Minutes of Conservation Commission Public Meeting

Commissioners Present:  Co-Chair John DiBlasio, Co-Chair Dottie Dolan, Lonni Briggs, Ed Reynolds, Paul Banner, Cyndi Moe, and Ginie Page .

4:00 - Business Meeting & Conservation Agent's Report

Co-Chair John DiBlasio called the meeting to order at 4:00 pm.

Gordon Peabody and John Portnoy made a presentation on behalf of the Herring River Technical Committee.  

Public Hearings 5:00 pm:

Kaefer, 205 Gull Pond Road, Map 8, Parcel 64:  Request for a Certificate of Compliance.  A site visit was made and the job is completed as approved.  Dottie Dolan moved to approve the Certificate of Compliance, seconded by Lonni Briggs; passed 7-0.

Kraus and Rosemblum, 130 Valley Rd, Map 9, Parce4l 641: Request for Certificate of Compliance.  Ginie Page made a site visit and reported the project is complete.  Ginie Page moved to approve the Certificate of Compliance; seconded by Ed Reynolds; passed 7-0.

DuBeau, 40 Richman Lane, Map 21, Parcel 29: Request for Certificate of Compliance.  Ed Reynolds made a site visit and reported the project is complete.  Ginie Page moved to approve the Certificate of Compliance; seconded by Cyndi Moe; passed 7-0.  

Cassano, 65 Atlantic Ave., Map 36, Parcel 54, RDA, construct additional driveway (Cont’d from 09/06/06).  Agent Greenberg reported the applicant requested a continuation to October 4, 2006.  Cyndi Moe moved to continue to October 4, 2006 as requested by applicant; Lonni Briggs seconded; passed 7-0.  

Malcynsky,115 Kendrick Ave., Map 20, Parcel 10, NOI, removal of rosa rugosa in buffer zone (Cont’d from 09/06/06).  Agent Greenberg reported a DEP number was issued.  The commission had discussed this hearing previously and the representative is aware of the conditions.  Dottie Dolan moved to approve the NOI; seconded by Ed Reynolds; passed 7-0.  Ginie Page is supervisor.

Himmelsbach,140 Grandview St., Map 14, Parcels 117 and 118: RDA: Alter existing deck with addition. David Lajoie represented the applicant.  He gave an overview of the proposed project. The addition will be the same level as the house.  Cyndi Moe identified the project as a Negative 3 with the Construction Notes included as a condition; seconded by Paul Banner; passed 7-0.      

Pierce, 925 Chequessett Neck Rd., Map 19, Parcel 100, NOI, reconstruct existing bulkhead (Cont’d from 08/06/06).  Peter Markunas represented the applicant.  Markunas gave an overview of the project.  He advised the Commission that some of the work will be done on the Chequessett Yacht Club property.  

Barbara Boone will get written permission from the Trustees of the Yacht Club for this.  A variance was granted to join the rock revetment to the abutting rock revetment.  The bulkhead will be composite material which resembles vinyl.  The cinder blocks will be buried at the site.  The bulkhead will be vertical and will be supported with anchors into the existing bank.  It will be five feet high with ten feet below ground level.  Backfill will consist of flowable fill and the area will be revegetated.  The stairs will extend four feet sideways and will be removed seasonally.  Petty questioned construction note 2 and Markunas clarified that no work would extend into the marsh.  Concern was voiced about access to the site which will be from the Yacht Club or by barge, which Coastal Engineering will monitor. Dottie Dolan moved to approve the NOI C13692 dated timeHour18Minute307/27/06 with conditions; seconded by Cyndi; passed 7-0.  Supervisors are Ed Reynolds and Ginie Page.          

Jurisdictional Opinions:

115 Parkington Hill Rd – remove 6 trees which overhang the deck; 5 are pine and 1 is oak.  Trees are in buffer zone but out of filter strip.  Cyndi moved to approve JO; Dottie seconded; 7-0.

47 Sea Oaks Way, 4 trees overhanging deck which sits on the 50 foot line.  Ginie moved to approve JO;  seconded by Ed Reynolds; passed 7-0.  

Business Meeting (Cont’d)

Agent Greenberg requested a listing of roads slated for pavement in the Town which are near the wetlands, but  no list was provided.  She requested RDA’s  be filed for all roads within wetlands.  The Commissioners will assist in identifying the roads and those requiring improvements such as storm drains.    

Agent Greenberg and Andrew Petty provided a form to the commissioners regarding action items which the commissioners want them to follow up on.

Paul Banner prepared draft for joint groups to maintain beaches.  The Comprehensive Committee is having a meeting and Paul will present the draft to them.  

Agent Greenberg didn’t feel she needed to go to Town Counsel about Harborside.  Greenberg will accept a letter from the Association with their approvals of requests for expansion, alterations, etc.

Cyndi Moe moved to approve the Meeting Minutes of September 6, 2006 with amendments; seconded by Ginie Page; passed 7-0.  

Cyndi moved to Adjourn at6:30; seconded  by Ginie; 7-0.
