Minutes of Conservation Commission Public Meeting

Commissioners Present:  Co-Chair John DiBlasio, Co-Chair Ginie Page, Dottie Dolan, Cyndi Moe,  Ed Reynolds, and Paul Banner.

Meeting called to order at 4:00 P.M. by Co-Chair John DiBlasio.

Ms. Greenberg wrote to Mark Burgess regarding the deviation in the location and size of rocks of the new revetment located at 60 Bayview Avenue.  Burgess responded the revetment was five feet thick and he would have had to cut into the bank order to line up the revetment with the Donalds.  Agent Greenberg told Burgess that when the Certificate of Compliance is reviewed, if there is any damage to the Donald’s, there may be an issue of financial responsibility.  Burgess is coming to the 5/17/06 meeting.  It was recommended a discussion take place regarding the use of chink/filter stones.  

A letter was received from Allison Palmer regarding vista pruning at the Morse property.  Ginie Page and John DiBlasio will make a site visit.

A stop work order was issued to Carla Lewis at 465 Lt. Island Road..  The existing driveway was removed on the coastal bank without the benefit of a permit.  She has applied for an NOI and will be appearing at a future hearing.

Greenberg reported the Herring River Technical Committee is planning to hire a consultant.  The  consultant will determine what is needed in terms of culverts, dike opening, etc.  The technical committee may be disbanded and a new oversite committee formed with representatives from several committees and other agencies.  Agent Greenberg stated they would be requesting a representative from the Conservation Commission, but Greenberg feels there may be a conflict of interest since the Conservation Commission will be approving future permits  for the entire project.  

The Cannon Hill project is underway.  Pilings from the harbor will be used for steps and water bars.  Ginie Page suggested a plaque be placed identifying the history of the area.

Andrew Petty, the new Health / Conservation Assistant, will start work on May 8, 2006.

Greenberg spoke with Guy Daniels regarding the Massari property on Indian Neck and discussed questions or misunderstandings regarding work zones.  Paul Banner suggested a trash can be placed at Omaha Road and at Indian Neck.  Greenberg will ask the DPW if they will supply cans and monitor them.

A Jurisdictional Opinion was requested by Barbara Lovett to prune the marsh side of Omaha Road because cars are being scratched and damaged.  Greenberg will advise.  Ginie Page moved to approve handling by Jurisdictional Opinion ; seconded by Cyndi Moe; passed 6-0.

Discussion took place regarding chink stone on beaches with revetments.  Greenberg will check the conditions placed upon properties regarding the use of chink stones and the responsibility to clean up the beaches.  She requested commissioners report locations to her.  

Jurisdictional Order for Wechler at Map 22, Parcel 110.  A deck was washed out during the winter storm.  Cyndi Moe moved to approve the JO; seconded by Dottie Dolan; passed 6-0.

The commissioners requested Agent Greenberg do a site visit at the following areas:

33 Money Hill Rd:  clear cutting and a mound of dirt within wetlands
Mac’s Shack, Commercial Street:  fence within resource area and pipes.
Kite Shop, Commercial Street:  fiber rolls
Stump Dump:  filling taking place by DPW

Alfred Pickard reported 14,820 pounds of debris was cleaned up at Egg Island in two days with three vehicles.  This normally would have taken over two weeks if access had been by boat only.

Certificate of Compliance:   
SE77-1087, Donald property, Map 35, Parcels 038 and 039.  Alfred Pickard stated the plantings and renourishment will be completed shortly.  Beach renourishment is an ongoing condition.  Ginie Page moved to approve the Certificate of Compliance; seconded by Cyndi Moe; assed 6-0.  

  
             
Public Hearings:

Himmelsbach, Joseph & Paula, 140 Grandview Street, Map 14, Parcels 117 and 118:  RDA:  Installation of septic system and new well.  David Lajoie represented the applicant.  The property abuts vegetated wetlands.  Only part of the work limit is in the buffer zone.  Cindy Moe moved to identify this project as a Negative 3; seconded by Dottie Dolan; passed 6-0.

Footit, Richard, 10 Bayview Ave, Map 35, Parcel 33:  NOI:  renourishment of bank.  Ginie Page recused herself as a member of the Conservation Trust.  Mr. Footit has discussed his project with EZ Doze It.  The length of the proposed renourishment is 150 feet along the coastal bank which the Conservation Trust owns.  Denny O’Connell stated the Trust had worked with other property owners in the past and would require additional information from Mr. Footit.  Agent Greenberg advised Mr. Footit that the Commission would need a narrative of the proposed project to include the elevation of the renourishment, how vehicles would access the property, potential revegetation, etc.  As yet, Natural Heritage had not responded to the application.  Discussion took place regarding access to the property and the possibility of


Footit getting an easement from Mr. Glaze.  Cyndi Moe moved to continue the hearing to June 7, 2006 to give Mr. Footit the opportunity to provide the Commission with a narrative as well an easement for access to the property; seconded by Paul Banner, passed 6-0.

Ed Reynolds moved to approve the April 5, 2006 meeting minutes with amendments; seconded by Ginie Page; passed 6-0.

Ginie Page moved to approve the April 19, 2006 meeting minutes with amendments; seconded by Ed Reynolds; passed 6-0.

The joint letter of the Conservation Commission and Open Space Committee was reviewed and revised.

Ginie Page moved to adjourn the meeting at 6:00 pm; seconded by Dottie Dolan; passed 6-0.
