Minutes of Meeting of June 12, 2013
Senior Center, Long Pond room, 7:00 pm

Attendees: Richard Willecke, Lezli Rowell, Janet Drohan, Ken Granlund, Gary Locke

I.      Title V Variances Requests

1.      Simons, 25 Way 84, Map 28, Parcel 159, review of Variance Request
(options 1, 2 and 3 for replacement of a well). The Board had requested a test for option 3. Tom Desmond represented the applicant and stated if Option 3 were used, it would be costly for the applicant. Gary Locke stated the Board is not responsible for costs; however, the quality of the water with option 2 is good and with monitoring the testing, could be approved. Water tests were provided. Gary Locke moved to approve option 2 for the well location with semi-annual testing for routine parameters; seconded by Lezli Rowell; passed 5-0.

2.      Coppola, 70 Ira Freeman Road (Deer Path Way), Map 12, Parcel 160, Mr. Coppola stated they are putting an addition to the dwelling, and it was suggested they place a vapor barrier between the new addition and the leach pit, resulting in a variance. Lezli Rowell moved to approve the retro-variance and grant the variances requested in the letter of 05/06/132 for a three bedroom structure in compliance with respect to the Nitrogen Loading Limitation subject to the following standard conditions:
a)      Design flow is to be limited to 427 gpd, to serve three (3) bedrooms.
b)      The well water shall be tested and found potable, with results copied to the Health Department prior to issuance of the Disposal Works Permit.
c)      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.
seconded by Ken Granlund; passed 3-2.

3.      Boratko, 40 Beach St., Map 35, Parcel 9, Emily Beebe represented the applicant and gave an overview of the project, stating this had been reviewed by several boards in the past. The leach field is as far away from the resources as possible. Lezli Rowell moved to approve Emily E. H. Beebe plan 1237 and grant the four variances requested in the letter of 05/20/13 for the upgrade of a septic sy6stem to serve a three bedroom structure, a grandfathered, non-conforming dwelling:
a)      Propertyi Line: 10’ separation required, 0’ provided from SAS.
b)      Depth of cover: no more than 36” allowed, approximately 54’ required.
a)      Separation between Septic Tank and top of Coastal Bank: 25’ required, 23’ provided
b)      Separation between Ejector pump basin and top of Coastal Bank: 25’ required, 23’ provided

Subject to the following conditions:

a) Design flow is to be limited to 340 gpd to serve three bedrooms.
b) No increase in habitable area without Board of Health review.
c) The new well shall be connected and put in service under the benefit of proper plumbing and electrical permits, and well shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
d) Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.

4.      Nazarian, 220 Holbrook Ave, Map 14, Parcel 163. Emily Beebe represented the applicant and gave an overview of the project. Maureen Connelly wrote a letter in favor of the project. Lezli Rowell moved to approve Emily E. H. Beebe plan2050 dated 05/14/2013 and grant the three variances requested in the letter of 05/14/13 for the upgrade of a septic system to serve a five bedroom structure, a grandfathered, nonconforming dwelling with respect to the Nitrogen Loading Limitation:
a)      Property Line: 10’ separation required, 1’ provided from SAS
b)      Foundation: 20’ separation required, 6’ provided from SAS
c)      Reduction to lateral overdig requirement due to lack of area
Subject to the following conditions:
a)      Design flow is to be limited to 550 gpd, to serve five bedrooms.
b)      No increase in habitable area without Board of Health review.
c)      There is to be no conversion of use without Board of Health review.
d)      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the disposal Works Permit.

V.      Correspondence
a.      Agent Greenberg-Lemos stated the county is supposed to be monitoring our I/A systems, and they are not doing anything about systems that are out of contract and not in compliance, which the customers are paying for. Agent Greenberg-Lemos will send letters to the property owners stating their systems are out of compliance.

b.      There were complaints from neighbors regarding noise issues on Gross Hill Road – NSTAR is checking into it.

c.      Additional correspondence was reviewed by the Bord.

VI.     New Business
•       Agent Greenberg-Lemos stated she made a site visit to Rispoli Ventures, LLC and determined no employees had received choke saver training, the order of food in the refrigerator was not in compliance, and there were no tongs or tissue for free samples. The next day she made another visit and nothing had been done as requested. She issued a violation $200 ticket. The restaurant has also overdrawn on the public water system.
