Minutes of Conservation Commission Public Meeting

Commissioners Present:  Co-Chair John DiBlasio, Co-Chair Ginie Page, Dottie Dolan, Cyndi Moe,  Ed Reynolds, Paul Banner and Lonni Briggs..

Staff Present:  Hillary Greenberg, Conservation Agent and Christine Bates, Committee Secretary

Meeting called to order at 4:03 P.M. by Co-Chair John DiBlasio.

Business Meeting:

Peter Markunas of Coastal Engineering and Dan Humphries of LEC Environment explained to the Commissioners that the Yankelovich and Prager beaches have experienced more bank erosion than anticipated.  Both of these properties received Orders of Conditions for bank revetments in April 2005.  Markunas presented a revised plan dated 04/05/06 which would realign the revetment.  Humphries expressed his desire to build the Prager revetment as voted on, with additional sand behind the revetment.   After a lengthy discussion, the Commissioners wanted the original Order of Conditions dated 11/09/04 to stand.  Reynolds moved to keep the original Order of Conditions; seconded by Dottie Dolan; passed 5 – 2.   There was discussion about doing a project to move the sand away from Black Fish Creek.  Agent Greenberg will determine who owns the land.  This is in the ACEC area and the entire system needs to be looked at for erosion.

Agent Greenberg reported the National Park will be working on the stairs at Marconi Beach.

The Commissioners reviewed and amended the letter to be sent to abutters of Conservation Land.  It was agreed the letter would be co-signed by the Commission and the Open Space Committee.  Peter Hall will supply the names and labels for mailing.

Agent Greenberg reviewed the correspondence file.  There were several bulletins, news letters and training opportunities.  


The following letters were authored by Agent Greenberg: 
1.  Letter to Rogers on Cliff Road advising him there would be a $200 fine per day if the structures go over the coastal bank.
2.  Letter to Board of Selectmen regarding the Billboard House on Chequessett Neck Road and the access / sign issues.

Agent Greenberg reported NOI’s may be revised and resubmitted.
The Commissioner’s signed off on the Martha Carroll definitive plan on Richman Lane as well as the Parkington definitive plan.  
Agent Greenberg will identify who is responsible for clearing Fire Roads near Duck Harbor and report they require clearing.
Dottie Dolan reported she visited the Boriskin property on March 20 with Agent Greenberg.  She stated there was some debris on the property.  She stated it appeared they were building berms and there might be a mooring for a boat.  
             
Public Hearings:

Young, Kevin, 35 Old Salt Lane, Map 41, Parcel 72:  Partial Certificate of Compliance.  Agent Greenberg made a site visit on 2/28/06 and discovered the retaining wall was not structurally sound.  She notified Young.  The landscaping is not complete as yet.  Cyndi Moe stated she had seen debris in the wetland and wanted to make another site visit before approving.  Moe moved to continue to 04/19/06; seconded by Ed Reynolds; passed 7-0.

Kerr, Edwin, 615 Chequessett Neck Road, Map 19, Parcel 118:  NOI, temporary access for septic system installation at 599 Chequessett Neck Rd. (Cont’d from 03/15/06.)  SE77-1092.  Jason Ellis represented the applicant.  He stated the NOI was for access to the Kerr property. Ginie Page moved to approve the NOI; seconded by Cyndi Moe; passed 7-0.  

McNamara, William, 349 Old Kings Highway, Map 23, Parcel 71:  NOI, septic system upgrade and new well installation (Cont’d from 03/15/06).  There is no DEP number necessary as this falls under the Wellfleet regulations.  A site visit was made.  There is an isolated bordering vegetated wetland.  The cesspools will be pumped and filled.  They have been out of use so there will be no contamination to wells.  Dottie Dolan questioned if the area was a vernal pool and if we could monitor it; Ellis stated he could not respond on behalf of the applicant.  The Board of Health approved the plans.  Ed Reynolds moved to approve the NOI; seconded by Ginie Page; passed 7-0 with conditions.  Supervisor is Hillary Greenberg.  

