Committee and Shellfish Constable Andrew Koch, Helen Miranda Wilson, and Guy Daniels came to the Commission to discuss trucks driving over shellfish areas.  Guy Daniels questioned if there are limitations on trucks on the tidal flats and what enforcement there is.  Agent Greenberg asked if they had received her letter dated 1/3/07.  Helen stated there are areas in town that naturally have shell fish on them that are called productive areas.  When there are clams and oysters visible at any stage, this is a productive area and there cannot be any grants.  Andy stated grants are given in non-productive areas.  Helen stated it is Conservation Commission’s business to enforce regulations.  There is a particular area on placePlaceNameOmaha PlaceTypeBeach where a truck drove over juvenile shellfish beds.  Andy Koch asked the Commission to advise the Shellfish Dept. of any proposed activity on the beach; he then can block off an area with cinder blocks painted orange to prevent trucks from driving over the beds.  Agent Greenberg stated there will be further renourishment of revetments, but all revetments are currently built.  Paul identified the area where there is a double revetment (Nemitz property), and the Corps of Engineers refused to have it taken down.  He stated the construction of revetments and renourishment must be done in a specific timeframe.  Andy Koch stated the grant owners are careful about driving over any productive and grant areas.  There was discussion regarding the barges and boats on town property.  Agent Greenberg stated they are going to try to find designated areas on Town property for winter storage.  Helen Miranda Wilson requested to be informed of any future meetings regarding boats on town property.  Dottie Dolan suggested we add to our protocol that the Shellfish Warden be involved in site construction and be invited to the site visit.  Ginie Page moved to include the Shellfish Constable in the pre-construction site visit; seconded by Ed Reynolds; passed 5-0.  Because Andy Koch makes frequent visits to all the shellfish areas, Paul Banner requested him to advise the Conservation Agent of any violations of regulations.  Agent Greenberg advised the Commission that Andy K has the authority to give out tickets to offenders.  Paul also stated the summer visitors sometimes drive over the beach or drag their boats over the beach and Andy Koch replied he usually gives warnings.  Paul Banner’s neighborhood is going to advise people they must get permission to launch boats.  
     
Mark Burgess of Coastal Engineering came to discuss the possibility of expanding the Kandell rock revetment.  The existing rocks end within 15’ of the property line per our local regulation.  Currently there is a dwelling above the exiting revetment.  Ms. Kandell would like to extend the rocks with a low wall similar to the Pearson’s approved plan.  Agent Greenberg was opposed to this idea as there is no structure above the area in discussion.  Banner asked if we are creating a new problem with future erosion if renourishment does not take place.  Greenberg stated that it is the property owners responsibility to renourish.  Burgess avowed that vegetation will never grow on the 30’ opening now exiting between Pearson and Kandell properties.  Discussion regarding beach access and renourishment took place.  Petty stated that the erosion at this location is very slow so the Commission can take its time determining what they would like to see done.  Agent Greenberg concluded that the Commission would have further discussion on this matter and she would write a letter to Burgess with their suggestions.
        
Public Hearings 5:00 pm:

Costa, 100 Kendrick Ave, Map 20, Parcel 8, RDA:  Upgrade Septic System.  Beebe represented the applicant and gave an overview of the project.  The project is within the flood zone and needs to be updated due to the potential sale of the property.  There will be some regrading.  The plans do not identify some of the trees to be taken down or the elevations of the property.  Agent Greenberg stated the lawn doesn’t appear to be fertilized.  Agent Greenberg asked Emily the ground water elevation.  She replied there will be over 3 ½’ of fill.  Agent Greenberg suggested the septic tank be watertested.  Paul Banner identified this as a negative 2; seconded by Ginie Page; passed 5-0 with conditions.

Town of placeCityWellfleet, Kendrick Ave, Map 21, Parcel 114:  Extension Permit for Orders of Conditions (Town Pier Expansion).  Agent Greenberg stated the Order of Conditions expire in March 07 and the Town is requesting an extension of another 3 years.  Ginie Page moved to permit the extension; seconded by Ed Reynolds; passed 5-0

Business Meeting Continued.

Representatives from the Open Space Committee and Peter Hall of the Conservation Trust came to discuss forming a subcommittee between the Boards on how to conduct the inspections of town owned land.   Jan Plaue spoke on behalf of the Open Space Committee.  She stated they are looking to conduct the inspections either at the end of winter or in the spring.  Ginie Page will represent the Conservation Commission and John DiBlasio will be the alternate.   Bob Jackson is the representative from the Open Space Committee.   A meeting is scheduled for Feb. 14 at 11:00 at the DPW building.  Dottie suggested a management plan which identifies animals and plants located on the property be discussed at the meeting.   

Agent Greenberg reported she received a letter from the Herring Warden which advised they have scheduled four (4) days (1/22/07, 1/27/07, 3/2/07 and 3/09/07) to burn brush piles and remove blockages in the stream at the Merrick and BoundBrook Island area.  

 Paul Banner moved to approve the Jurisdictional Opinion ; seconded by Joihn DiBlasio; passed 5-0.    
Dottie Dolan reported there will be a Storm Water management / sediment seminar on Jan 22, 2007 at  9:00 am at the Eastham Town Hall.  
Dottie Dolan reported PersonNameGordon Peabody and Emily Beebe have scheduled a meeting at the  Library on 2/1/07 regarding water issues.

Agent Greenberg reported Audrey Danforth’s Court appearance is scheduled for January 26, 2007.  A  ticket was issued for her to remove all the wood from the back yard and store it on the leach field.  Danforth’s Order of Conditions has expired at this point.  Gilmore:  Agent Greenberg continues to issue  tickets everyday to Gilmore.  She still has to move garbage into containers and was told house is on the market.  

Agent Greenberg stated she is waiting for a plan from Emily Beebe for the Neighborhood Garage.  She and Andrew will make a site visit.

Ginie Page suggested using the sand pit as a storage area for boats and charge a small fee.  Any boats not claimed will be put up for auction or be donated.  

Paul Banner moved to approve the Meeting Minutes of 1/3/07 as corrected; seconded by John DiBlasio; passed 5-0.

Agent Greenberg asked the Commission if they wanted to take any action with Valli’s barge.  The Harbormaster cannot do anything further and the Town has become involved as well.  Paul Banner suggested there be no immediate action and ask Valli to provide an alternative plan for next year.  

Dottie Moved to adjourned at 6:05; seconded by Ginie Page; passed 5-0.
