I.      Title V Variances Requests

1.      Laposta/Kaminski, 34 Samoset Ave, Map 28, Parcel 123.  Due to lack of quorum, this hearing will be continued to August 14, 2013.

2.      Sunbird Food Truck, 2520 State Hwy, Map 23, Parcel 34, variance for
105 CMR 590.009 B.  J’aime and Christian Sparrow, owners of the Sunbird Food Truck, stated there is a full kitchen inside the serving trailer.  Ms. Sparrow stated the operation receives deliveries in Eastham and they would like to receive the deliveries at the location of the operation utilizing a refrigerated trailer.  This would enhance the safety of the food products and would be stationery during the seasonal operation.  Agent Greenberg-Lemos stated she made a site visit and the container and food truck are up to code.  Ken Granlund moved to approve the variance for 105 CMR 590.009 B; seconded by Gary Locke; passed 3-0.

3.  Barnes, 41 4th Ave, Map 40, Parcels 80 and 79.  Mr. Barnes stated the water tests have improved with lower nitrates and lower sodium.  The well is located less then 100’ from the septic.  Mr. Barnes stated the abutting vacant property, owned by a trust, is available for a new well to serve his property.    If the vacant property were to have a dwelling built on it, another well would have to be installed.  Gary Locke moved to approve the variance for the use of a well on the abutting property; seconded by Ken Granlund; passed 3-0.

II.     Business
DPW – Transfer Regulations:  Mark Vincent was unable to attend the meeting so this will be continued to the August 14, 2013 meeting.

Oyster shell – change transfer regulations to allow other communities to drop their oyster shells at Wellfleet.  Agent Greenberg-Lemos stated there are issues after the shells are put into the harbor/water ways with flies and maggots in the water as well as on the beaches.  She feels the shells are not as clean as she would like and requested the Board think about it and discuss at the August 2013 meeting.
