MINUTES OF MEETING OF AUGUST 20, 2003, 4:00 P.M., SENIOR CENTER

Meeting called to order at 4:05 p.m. under the Wetlands Protection Act and the Wellfleet Environmental Protection Bylaw by Chair Cyndi Moe.
Business Meeting.
-Harriet Miller and Abby Franklin were welcomed as guests.
-The Minutes of 8/6/03 were approved as amended, as MOVED by DiBlasio, SECONDED by Dolan, and CARRIED 6-0.
Conservation Agent's Report.
-An Enforcement Order is being issued for illicit tree cutting on the Sparrow property, Pond Avenue. The Sparrows will also pursue the matter in civil court.
-A letter was reviewed from Sue & Tom Peters, Lieutenant Island Road, reporting drainage onto their property and into the wetland from a Town storm drain. This will be investigated in connection with the paving project in the fall.
-The Selectmen will begin discussion of a policy for disposition of Town-owned land at their meeting on 8/25/03.
-Approval was requested for a Jurisdictional Opinion for Thompson, 6 Wigwam Street for the clearing of ivy and planting of bearberry.
MOVED by Dolan, SECONDED by Banner, and CARRIED 6-0.
-Paul Banner announced an Audubon walk around Indian Neck to identify flora and fauna.
-There was brief discussion of the situation with septic systems
in the west Commercial Street area. Selectmen's policy is to allow no private hook-ups to the new municipal water system until it has been functioning a year or two and data on Town usage has been collected. Tight tanks may have to be installed in the area.
-Installation of the municipal water system will begin on 9/2, will cease during the Oyster Festival, and continue from the Marina up Bank and Holbrook Streets to Main & West Main. Some temporary re-routing of traffic will be necessary for brief periods.
-There was discussion of the use of the property behind the Mobil Station as a dumping ground by Robbie Gilmore. Illicit occupation
in campers is also reported. Board of Health, Conservation Commission and Zoning violations are being addressed.
-Letters of thanks to Charles Barr of the Ocean Conservancy for his visit and luncheon, and to Todd Lebart of the Beachcomber are to be written.
-Acting Shellfish Constable Jim McGrath is to be invited to attend the October 1st meeting to discuss winter storage of shellfishing gear away from resource areas.
-Certificates of compliance will not be issued for the Kratky and Risch revetments. As-Built plans will be required.

4:45. Alan Prager, SE 77-967, 376 King Phillip Road, Map 35, Lot 184: Request to amend Order of Conditions. (Continued from 8/6/03.) Alan & Jane Prager were present. The Minutes of 7/16/03 were reviewed. Cyndi Moe reported that word has still not come from Natural Heritage, and their time is up. Ed Reynolds MOVED "that the Conservation Commission grant the request for elimination of Special Condition #3 and amend the Order of Conditions to reflect this." SECONDED by Paul Banner and CARRIED 6-0.
5:00. Town of Wellfleet/Dept. of Public Works, NOI, SE 77-1004,
Lieutenant Island Road, Map 4: Resurface roadway; improve shoulders. Assistant DPW Director Kevin Cahoon said the approach to the bridge will be resurfaced and recrowned back to Catboat Road.The sinking shoulders on that stretch will also be strengthened, and it is hoped that restriping and new signs will
keep vehicles off the marsh grass. John DiBlasio MOVED "that the Conservation Commission approve the Stearns & Wheler Plan for the Lieutenant Island Road project dated 7/24/03, subject to conditions specified. Conditions set. Spvsrs.Beebe, E.Mitchell.
5:15. Matthew Parent, RDA, Shellfish Grant, Egg Island: Access.
Mr. Parent described his grant on the west end of Egg Island, noting that vehicle access is not possible. The Chair read standard conditions for Egg Island limiting access to foot or boat. There was discussion of landowner Haggerty's claim to riparian rights in this area. Dottie Dolan MOVED "that the Conservation Commission make a Determination of Applicability, Negative #2." SECONDED by Ed Reynolds and CARRIED 6-0.
5:30. Peter & Bernadette MacLeod, NOI, 46 Spring Brook Road, Map 47, Lot 25: New dwelling. (Continued from 7/16/03.) The Minutes of 7/16/03 were reviewed. Stephanie Sequin and Bernadette MacLeod reviewed the amended plan with Commissioners. The existing septic tank will remain and the new house will be connected to it along with the cottage; pine trees will be taken down; provision is made for a new foundation under the cottage. Ms. MacLeod said two wells are proposed because there will be two separate households. There was discussion of the location of the reserve area. Ed Reynolds MOVED "that the Conservation Commission approve Ryder & Wilcox Plan #2689, as revised 7/29/03, subject to conditions specified," SECONDED by Dottie Dolan and CARRIED 5-0-1. 5:50. Marie Lovely, NOI, 30 Kendrick Avenue, Map 20, Lot 1: Septic system upgrade; relocation of water lines. (Continued from 7/16/03.) The Minutes of 7/16/03 were reviewed. Stephanie Sequin presented a revised plan responding to Board of Health concerns about the location of the septic tanks. Since the revised plan must be presented to BOH, John DiBlasio MOVED "that the Conservation Commission continue the hearing to 9/3/03." SECONDED by Ginie Page and CARRIED 6-0. Cyndi Moe asked that the ACEC be shown on the plan.

6:05. Michael & Linda Brimm, NOI, 160 3rd Street, Map 40, Lot 102: Coastal Bank Protection. (Continued from 7/16/03.) The Brimms were present with engineer Will Joy and Geologist Peter Rosen. Mr. Joy read a letter dated 8/20/03 outlining alternatives for shorefront protection and the goals of the soft solution chosen. Mr. Joy noted that recent research has shown that sand replenishment works best on banks rather than on the beach. A revised plan was reviewed showing fiber rolls at the base of the bank and tapering at the end, sand drift fencing, and an elevated stairway over the bank. The bank above the fiber rolls will be graded and vegetated. There will be annual monitoring by an engineer in the spring with a report to the Commission. When the fiber rolls are exposed by 50% or more, renourishment will be
undertaken. A comprehensive letter from abutter Warren Woods dated 7/28/03 in objection to the Brimm proposal had been reviewed by Commissioners. A second letter dated 8/19/03 urged beach renourishment at lesser cost than the solution proposed. There was discussion of the following: annual rate of erosion; point at which beach nourishment should be undertaken; carrying the fiber rolls over into the paper road. Geologist Stan Humphries, representing Mr. Woods, questioned the timely receipt of the revised plan. Commissioners said it had been received in good time. He also submitted data on the changing annual erosion rate in the area and urged beach renourishment as a better and cheaper solution. Mr. Woods spoke in objection to the project, reiterating the points made in his letters and emphasizing that the use of fiber rolls will take the front of his property right out.
Paul Banner MOVED "that the Conservation Commission approve Coastal Engineering Plan #C15263.00/SP-1 as revised 8/12/03, subject to conditions specified." SECONDED by Ginie Page and CARRIED 6-0. Conditions were set. Supervisors Ed Reynolds and Emily Beebe.
