Minutes of Meeting of December 14, 2011
Senior Center, Conference Room, 7:00 p.m.

Board of Health: Present:  Richard Willecke, Lezli Rowell, John O’Hara, Ken Granlund, Alex Hay, Agent Greenberg-Lemos and Christine Bates Committee Secretary
1.  Title V Variances Requests
a)      Roach, 134 Indian Neck Rd., Map 28, Parcel 55, Variance Request.  David Lajoie represented the applicant and gave an overview of the project, stating the parcel is very small.  The Advantex denitrification system will be used.  Lezli Rowell moved to approve the variances requested in the Felco letter of 10/25/11, plan 11075 dated 10/20/11, for the upgrade of a septic system to serve a three (3) bedroom structure, a grandfathered, non-conforming dwelling (with respect to the Nitrogen loading Limitation) using Advantex denitrification technology under the remedial use approval category subject to the following conditions:  
1.      Design flow is to be limited to 330 gpd, to serve 3 bedrooms
2.      No increase in habitable area without Board of Health review.
3.      The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.

5.      A copy of a 3 year operation and maintenance contract with a certified wastewater operator shall be submitted to the Health Department prior to issuance of the Disposal Works Permit.  The system is to be equipped with a modem and auto dialer programmed to automatically call the maintenance company if alarm conditions occur.  Monitoring shall be quarterly for effluent for the following parameters:  temperature, pH, nitrate, ammonia, BOD, TSS, Total Nitrogen and TKN.  The influent shall be sampled for these parameters biannually.  The schedule for monitoring shall be quarterly for the first 2 years of ope4ation, semi-annually for the next 2 years, and 1 sample annually from then on.  If sampling data results exceed maximum effluent discharge limits, a system modification will be required.  The Board of Health will evaluate limits that are exceeded twice in a years time.  Upon transfer of deed this schedule shall be restarted.  All results copied to the Health Department and the Barnstable County Department of Health and the Environment, with data provided in what format is acceptable to those agents.  Any other sampling per DEP approval.

b)      Cashin, 21 Arthur Cashin Way, Map 40, Parcel 148, Variance Request.  Stephanie Sequin of Ryder Wilcox represented the applicant and gave an overview of the project, stating the lot is 1,400 square feet.  The well will be moved to a new location.  She explained the various variances requested.  Lezli Rowell moved to approve the variances requested in the Ryder Wilcox  letter dated 12/01/11, plan 10840 dated 11/11/11 for the upgrade of a septic system to sere a four (4) bedroom structure, a grandfathered, nonconforming dwelling subject to the following conditions:
1.      Design flow is to be limited to 475 gpd, to serve 4 bedrooms
2.      No increase in habitable area without Board of Health review
3.      The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit
4.      The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit
Seconded by Alex Hay; passed 5-0.  

2.      Business
Pay As You Throw committee:  John Morrisey stated there was a study done by EPA on several communities who have PAYT and there was a large percentage less waste at these sites.  Recycling increases as well as people composting, with trash tonnage decreases.  Agent Greenberg-Lemos questioned how commercial businesses and private haulers handle trash with the Pay As You Throw method and haulers cannot have mixed loads (special bags vs. regular bags).  There are 7 commercial haulers and approximately 78 other private haulers in the Town of Wellfleet.  Many of the haulers do not drop their trash at Wellfleet’s transfer station.  The PAYT committee does not encourage subsidizing bags to people with less income. They anticipate raising $132,000 with the bags costing $0.50, $1.00 and $1.50, based on size.  The sticker fee may be reduced.  Hay recommended an educational program for users and stated there are grants available from DEP.  Agent Greenberg-Lemos stated Americorp could participate with education.  Several retail stores could sell the bags and there is no mark-up.  There are some manufacturers who will deliver the bags and ensure the money is put into the town’s account.  It was agreed implementation should take place in January 2013 to work out any issues.  It was brought up how convenient it would be if there were recycling containers available to the public.  It was recommended inviting commercial haulers, realtors, and business owners to a meeting or workshop regarding recycling and PAYT program.

Literature, clinic information, fees for Orleans, letter from National Seashore regarding bathhouse that is failing at LeCount Hollow, study results from Silent Springs Institute regarding water results, subdivision plan, memo from Silverman regarding oil tanks and new procedures for inspection and issuing waivers, copy of water connections, CC Reporter is distributed electronically, and radon information.       

Richard Willecke moved to adjourn at 8:05; seconded by Lezli Rowell; passed 5-0.
