Minutes of Meeting of June 8, 2011
Senior Center, Conference Room, 7:00 p.m.

Present: Richard Willeke, Lezli Rowell, Ken Granlund, Assistant Agent Andrew Petty, and Christine Bates Committee Secretary

Chair Willecke opened the meeting at 7:00 pm.  
1.      Title V Variances Requests

Morgan,  60 Arey Lane, Map 36, Parcel 26. Jason Ellis represented the applicant and gave an overview of the project, stating there is a failed leach pit .  He stated the well will have to be relocated.  Andrew Petty stated this will go before the Conservation Commission due to the resources.  Lezli Rowell moved to approve the J. C. Ellis Plan dated 05/20/11 and grant the three (3) variances requested in the letter of 05/24/11 for the upgrade of a septic system to serve a three (3) bedroom structure, a grandfathered, non-conforming dwelling (with respect to the Nitrogen Loading Limitation) under the remedial use approval category subject to the following conditions:
1.      Design flow is to be limited to 340.4 gpd, to serve 3 bedrooms.
2.      No increase in habitable area without Board of Health review.
3.      There is to be no conversion of use without Board of Health review.
4.      The new well shall be connected and put in service under the benefit of proper plumbing and electrical permits, and well shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
5.      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit
seconded by Ken Granlund; passed 3-0.    

Coll, 310 Blue Heron Road, Map 42, Parcel 124.  David Lajoie of Felco, Inc. represented the applicant  stating this will be an upgrade and the Conservation Commission approved the plan.  There are four variances requested and an Advantex unit will be used.  Lezli Rowell moved to approve Felco Inc. Plan 11015 dated 04/25/11 and grant the four (4) variances requested in the letter of 05/19/11 for the upgrade of a septic system to serve a three bedroom structure, a grandfathered, non-conforming dwelling (with respect to the Nitrogen Loading Limitation) under the general approval category with the requirement of meeting the provisional denitrification standard of 19 mg/L nitrogen subject to the following conditions:
1.      Design flow is to be limited to 340 gpd, to serve three bedrooms.
2.      The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the disposal Works Permit.
3.      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit
4.      A copy of a 3 year operation and maintenance contract with a certified wastewater operator shall be submitted to the Health Department prior to issuance of the Disposal Works Permit.  The system is to be equipped with a modem and auto dialer programmed to automatically call the maintenance company if alarm conditions occur.  Monitoring shall be quarterly for effluent for the following parameters:  temperature, pH, nitrate, ammonia, BOD, TSS, Total Nitrogen and TKN.  The influent shall be sampled for these parameters biannually.  The schedule for monitoring shall be quarterly for the first 2 years of operation, semi-annually for the next 2 years, and 1 sample annually from then on.  If sampling data results exceed maximum effluent discharge limits, a system modification will be required.  The Board of Health will evaluate limits that are exceeded twice in a years time.  Upon transfer of deed this schedule shall be restarted.  All results copied to the Health Department and the Barnstable County Department of Health and the Environment, with data provided in what format is acceptable to those agents.  Any other sampling per DEP approval.seconded by Ken Granlund; passed 3-0.   

Newman, 75 Governor Foss Drive, Map 23, Parcel 132.  Matt Farrell of J. M. O’Reilly & Associates, Inc. represented the applicant and gave an overview of the project, stating there is a failed leach pit.  The well has already been replaced within the same locus.  He stated has been minimal grading performed to accommodate the new leach pit.  Lezli Rowell moved to approve the J. M. O’Reilly plan JMO-6454 dated 05/26/11 and grant the one variance requested in the 5/27/11 letter for the upgrade of a septic system to serve a four bedroom structure, a grandfathered, nonconforming dwelling subject to the following conditions:
1.      Design flow is to be limited to 475.97 gpd, to serve four (4) bedrooms.
2.      The new well shall be connected and put in service under the benefit of proper plumbing and electrical permits, and well shall be tested and            found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
3.      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of       deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit

2.      Business

MAVIN is a disease reporting program of Barnstable County which the County Nurse would like all towns to participate in.  It will allow accurate and timely information on infections/diseases.  Lezli Rowell moved to approve Wellfleet Health Department participation; seconded by Ken Granlund; passed 3-0.
