Minutes of Meeting of February 13, 2013

I.      Title V Variances Requests

1.      Pierce, 36 King Phillip Rd., Map 28, Parcel 171   David Lajoie represented the applicant and stated this is a septic system upgrade.  The well on the property will be relocated.  Gary Locke moved to approve Felco Plan 12116 dated 01/15/13 and grant the two variances requested in the letter of 01/21`/13 for the upgrade of a septic system to serve a three bedroom structure subject to the following standard conditions:
a)      Design flow is to be limited to 352 gpd to serve three bedrooms
b)      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to issuance of the Disposal Works Permit
seconded by Ken Granlund; passed 4-0.  

2.      Donahue, 245 Baker Ave, Map 15, Parcel 88  David Lajoie represented the applicant and explained the project to the Board.  This will be an I/A septic system.  Gary Locke moved to approve Felco Plan 12125 dated 01/09/13 and grant the five variances requested in the letter of 01/21/13 for the upgrade of a septic system to serve a three bedroom structure using an Advantex denitrification technology subject to the following standard conditions:
a)      Design flow is to be limited to 337 gpd, to serve 3 bedrooms
b)      The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit
c)      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit
d)      A copy of a 3 year operation and maintenance contract with a certified wastewater operator shall be submitted to the Health Department prior to issuance of the Disposal Works Permit.  The system is to be equipped with a modem and auto dialer programmed to automatically call the maintenance company if alarm conditions occur.  Monitoring shall be quarterly for effluent for the following parameters:  temperature, pH, nitrate, ammonia, BOD, TSS, Total Nitrogen and TKN.  The influent shall be sampled for these parameters biannually.  The schedule for monitoring shall be quarterly for the first 2 years of operation, semi-annually for the next 2 years, and 1 sample annually from then on.  If sampling data results exceed maximum effluent discharge limits, a system modification will be required.  The Board of Health will evaluate limits that are exceeded twice in a years time.  UPon transfer of deed this schedule shall be restarted.  All results copied to the Health Department and the Barnstable County Department of Health and the Environment, with data provided in what format is acceptable to those agents.  Any other sampling per DEP approval
seconded by Janet Drohan; passed 4-0.

3.      Taylor, 165 3rd St., Map 40, Parcel 104  Jason Ellis represented the applicant and stated the house was recently sold after being vacant for several years.  There will be an increase in square footage of the building but no additional bedrooms.  The Board stated they would approve the request pending submission of plan with well moved 100 feet.   Gary Locke moved to approve J. C. Ellis plan for Taylor dated 01/28/13 and grant the five variances requested in the letter of 02/15/13 for the upgrade of a septic system to serve a two bedroom structure using Orenco Advantex denitrification technology per revised plan eliminating Variance Request #1 subject to the following standard conditions:
a)      Design flow is to be limited to 220 gpd, to serve two bedrooms
b)      No increase in habitable area without Board of Health review
c)      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Premit.
seconded by Ken Granlund; passed 4-0.    

4.      Pechonis, 135 Old Truro Rd., Map 8, Parcel 164  Jason Ellis represented the applicant and stated the barn will remain with the dwelling behind it on the property.  He described the requested variances.  Gary Locke stated because this would be a change in use and stated changing the barn to a dwelling would be beneficial, per the state codes, but there is an environmental protection issue because this is new construction.  The Board requested a new design.  Richard Willecke moved to continue to 03/13/13; seconded by Gary Locke; passed 4-0.   

II.     Business
        Discussion regarding S. Wellfleet General Store use, 1446 State Hwy, Map 30,Parcel 6 (Davis’s Corner, LLC).  David Lajoie and Todd Robichaud came to the table and stated the property is under new ownership.  There will be a 4500 square foot general store with a deli service, and Robichaud would like a one bedroom apartment on the second floor.  The apartment has been in existence but not permitted to their knowledge.  The septic design is for deli use and there is an arbitrary number of 300 gpd for the deli, with 200 gpd for the apartment.  They would like to install a meter and monitor the water usage for one year.  If needed, they would come back and propose an upgrade.  The Board agreed with a meter being installed and being monitored.  David Lajoie will provide documentation and narrative regarding the apartment and location of the water meter.      

        Pay As You Throw Public Hearing

        Richard Willecke stated the public hearing is to make a recommendation to the Board of Selectmen.  He stated it is important to address the issue now because money can be saved at the present time, it will take time to educate the public, and implement the program.  John Morrissey, a member of the Recycling Committee, gave an overview of the Pay As You Throw program.  He provided savings the town could realize, the benefits of recycling, and environmental impacts.  

        David Quinn, who works with all 15 towns on the Cape, stated this is an effective program with 137 towns in the state are using PAYT.  He stated people begin to        recycle better and utilize composting.  He stated surveys state that illegal dumping tends to resolve itself if they experience it in the beginning.   There are 55 public trash bins in Wellfleet and he suggested having a plan in place for illegal dumping of household trash.  

        The use of bags is more efficient and easier for enforcement, coming in three sizes.  Willecke stated non residents and residents will be encouraged to use the transfer station, and renters of units/homes will be educated.  There will be a         reduction in the sticker fee.  The 33 gallon bag will be $1.50 each, a 13 gal bag       $1.00 and an 8 gal bag $0.50.  Jay Horowitz stated he is concerned with recycling because the transfer station is not user friendly, and feels the recycling section    should be upgraded and clearly marked for the public.  Chair Willecke stated he has discussed PAYT with the DPW Director regarding upgrading the transfer station, and it would cost money for the design and implementation.  DPW is concerned about an increase in recycling and new containers which will be required.  Willecke stated the program would not be implemented for almost a year.  Morrissey stated there is an item on the town warrant for two new trash compactors for recycling and the program will be entered into gradually, looking for improvements.  There will be 10 months preparation time, with six months of practice before the summer visitors come.   Lydia Vivante stated there is talk about a textile recycling program.  The Board will make a recommendation to the Board of Selectmen so the program can go forward and education will be a key factor for the public.  

        Richard Willecke moved that the Board of Health institute a “Pay as You Throw” (PAYT) program at the Wellfleet Transfer Station starting in FY2014.  The program will include the regulations and fees listed in Document A, which he reviewed for the public.

        Comments:  the program is designed to be revenue neutral, so the sticker fees are lower due to the cost for the PAYT bags.  There was discussion regarding abatements for people having a need and establishing proof they have established some kind of assistance program.  Richard Willecke will talk with Suzanne Thomas because she is aware of the fuel assistance program.  Morrissey stated some people will probably donate bags as well.  Trash haulers may have to   offer trash and recycling to customers.  Harry Terkanian recommended that commercial haulers pay by the ton versus having to put trash in bags.  David  Quinn stated bundled pricing is a requirement to get grant money.   There was discussion regarding the amount of money it costs for tipping and delivery to    SEAMASS.  David Quinn stated bins are available to towns through grants for purchasing recycling bins and composting bins.

        The motion was seconded by Gary Locke; passed 4-0.    
        
        The Board of Health will be meeting with the Board of Selectmen on March 12, 2013 to review the PAYT program and hold the final PAYT public hearing on March 13, 2013.
