Conservation Commission Minutes 07/20/05

Meeting called to order at 4:03 P.M. by Co-Chair Edwin Reynolds  

Business Meeting:

Cyndi Moe moved to approve June 15, 2005 meeting minutes with amendments; seconded by John DiBlasio; passed 5-0.

Cyndi Moe moved to approve July 6, 2005 meeting minutes with amendments; seconded by John DiBlasio; passed 65-0.

Dottie Dolan reported beach clean up was scheduled for August 22, 2005 and that the Commission would address the coverage at the August meeting.  

The endorsement letter for the Open Space and Recreational Plan was signed by the Commission.

Jurisdictional Opinion

Suzanne Thomas, Beach Director ,  requested permission to renourish clean sand at Long Pond Beach due to roots and dirty sand at the Public Beach.  The Commissioner’s wanted to know the amount of sand to be placed on the beach.  It was suggested Thomas submit an NOI for future needs.  Franklin moved to authorize the Jurisdictional Opinion; seconded by Dolan; passed 6-0.  

Kevin Cahoon of the DPW requested permission to draw water from Squires Pond for hydro-seeding top of land fill cap.  Moe stated this is a privately owned pond and abutters should be notified.  Agent




Greenberg stated DPW would send letters to the abutters.  Since this was a “need to know”, the Commission had no problem with the water request.

Agent Greenberg reported the Shellfish Warden and Harbormaster did not want to endorse shellfish grant holders driving to Egg Island during extreme low tide due to safety issues, including vehicles getting stuck in sink holes and the potential of not being able to get out to them.  The Commission agreed with the experts and will not endorse the request.

Abby Franklin reviewed the mail which included an abutter letter regarding the Taylor property, Ernst self help grants, and Rensler property.

Banner reported the Alternative Energy Commission will make recommendations that White Crest Beach be sited as the alternative energy location.  He also noted there is Town property for affordable housing in the same area.

Abby Franklin reviewed the draft Herring River MOU and drafted comments on it to be submitted bny the Conservation Commission.  Discussion took place regarding the wording.  Franklin belives stakeholder input should be gathered through public hearings and written comments rather than a Stakeholder Committee.  Franklin will change the wording of the MOU comments per the Commissions recommendations.

NOMINATION OF OFFICERS FOR 2006:

Cyndi Moe moved to nominate John DiBlasio as Co-Chair for two years; seconded by Abby Franklin; passed 6-0.

Cyndi Moe moved to nominate Ginie Page as Co-Chair for one year; seconded by Abby Franklin; passed 6-0.

Cyndi Moe moved to nominate Abby Franklin as Correspondence Secretary; seconded by Dottie Dolan;
passed 6-0.

Public Hearings:

5:00    Levy, 95 Governor’s Foss Drive, Map 23, Parcel 131:  RDA:  Replace existing deck, build garden and retaining wall with water feature.  Neil Allen, contractor, represented the applicant.  The scope of work will be out of the 50 foot buffer zone.  The proposed decking will be 16’ x 18’ and 12’ x 13’.  Gravel will be utilized as the base with plantings.  One layer of timber will be utilized for the retaining wall at ground level.  Franklin suggested using native plants within the 100’ buffer zone.  A vernal pool contained turtles and dragonflies.  David Flaherty will certify the vernal pool.  Cyndi Moe moved to determine this as a Negative 3; seconded by John DiBlasio; passed 5-1.  

5:16    Taylor, 115 Pond Ave., Map 29, Parcel 368:  NOI:  Construction of leach area and driveway within ACEC (Cont’d from 07/06/05).  Franklin moved to continue the hearing to September 7 per applicants request; seconded by DiBlasio; passed 6-0.

5:20    Norgeot & Town of Wellfleet Shellfish Dept., NOI, Kelp Restoration Project off Great Island (Cont’d from 11/17/04).  Dolan moved to continue to 8/3/05 due to applicant’s absence at hearing; seconded by DiBlasio; passed 6-0.  

OTHER:

Agent Greenberg invited Mr. Driscoll and Berstein to attend the next meeting regarding the clear cutting which took place on property.   

Dolan moved to adjourn the meeting at 5:26 pm; seconded by Franklin; passed 6-0.
