Meeting called to order at 4:03 P.M. by Co-Chair Cyndi Moe. June 2, 2004 meeting minutes read and accepted with amendments. Moved by Ginie Page; Seconded by Dottie Dolan; Passed 7-0.

There were three Corrected Certificates of Compliance (error made in not including on-going conditions: Kratkey, Miller Realty Trust, and Risch. (no motion required).
Jurisdictional Opinion:
The Harbor Master office requires a portable shed be located near the existing gas pumps in order to keep paperwork in one location to better serve the public. This will not be a permanent fixture. John DiBlasio Moved to approve the Jurisdictional Opinion; Seconded by Abby Franklin; Passed 7-0.
Ginie Page noted she would like the Commission or Agent to investigate possible activity at the Schwallie property.
Emily reported she will be having a meeting with Rex Peterson regarding the MOU for the Herring River Salt Marsh Restoration project. She reported the Chequessett Yacht and Country Club is going forward with developing their site plan. The MOU will be reviewed by the Selectmen. Abby Franklin reported that the binder of Herring River History (newspaper articles) is complete and available.
Cyndi Moe, Paul Banner and John DiBlasio reported they were sworn in at Town Hall for their reappointment.
Public Hearings:
5:00 Knies, 10 D Street, Map 40, Parcel 1: RDA: Pruning. Frank Corbin represented the Knies. The plan stated the trees would be topped. Corbin stated if they took 30% off the top, the trees would still survive. The Knies would like a 180 degree view of the bay. Cyndi Moe stated the Commission would prefer to see a window effect (removing certain trees in one area and limbing trees) versus topping trees. Corbin stated he estimated there would be nine (9) trees topped and that he would flag selected trees for pruning with a vertical flag and identify trees with a circular flag that were to be cut down. Paul Banner stated he would like to follow up in one year to see the health of the trees after topping. Dottie Dolan Moved the Determination of
Applicability is a Negative 3; Seconded by John DiBlasio; Passed 7-0. Conditions will include that photographs be taken before and after the pruning from the 2nd floor of the dwelling and Corbin shall flag trees before the end of the week for the Commission to review.

5:25 Albert Norgeot and Town of Wellfleet Shellfish Dept, NOI: Kelp restoration project off Great Island (Cont’d from 6/16/04). A request was received to continue this case. John DiBlasio Moved to continue to July 21, 2004; Seconded by Abby Franklin; Passed 7-0.
5:35 Gary and Margaret Ender, NOI, 145 Samoset Ave, Map 28, Lot 104: Reconstruct seawall, construct access stairs, landscaping (Cont’d from 6/14/04). Robert Perry represented the Ender’s. Perry stated that the current scope of the project has been amended, removing the revetment work from the plan. A revised landscaping plan defining native plantings was filed as well. Perry highlighted aspects of the revised plans. Emily Beebe read a note from abutter David Wright, who had a concern regarding the deck on the zig zag revetment. Perry stated the deck will have a 2’ x 4’ rail. Cyndi Moe asked if the decking on the northwest side of the house would include a fence. Perry
stated yes. The posts for the cantilever stairway will be placed outside of the walkway in a sandy area. Ginie Page Moved to approve the revised plans dated 06/14/04 and 06/01/04 with conditions; Seconded by Paul Banner; Passed 7-0. Abby Franklin, Supervisor
6:00 Wellfleet Bay Wildlife Sanctuary, Map 46, Parcel l17: Repairs to existing cabin. Abby Franklin recused herself, being an employee of Audubon. Charles McKendree
said the work to be performed is to raise up the cabin and place the structure on new sonotube footings along with new flooring. Any structural repairs will be fixed. A file number has not been assigned by DEP as yet and a letter has not been received from Natural Heritage. Dottie Dolan Moved to continue case to 07/21/04; Seconded by Paul Banner; Passed 7-0.
6:15 R. (Guenther) Back, NOI, 170 Blue Heron Road, Map 41, Parcel 9: Proposed new dwelling (Cont’d from 4/21/04). Sarah Turano Flores and David LaJoie represented Guenther Back. The Commissioners stated it was very difficult to identify the markers. Mr. Lajoie stated the location of the house has been rotated to move it further out of the buffer zone. The revised plan dated 03/08/04 provides a landscaping scheme. There was discussion regarding the identification of the “top” of the bank. Mr. Lajoie went into detail to identify the method he used to delineate the top of bank. Mr. Lajoie stated there had been no objection from any abutters. Robert Sebbag, abutter, asked how many trees would be removed. Mr. Lajoie stated the only trees

6:40 Menegay Realty Trust, NOI, 190 Blue Heron Road, Map 41, Parcel 12: Proposed new dwelling (Cont’d from 04/21/04). David Lajoie and Sarah Turano Flores represented the trust. Mr. Lajoie stated they have reduced the size of the dwelling from 90’ x 25’ to 57 x 15’. He stated the entire lot is in the buffer zone. The reason the area was not staked for site inspection was because the new plan was just developed. Cyndi Moe requested the lot be staked clearly. Mr. Lajoie stated it was estimated they would be disturbing 6,000 feet, and will require a variance for the work limit. He stated the location for the well cannot be altered. Mr. Lajoie is required to provide the following to the Commissioners: flag trees to be cut down,
stake footprint of house, provide mitigation plan and an Alternative and Analysis update. The Commissioners will meet David Lajoie on August 4, 2004 at 10:00 at the site. John DiBlasio Moved to continue the hearing to August 4, 2004; Seconded by Dottie Dolan, Passed 7-0.
