I.      Title V Variances Requests

1.      Laposta/Kaminski, 34 Samoset Ave, Map 28, Parcel 123 (Cont’d from 07/10/13).  The hearing will take place at the September 11, 2013 meeting for lack of quorum.
2.      Sadie Hutchings, 9 Coles Neck Rd., Map 8, Parcel 251, stable permit.  There will be two (2) goats and eight (8) chickens.   The applicant was requested to move the stable area fifty (50) feet from the wetland.  The Board requested a water test be provided to the Health Department.  Gary Locke moved to approve the stable permit; seconded by Janet Drohan; passed 3-0.
3.      Ross, 945 Chequessett Neck Rd., Map 9, Parcel 98, new septic.  This is a voluntary upgrade with the system located adjacent to the coastal bank.  Gary Locke moved to approve East Cape Project 13-015 dated 07/22/2013 and grant the 12 variances requested in the letter of 06/19/13 for the upgrade of a septic system to serve a 5 bedroom structure, a grandfathered, non-conforming dwelling using Advantex Ax25RT denitrification technology under the remedial use approval category subject to the following conditions:
a)      Design flow is to be limited to 550 gpd to serve five (5) bedrooms
b)      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.
c)      A copy of a 3 year o9peration and maintenance contract with a certified wastewater operator shall be submitted to the Health Department prior to issuance of the Disposal Works Permit.  The system is to be equipped with a modem and auto dialer programmed to automatically call the maintenance company if alarm conditions occur.  Monitoring shall be quarterly for effluent for the following parameters:  temperature, pH, nitrate, ammonia, BOD, TSS, Total Nitrogen and TKN.  The influent shall be sampled for these parameters biannually.  The schedule for monitoring shall be quarterly for the first 2 years of operation, semi-annually for the next 2 years, and 1 sample annually from then on.  If sampling data results exceed maximum effluent discharge limits, a system modification will be required.  The Board of Health will evaluate limits that are exceeded twice in a years time.  Upon transfer of deed this schedule shall be restarted.  All results copied to the Health Department and the Barnstable County Department of Health and the Environment, with data provided in what format is acceptable to those agents.  Any other sampling per DEP approval.

4.       Stern, 280 Circuit Rd., Map 25, Parcel 9, new septic and move dwelling.  Jason Ellis represented the applicant and gave an overview of the project.  Gary Locke moved to approve J. C. Ellis Plan dated June 13, 2013 and grant the five variances requested in the letter of 07/26/13 for the upgrade of a septic system to serve a 4 bedroom structure, a grandfathered, non-conforming dwelling using Advantex denitrification technology under the remedial use approval category subject to the following conditions:
a)      Design flow is to be limited to 440 gpd, to serve 4 bedrooms.
b)      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.

DPW – Transfer Regs
   Pay As You Throw
Mark Vincent, DPW Director, stated he has concerns with staffing because there are currently three people and four are needed.  The DPW is considering closing the transfer station two days per week to reduce costs.  He stated three towns on the Cape are closed two days per week.  The Town of Wellfleet provides additional services such as brush and demolition.  Discussion included closing in the summer could be a problem and holding two days from restaurants a problem with trash building up.  Gary Locke and Janet Drohan both felt the station should be open seven (7) days during June, July and August.  Richard Willecke suggested a camera to monitor the use of the transfer station.  Harry Terkanian stated he wants to provide good service but requires the budget to do so.  Vincent stated if the station is opened 7 days, he needs reassurance funding for staff is available.  Janet Drohan stated there would be money for part time staffing.  Mr. Frazier, a private hauler, stated they are concerned people will not use the recycling bags.  Eric Oliver of Nauset Disposal stated they do a great deal of recycling now.  Rob Paul of Nauset Disposal stated commercial haulers need to use the Pay As You Throw bags.  Chair Willecke stated he would like to continue the discussion at the next meeting with a full Board.    

Oyster shells   

It was reported the oyster shells being located at the mouth of Duck Creek have maggots in the shells because they are not cleaned of all the meat and Vincent stated he and the Health Agent agreed the shells have to be clean.