Matson, Peter & Susan, 2950 Old Kings Hwy, Map 3, Parcel 2:  NOI, Septic System Upgrade (Cont’d from 03/15/06).  DEP 77-1091  John Schneible of Coastal Engineering represented the applicant.  A site visit was made on 03/15/06. The property is near the Herring Brook as well as within the ACEC area and the applicant want to upgrade the septic system.  The abandoned privy will be covered.  Paul Banner moved to approve; seconded by Ed Reynolds; passed 7-0 with conditions.   

Ziering, Ira, 115 Way #89, Map 29, Parcel 285:  NOI, Construction of addition to existing dwelling and septic system upgrade within 50 foot filter strip and 100 foot buffer zone (Cont’d from 03/15/06).  


SE77-1093 (3rd proposal).  Cyndi Moe recused herself.  David Lajoie represented the applicant.  Mark Hammer, architect, stated there will be internal reconstruction and the entry door may change.  Natural Heritage stated they had no issue with the project.  Dottie Dolan moved to approve the NOI; seconded by Ginie Page; passed 6-0 with conditions.  Supervisor is John DiBlasio.   

Randall Carpenter/Lynn Babington, 126 2nd Street, Map 40, Parcel 99:  NOI:  Addition to an existing dwelling within buffer zone (Cont’d from 02/01/06).  SE77-1088.  David Lajoie and Mark Hammer represented the applicants.  Meeting minutes of January 18, 2006 were read into the record.  The project was reduced in scope by adding a 2nd floor decking extension to connect the main dwelling with the garage.  Dottie Dolan moved to approve the NOI; seconded by Cyndi Moe; passed 7-0 with conditions.  Cyndi Moe is supervisor.

Kevin O’Connor, 135 Main St., Map 15, Parcel 118, RDA:  Septic Upgrade.  Chris Wixson represented the applicant.  He stated there are contaminated cesspools.  A part of the excavation will be in the 50 foot buffer zone.  An alternative treatment system will be utilized.  Cyndi Moe moved this project as a Negative 3; seconded by Paul Banner; passed 7-0 with conditions.

Jeanne Coser (Captain Higgins), 250 Commercial St., Map 21, Parcel 106:  RDA, Septic Upgrade.  A site visit was made.  Chris Wixson represented the applicant.  The Commission was concerned about the work zone limit and truck access.  Wixson stated they would utilize sand bags and fiber filled rolls as a barrier around the work limit.  He estimated the work would take place after the summer season.  There was concern regarding the drainage and run off from the parking lot and could another catch basin be installed.  DEP had not responded with a number as yet.  Ed Reynolds moved to continue to 04/19/05; seconded by Dotti Dolan; passed 7-0.

Glaze, John, 625 Old Wharf Rd., Map 35, Parcel 14, NOI:  Renourish beach and repair existing erosion control.  DEP 77-1094.  Glaze could not attend the meeting so Agent Greenberg described the project.  Natural Heritage had a concern about the Diamondback Terrapin Turtles and stated work must be conducted before June 1st.  Sand will be distributed to control erosion.  Ginie Page moved to approve the NOI; seconded by Dottie Dolan; passed 7-0 with conditions.  

Granville, Robert, 46 Eric’s Way, Map 8, Parcel 67:  RDA, construction of dwelling with portion of decking within 100 foot buffer zone.  The Commission could not locate the property at the site visit.  The deck will be built 8 feet within the 100 foot buffer zone.  The deck will be elevated and will involve three (3) posts going into the buffer zone.  Ed Reynolds moved to identify this as a Negative 3; seconded by Dottie Dolan; passed 7-0 with conditions.  

Danforth, Audrey, 5 Holbrook Ave., Map 21, Parcel 105, RDA:  Construct 14’ x 18’ shed within ACEC.  A site visit was made.  Danforth gave the history of receiving a building permit in 1999 and due to her septic problems, was unable to complete the project and the permit expired.  A concrete pad is already in place on the property.  Meeting minutes of 09/01/04 were read into the record.  Paul Banner moved to approve the RDA as a Negative 3 based on the fact the cement pad is already on the property; seconded by Ed Reynolds; passed 5-2.  Supervisor is Dottie Dolan.  





Business Meeting continued:

Paul Banner moved to approve the meeting minutes of March 15, 2006 as amended; seconded by Ed Reynolds; passed 7-0.
