Minutes of Meeting of July 11, 2012
Senior Center, Long Pond Room, 7:00 p.m.

Present:  Chair Richard Willecke,  Ken Granlund, Lezli Rowell, Janet Drohan,
Health Agent Hillary Greenberg-Lemos, Town Administrator Paul Sieloff, and Christine Bates, Committee Secretary

Chair Richard Willecke called the meeting to order at 7:00 p.m.  The meeting was tape recorded.
I.      Title V Variances Requests

a)      Emmons, 119 Hamblen Farm Rd., Map 19, Parcel 13, Septic Upgrade.  David Lajoie represented the applicant and stated the application is being treated as a new hearing due to abutters not properly being notified.  He stated the issue was for the number of bedrooms allowed on the property which is going to be subdivided.  He stated the Conservation Commission has issues with the number of bedrooms and size of the potential dwelling based on the wetland constraints.  Sarah James, an abutter, opposed the proposal because she is concerned with the wetlands as well as potential fill in the area.  She is concerned with antibiotics in the ground water, toxic substances, pesticides, chemicals, etc.  She is concerned with the nine requested variances. David Lajoie reviewed the variances requested and Lezli Rowell stated this would be an upgrade because it is replacing a cesspool system and the new system will remove approximately 80% of the nitrates.     Sarah James questioned how the lot is determined, if it is only upland or includes wetlands and Lezli Rowell responded that as long as it is not a marine environment, it is the entire property.  Anthony Cushman, an abutter, stated his family owns the surrounding wetlands which they want to protect and is concerned with going from the current two bedrooms on the property to the proposed five bedrooms.    The Board told Mr. Cushman that the current owners should not be penalized because the property was under utilized in the past.  .  Lezli Rowell moved to   approve Plan 11107, revised 06/01/12 and grant the nine variances requested int he letter of 06/25/12 for the upgrade of a septic system to serve five (5) bedrooms in two structures in compliance with the Nitrogen Loading Limitation using Fast denitrification technology under the provisional approval category subject to the following conditions:
1)      Design flow is to be limited to 570 gpd, to serve 5 bedrooms.
2)      The new well shall be connected and put in service under the benefit of proper plumbing and electrical permits, and well shall be tested and found potable, with results copied to the Health Department, prior to issuance of the      Disposal Works Permit.
3)      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of   the Disposal Works Permit.
4)      A copy of a 3 year operation and maintenance contract with a certified wastewater operator shall be submitted to the Health Department prior toi issuance of the Disposal Works Permit.  The system is to be equipped with a            modem and auto dialer programmed to automatically call the maintenance company if alarm conditions occur.  Monitoring shall be quarterly for effluent for the following parameters:  temperature, pH, nitrate, ammonia, BOD, TSS,               Total Nitrogen and TKN.  The influent shall be sampled for these parameters biannually.  The schedule for monitoring shall be quarterly for the first 2 years of oepration, semi-annually for the next two years, and 1 sample                        annually from then on.  If sampling data results exceed maxiumum effluent discharge limits, a system modification will be required.  The Board of Health will evaluate limits that are exceeded twice in a years time.  Upon transfer of                deed this schedule shall be restarted.  All results copied to the Health Department and the Barnstable County Department of Health and the Environment, with data provided in what format is acceptable to those agents.  Any           other sampling per DEP approval.  

        Seconded by Ken Granlund, passed 4-0.

        Richard Willecke left the meeting at 7:40 pm.
           
b)      Harrington, 30 Fox Island Road, Map 28, Parcel 223, new well.  Heidi Ganss Harris gave a history of Browns Landing Condo’s, stating the water quality was poor.  A dyke burst and the sodium level is extremely high.  Potable          water was found within 75’ from a septic system.  Agent Greenberg-Lemos stated there was no other location for the new well.  She also stated the water will be tested twice a year.  Agent Greenberg-Lemos reported she had                    granted permission for the new well as an emergency and requested the applicant come before the Board..  Janet Drohan moved to approve the new well with the requirement of water quality testing every 6 months; seconded             by Ken Granlund; passed 3-0.


c)      Lee, Old Chequessett Neck Rd, Map 14, Parcel 72, septic upgrade.  Jason Ellis represented the applicant and gave an overview of the project.  He stated the house is currently in disrepair and the new owner will demolish and                 rebuild a new 2 bedroom dwelling.  Lezli Rowell moved to approve the J. C. Ellis plan dated 6/1, 2012 and grant the four (4) variances requested in the 06/28/12 letter for the upgrade of a septic system to serve a two bedroom                        structure in compliance with Nitrogen Loading Limitation subject to the following conditions:
1)      Design flow is to be limited to 228.6 gpd to serve two bedrooms.
2)      The new well shall be connected and put in service under the benefit of proper plumbing and electrical permits, and well shall be tested and found potable, with results copied to the Health Department, prior to issuance of the      Disposal Works Permit.
3)      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of   the Disposal Works Permit.

        seconded by Ken Granlund; passed 3-0.
II.     Business
Discuss and vote on changes to Local Regulations Section 1000: Solid Waste Transfer Station and Section 7000:Violations.  
Agent Greenberg-Lemos reviewed the anticipated changes regarding payments on billed accounts for solid waste transfer station.  Lezli Rowell recommended changing the wording in Section 1006.  .  

7000 Violations:  Agent Greenberg-Lemos recommended a  new section to replace the current “b”section.   Paul Sieloff questioned why there was a “cap” of $200 and Agent Greenberg-Lemos stated if there were violations of a lesser nature, the agent could issue a lesser fine.

Lezli Rowell moved to adopt the changes; seconded by Janet Drohan; passed 4-0.
        
III.    Licenses
        Licenses were signed.  

IV      Minutes
        Lezli Rowell moved to approve the amended  06/13/12 meeting minutes; seconded by Ken Granlund; passed 3-0.

        The 03/28/12 and 05/0912 meeting minutes will be addressed when there is a quorum.
