Cape Cod National Seashore held their “Hunting in the Park” informational meeting at the Wellfleet Senior Center.  The Wellfleet Conservation Commission hosted the event.  Approximately 50 people were in attendance.

Commissioners Present:  Ed Reynolds , Co-Chair, Cyndi Moe, Dorothy Dolan, Paul Banner; Virginia Page; Abby Franklin; John Diblasio

Staff Present:  Emily Beebe, Conservation Agent and Christine Bates, Committee Secretary

Meeting was called to order at 5:04 by Co-Chair Edwin Reynolds.

Public Hearings:

5:05     William J. Frew:  RDA:  54 Hiller Ave, Map 20, Parcel 68:  Applicant seeks to prune and cut specific trees to recapture view.  A site visit was made.  Cyndi Moe suggested the pruning / cutting be done in increments.  Instead of topping several trees, the Commission suggested cutting down only a few.  Trees were identified by numbers on a picture provided to the Commissioners.  After review and the site visit, it was suggested Tree #1 be pruned; Tree #3 be cut to the ground; Tree #4 cut to the ground, and Tree #7 be cut to the ground.    Applicant to mark the trees with tape so Conservation Agent can verify correct trees to be cut prior to completing work.  John DiBlasio Moved to determine this case a Negative 3; Seconded by Dottie Dolan, Passed 7-0.  Logs are to be left in place for habitat and brush is to be either piled or removed.

5:12     Chequessett Yacht and Country Club:  680 Chequessett Neck Road, Map 19, Parcels 81, 115, 101, and 111.  AOOC:  Permission requested to add plantings and nourishment to an area where embankment is being scoured out.  Emily Beebe and Erik Mitchell visited the site.  Applicants need additional time to complete planting work.  It was suggested they have a professional do the work.   Dottie Dolan Moved to approve the repair of the stairs and stabilizing the banks; Seconded by Abby Franklin; Passed 7-0 with conditions:

5:24     Norma Gilmore, NOI, 2675 State Highway, Map 15, Parcel 128:  Reconstruct single family dwelling.  Site visit was made.  Mr. Gilmore stated the work from the previous NOI was started but they were unable to finish.  Sand was left piled on site through the winter from the foundation excavation located forty (40) feet from the resource area.  The DEP has not yet issued a file number.  The Gilmore’s did not provide a narrative or alternative analysis, and the Gilmore’s need to identify all activities that occur within the buffer zone (fuel tanks, vehicles, etc.).  Cyndi Moe stated the area in discussion is in the ACEC.   The cedar trees and other dead brush need to be removed from the site.  The Commissioners asked to see the sequence of work events and stated that the silt fence needed to be kept in good repair.  The Gilmore’s stated the construction materials will be put in the basement.  The new regulations require a breakdown of the amount of disturbed area in the buffer zone and the Commissioners asked that this plan be prepared by a professional.  Cyndi Moe Moved to continue to July 21; Seconded by John DiBlasio; Passed 7-0.

5:42     Albert Norgeot and Town of Wellfleet Shellfish Department; NOI, Kelp restoration project off Great Island (Cont’d from May 19, 2004).  Meeting minutes of May 19 were read as well as a letter to the commissioners from the Park Service dated June 3, 2004. The DEP has not yet issued a file number.  A question was asked about the control of draggers going over the area.  Mr. Norgeot responded that he is working with Andy Koch to offer an educational program to the shellfishermen.   Dottie Dolan Moved to continue to July 7; Seconded by Abby Franklin; Passed 7-0.   

5:55     Kathleen Emmons, NOI, 19 Hamblen Farm Road, Map 19, Parcel 13:  Septic system and construction of deck (Cont’d from May 29, 2004).  Jason Ellis represented the Emmon’s.  Meeting minutes of May 19, 2004 were read.  Mr. Ellis reported the project had gone before the Board of Health and was approved.  The deck’s dimensions will be changed from 8 x 17 to 6 x 17 and will be designed by an engineer to utilize a diagonal support.  Dottie Dolan Moved to accept the revised plan; Seconded by Abby Franklin; Passed 7-0 with conditions..

6:08    Gary Ender, NOI, 145 Samoset Ave, Map 28, Lot 104.  Reconstruct seawall, construct access stairs, landscaping (Cont’d from June 2, 2004).  Applicant requested a continuance to July 7, 2004.  Cyndi Moe Moved to continue to July 7, 2004; Seconded by Abby Franklin; Passed 7-0.
 
6:09    Stephanie Gallico, NOI, 55 Bay View Ave, Map 35, Parcel 41:  Addition to single family dwelling.  A site visit was made.  David Lajoie represented the Gallico’s.  The Commissioners reported that the site where the new stairs would be built is in the ACEC area.  Mr. Lajoie stated the stairs would be constructed from above the upper level on the porch to a platform, then the stairs would turn to the west.  There is also a proposed roof deck.  An alternative analysis was supplied.  The project is located  in the 50 foot buffer strip.  The decking would be supported by one post in the buffer zone and there will be no loss of trees.  Ms. Beebe stated she received a phone call from an abutter who spoke in favor of the project.  We have not received a letter from Natural Heritage.  Ginie Page Moved to continue the case to July 7; Seconded by Dottie Dolan; Passed 7-0.

6:25    FOBRO, Inc., d/b/a Flying Fish Café, RDA, 29 Briar Lane, Map 14, Parcel 26:  landscaping.  Owners Sarah Robin and Kristen McDonald explained they want to clean up the front yard and side yard with plantings, seeding portions of lawn, removing split rail fence and wood bench, and pruning trees.  John DiBlasio Moved to accept this application as a Negative 3; Seconded by Abby Franklin; Passed 7-0.

Certificates of Compliance:
           Miller Realty Trust, SE77-626, 246 King Phillip Road, Map 34, Parcel 12;  stairs were constructed differently than what was on the original plan.  Cyndi Moe Moved to grant Certificate of Compliance; Seconded by Paul Banner; Passed 7-0.

Jurisdictional Opinion:
          
1.      Tent at the Moorings for a wedding (149 Commerce Street);  Cyndi Moe Moved to approve;
          Seconded by Dottie Dolan; Passed 7-0.

2.      Al Richi requested permission to pump and fill cesspool 75 feet from wetlands at 6 Wigwam Street.  He will need to collapse the cesspool and put sand on top.  Cyndi Move                       Moved to approve; Seconded by Abby Franklin; Passed 7-0.

John DiBlasio stated all Commissioners were reappointed for positions for the following year by the Selectmen and would have to go to the Town Clerk to get sworn in.  

Meeting minutes of May 19, 2004 were read and amendments made.  Cyndi Moe Moved to approved meeting minutes with amendments; Seconded by Dottie Dolan; Passed 7-0.

Dottie Dolan asked about the status of the trail maps.  Emily stated they were not completed as yet, but she was working with the printer.  Dottie agreed to assist her on the project..

A question was brought up regarding the  Lobster Hut on Commercial Street and the pvc piping behind the restaurant.  Emily responded they are used to provide fresh salt water to the lobster tanks.  This was installed many years ago and several establishments use this method for their lobster tanks.  Emily stated she will do a full inspection prior to the restaurant opening up for the season.

It was reported the Currier’s on Chequesset Neck Road added a new deck on the far side of their home.  The Commissioners to investigate.
