Minutes of Meeting of January 26, 2011
Senior Center, Conference Room, 7:00 p.m.

Present: Richard Willecke, Lezli Rowell, John O’Hara, Alex Hay, Agent Hillary Greenberg-Lemos, Assistant Agent Andrew Petty, and Christine Bates

Chair Willecke opened the meeting at 7:00 pm.
1.Title V Variances Requests
1.Britta Tate, 60 Designers Rd., Unit K, Map 23, Parcel 7, variance request.  Emily Beebe represented the applicant. Lezli Rowell stated that she had read the previous meeting minutes and is prepared to hear the continuation of the case. Beebe gave an overview of the revised plan.  Beebe stated that she certified the tank is waterproof, and provided information on the charcoal venting. Beebe stated hat the over-dig is due to the fill at grade, and will be approximately 17.3" at the lowest corner. Lezli Rowell moved to approve Emily E. H. Beebe’s revised plans dated 1/20/11 and grant the one variance requested in the letter of 11/30/10 for the upgrade of a septic system to serve a two bedroom structure, in compliance with the Nitrogen Loading Limitation, subject to the following conditions:
1.  Design flow is to be limited to 237 gpd to serve two bedrooms.
2.  The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
3. Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department.

2.  ~Keegan, 935 Chequesset Neck Rd., Map 19, Parcel 99, variance request. Agent Hillary Greenberg-Lemos stated that there is a 12’ variance request from the existing leach facility to the foundation, due to new addition to house. Lezli Rowell moved to approve Coastal Engineering Plan C15637.01 revised January 13, 2011 and grant the cellar variance requested in the letter of 01/18/11 for the retrofit of existing, previously approved septic installation with the following conditions:
a)  Design flow to be limited to 330 gpd, to serve three bedrooms
b)  No increase in habitable area without Board of Health review
c)  Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department.
seconded by John O’Hara; passed 4-0.

2.      Business

Dog Waste on Beaches and effects on aquaculture. Agent Greenberg-Lemos informed the Board that Suzanne Thomas was not available to come to the meeting, but that she requested this topic on the agenda.  There was discussion regarding the fact that the Shellfish Advisory Committee had already put signs on the beaches.  Agent Greenberg-Lemos stated that while there have been two closures of the beaches on the bay side (Burton Baker and Mayo) closure events were likely due to rain.  She reported that the Board of Health does not deal with shellfishing regulations and the Board does not conduct any water sampling for area closures (controlled by the Division of Marine Fisheries) only recreational bathing.  

Agent Greenberg-Lemos recommends that the Shellfish Constable, Animal Control Oofficer and the Beach Commissioner and staff enforce the dog waste matter with issuing tickets to dog owners who do not clean up after the dogs. The sign(s) at Mayo Beach/Harbor are incorrect based on the regulations. Chair Willecke feels that the current regulations are adequate which advise the hours dogs are allowed and at which locations, and the Board supports the Selectmen’s recommendations. In lieu of new regulations, the Board recommends better enforcement of the current regulations in place.

5.         Correspondence~
Agent Greenbert-Lemos stated that there is correspondence regarding grease traps with follow up correspondence from DEP.
Letters were sent to restaurants regarding healthy eating / menus
She reported that the National Park is doing~prescriptive~brush burning.
Barbara Austin sent a letter providing information on agriculture
The Mobil gas station will be closing January 31 to upgrade tanks.
The next meeting is February 9, 2011.
