Meeting called to order at 4:03 P.M. by Co-Chair Ed Reynolds.  

Certificates of Compliance:

Peter Richman, 130 Catboat Road, Septic, (SE77-1020),  site was inspected and approved.  Dottie Dolan Moved to issue Certificate of Compliance; Seconded by John DiBlasio;
Passed 6-0.

Emily submitted revised plans from Bourne Consulting Engineers that show the relocation of the storm treat unit at the Marina.  Emily asked the Commissioners if they want to amend the order or to accept the new location as there is no change in the scope of the project.   The current plan shows the new location for the storm treatment.  Paul Banner Moved to accept the revised plan (Marina Expansion showing new location for the storm water); Seconded by Abby Franklin; Passed 5-1.


Jurisdictional Opinion:

Luke Corbalis, 50 designers Road:  replace existing deck on same footprint.  Cyndi Moe Moved to approve Jurisdictional Opinion; Seconded by Dottie Dolan; Passed 6-0.

Michael McSweeney, Schusters Trailer Park, construct 14’ x 24’ deck at entrance of the trailer and ramp for wheelchair.  The Commissioners would like to see a plan.  Cyndi Moe Moved to have McSweeney submit an RDA; Seconded by Dottie Dolan; Passed 6-0.

Richard Lay, 245 Gull Pond Road:  Would like to do driveway maintenance which would include filling potholes with a hardener.  Stones to be placed in ruts.  John DiBlasio Moved to approve Jurisdictional Opinion; Seconded by Cyndi Moe; Passed 6-0.

Other Business:

Dottie Dolan announced beach clean up is scheduled to Saturday, July 31, 2004.  Abby, John and Ed to help.  Emily Beebe stated the Open Space Committee was meeting with the printers on Monday (July 26) and that the artwork has been submitted.  

Paul Banner reported the Local Comprehensive Planning Board will be distributing a letter indicating what each Board / Commission listed as goals for the 1995 plan.  Each Board/Commission needs to respond with accomplishments.

Emily Beebe and Jacqui Wildes are developing a grant application with B.U. for a Robert Wood Johnson Foundation grant to support “Fleet Feet”.  This program will reach out to elders and elementary school aged children as well as the general public to increase activity levels and build relationships between the generations.  The program will include developing trail guides for fire roads and trails located in Wellfleet.  They will also include on-line maps identifying fire roads and trails so people can access more trails, more easily.  Emily Beebe requested a letter of support from the Commission.

Abby Franklin requested the meeting with the ZBA on August 12, 2004.  Christine Bates to ask Board regarding start time.  

Abby Franklin reported the State of the Wellfleet Harbor conference is scheduled for November 6, 2004, and that they have received a $1,000 grant from the  Community Foundation of Cape Cod.

Emily Beebe asked the Commissioners to review the draft Memorandum of Understanding (MOU) on the Herring River Salt Marsh Restoration Project for any changes.  Rex Peterson will set up meeting with the Selectmen for presentation.      The Park has developed a monitoring plan already, including water quality results, etc. which would be an appendix to the MOU.  Emily Beebe will get back to the Commission with the date of the Selectman’s meeting.  

Mr. and Mrs. Brimm of Lt. Island, came before the Commission.  They explained that three years ago they asked for help on the erosion on their wall.  A neighbor appealed and sued the Conservation Committee and the Brimms’.  At the present time, there is a fence across the right of way road.  It is forcing people to go on their property and cause further erosion.  They stated they don’t want to have to police their property, but are concerned with erosion from the paper road.  Emily Beebe suggested they get some signs made from DPW stating “danger, sliding
sand” or some other warning.  They cannot put up an additional fence.  Emily to do a site visit and check if the fence can be removed.

Jan Plaue, of the Open Space Committee, came before the Commission, to seek approval of their Open Space Committee goal of establishing a piece of town owned property as under the control of the Conservation Committee.  The lot (Map 29, Parcel 499) is five (5) acreas of wetland on Drummer Cove.  She stated several of the neighbors have cut down trees in the past and the
Open Space Committee feels the land needs to be further protected.  Cyndi Moe Moved to support the project located at Pond Avenue; Seconded by Dottie Dolan, Passed 6-0

Public Hearings:

5:00     Nathaniel and Elizabeth Terry, 320 Cove Road, Map 28, Parcel 18:  RDA, Pruning.  Emily Beebe spoke on behalf of the Terry’s.  There is a right of way which has some small locust and pitch pines in the three foot wide pedestrian walkway that the Terry’s would like to maintain by removing some of the small locusts and by pruning other trees.  Cyndi Moe Moved to identify this as a Negative 3; Seconded by Ed Reynolds, Passed 6-0.

5:30     Norma Gilmore, 2675 State Highway, Map 15, Parcel 128, NOI, Reconstruct single family dwelling (Cont’d from June 16, 2004).  The Commission received a request to continue this hearing; Abby Franklin Moved to continue the hearing to August 4, 2004; Seconded by Cyndi Moe; Passed 6-0.  

5:45-   Albert Norgeot and Town of Wellfleet Shellfish Dept, NOI:  Kelp restoration project off Great Island (Cont’d from June 16, 2004).   The Commission received a request to continue the hearing to August 18, 2004.  Abby Franklin Moved to Continue to August 18, 2004, Seconded by John DiBlasio; Passed 6-0.

5:46-   Wellfleet  Bay Wildlife Sanctuary, Map 46, Parcel 17:  Repairs to existing cabin.  Abby Franklin recused herself.  DEP assigned SE77-1036, Natural Heritage letter received.  Cyndi Moe Moved to approve with Conditions; Seconded by Paul Banner; Passed 6-0.  John DiBlasio – Supervisor.

5:15     Audrey Danforth, 5 Holbrook Ave., Map 21, Parcel 105, NOI, Expand porch in buffer zone.  Ed Reynolds stated Commission had not received a full plan.  An engineer needs to show where the wetlands are on the map and what steps Ms. Danforth has to take in order to meet the Commissioner’s requirements.  The site plans received do not show the resource area.  The Commission requires a proposal to mitigate disturbed land, and needs to see the square footage of land in buffer zone, disturbed area in the buffer zone, and disturbed area in the 50 foot zone.  Ms. Danforth stated B & B Houselifting will be doing the septic and foundation work, possibly in August.  The Commission told Ms. Danforth the current application is not adequate or correct; this is a proposed addition to the dwelling, not an expansion of a porch.  Paul Moved to continue to August 4, 2004; Seconded by Cyndi Moe; Passed 6-0.  Emily Beebe stated Ms. Danforth was to supply information by July 28, 2004 in order to be heard at the August 4, 2004 meeting..  

Cyndi Moe Moved to adjourn the meeting at 5:30 pm; Seconded by Abby Franklin, Passed 6-0.
