Wellfleet Board of Health, Wednesday, May 8, 2013 at 7:00 pm at the Senior Center

I.      Title V Variances Requests

1.      Esten, 10 Marsh View, Map 28, Parcel 225, well variance:  Ron Peterson represented the applicant and stated the well needs to be relocated away from the marsh and salt water.  He stated the area will get worse with high sodium counts unless the dike gets repaired.  Agent Greenberg-Lemos requested a water sample to ensure for potable water.  Lezli Rowell moved to approve the well relocation requested by Atlantic Well Drilling in a letter dated March 11, 2013 and located on Felco Construction Engineering Site Plan 86101 dated 07/05/86; seconded by Janet Drohan; passed 5-0.
      
2.      Simons, 25 Way #84, Map 28, Parcel 159.1, new well.  David Lajoie represented the applicant and gave an overview of the project.  He stated the sodium count is high on two abutting properties owned by the Simons.  Lajoie stated there is another option for a water test on Map 28, Parcel 159.1 which the Board would like him to pursue in the event of a potential septic upgrade on the property.  David Lajoie requested a continuation to June 12, 2013.        

II.     Business
1.      Markis, 129 Commercial Street, Map 21, Parcel 123, failure to comply with Board of Health Order to upgrade subsurface sewage disposal system.  Agent Greenberg-Lemos stated Ms. Markis was ordered to upgrade her septic system two years ago and on October 22, 2012 she was ordered to upgrade in 6 months which she did not do.  Agent Greenberg-Lemos sent another letter on April 24, 2013 and read a response from Ms. Markis.  A preliminary plan was provided to the Health Department and the abutters  have applied for town water but are not hooked up yet.  Ms. Markis requested upgrading to a Title 5 septic system instead of the recommended I/A system.  The Water Department did not have records that the abutters have paid for Town water.  Richard Willecke motioned that Ms. Markis can proceed with a standard Title 5 septic upgrade if the two abutters have deposited money for the town water.  In the event that the applications are unpaid, Ms. Markis must proceed with an I/A upgrade plan; seconded by Lezli Rowell; passed 5-0.     

2.      Grace Chapel Church, 25 Lt. Island Rd., Map 42, Parcel 69, proposed dwelling.  David Lajoie represented the applicant and stated they would like to construct a detached dwelling.  There was discussion regarding the number of seats at the church versus the actual number of people who attend events.  Richard Willecke expressed concern  with the septic system not being able to handle the church, which also has a kitchen, as well as a dwelling.  Lezli Rowell stated the nitrogen loading limitation allowance would be 968 gpd based on the size of the property.  She recommended upgrading the septic system for a three bedroom dwelling and for 106 seats for the church with a 968 gpd design flow.

        Janet Drohan moved to approve the 01/09/13, 02/13/13, and 03/13/13 meeting      minutes as amended; seconded by Ken Granlund; passed 5-0.
