Board of Health: Present:~Lezli Rowell, Alex Hay, John O’Hara, Agent Greenberg-Lemos and Christine Bates Committee Secretary

1.      Title V Variances Requests

a)      Simpson, 25 Caledonia Path, Map 42, Parcel 83, Stable/Farm (chickens).  Ed Simpson gave an overview of his proposal.  He stated he would like to have 6 hens but may go for 12 bantams and does not plan on having roosters.  He stated the only area to locate the coop is by the driveway and it will be small in size.  He stated his garden is organic and plans to compost the manure and use it in the garden.  Agent Greenberg-Lemos recommended moving the coop 100 feet from the well and moving the manure/compost pile as well.  The chickens will be kept in the fencing area.  John O’Hara moved to approve the Stablel/Farm request; seconded by Alex Hay;
passed 6-0.
b)      Freyss-Cole, 65 Paine Hollow Rd., Map 29, Parcel 393, Stable/Farm (goats).  Cedar Freyss-Cole stated they want two to three goats to use as a vegetative control.  They are non-milkers and non-breeders.  The water test is good and there is a new septic on the property.  The animals will be kept in a stable and fencing will surround the area they will be in.  He stated the animals could be moved to another area in the future.  Alex Hay moved to approve the stable/farm permit for the goats; seconded by John O’Hara; passed 3-0.  

c)      119 Hamblen Farm Rd., Map 19, Parcel 13, septic upgrade  (Cont’d from 04/11/12).  David Lajoie presented revised plans.  He stated he went to the Conservation Commission who recommended a two bedroom system, which eliminated 2 bedrooms.  Lajoie stated he would like provisional use using alternative treatment, allowing for five bedrooms.  The owner would like to have a cottage with three bedrooms and a dwelling with one bedroom, totally four bedrooms.  Attorney Zehnder stated the owners would like to have three bedrooms in the cottage which will be sold in the future.  There will be 40,000 square feet for each parcel.  Zehnder recommended going back to five bedrooms (2 bedrooms and 3 bedrooms in the other dwelling).  Lezli Rowell moved to approve the Felco Plan dated ......... (new paperwork), 5 bedrooms, 2 structures, ; seconded by Alex Hay; passed 3-0.  

d)      460 School House Hill Rd., Map 4, Parcel 34, septic upgrade (Cont’d from 04/11/12).  David Lajoie represented the applicant and submitted revised plans which included soil testing results.  There are three cesspools which need to be eliminated.  There is very little separation to the ground water.  Three variances are requested.  The Board was very concerned with the septic tank being in water and the life expectancy of the system.  The Board recommended utilizing a tight tank on the property at this point in time and coming back to the Board when they are ready to do further upgrading.  Lezli Rowell moved to continue to June 13, 2012 in order for Mr. Lajoie to discuss the options with the owners; seconded by Alex Hay; passed 3-0.     

e)      Cavanaugh, 150 School House Rd., Map 15, Parcel 27, septic upgrade.  David Lajoie represented the applicant, stating there is an existing house and cottage totaling 6 bedrooms.  They are on town water and require one variance for grade coverage.  Lezli Rowell moved to approve Felco Plan 12026 dated 03/23/12 and grant the one variance requested in the letter of 04/25/12 letter, for the upgrade of a septic system to serve  six bedrooms, a grandfathered, non-conforming dwelling:

Variance request: 2’ from required three-foot maximum cover over leach area

subject to the following conditions:

1)      Design flow is to be limited to 660 gpd to serve six bedrooms.
2)      No increase in habitable area without Board of Health review.
3)      There is to be no conversion of use without Board of Health review.
4)      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of   the Disposal Works Permit.      
seconded by Alex Hay; passed 3-0.

2.      Business
Janet Drohan attended the meeting and is considering joining the Board.         

3.      Licenses:  licenses were signed
        
4.      Minutes
        Lezli Rowell moved to approve the amended 3/14/12 meeting minutes; seconded by  Alex Hay; passed 3-0.

5.      Correspondence
        Agent Greenberg-Lemos reported she wrote another letter regarding enforcement for Bob Larsen’s property and will send him a $25.00 ticket.  
        Agent Greenberg-Lemos reported the property at 390 Gull Pond Road (David Sullivan)      was issued a cease and decease on the property.  There are three illegal apartments on the property and the septic system is inadequate.                The Building Inspector has Town Counsel involved.  
        Agent Greenberg reported there was a successful choke saver course.   

Lezli Rowell moved to adjourn at 8:15 pm; seconded by John O’Hara; passed 3-0.
