Minutes of Meeting of May 26, 2010

Chair Willecke opened the meeting at 7:00pm.
I.      Title V Variance Requests
Laschever, Map 35, Parcel 105, 6 Pleasant Point Landing, variance request.  (Cont’d from 05/12/10).  David Bennett of Bennett Environmental Assoc. Inc. gave an overview of the variance requests and stated this will be a FAST I/A under~remedial use, requiring State approval.  There is a public water supply serving the area.  Rowell moved to approve the Bennett Environmental Associates, Inc. plan #DEA10-10187 dated 04/20/10and grant the four variances requested in the letter of 04/26/10 for the upgrade of a septic system to serve a three bedroom structure, using FAST denitrification technology under the Remedial Use approval category, with the following conditions; seconded by John O’Hara; passed 3-0   Bennett responded to questions of a relative of an abutter.
a.      Design flow is to be limited to 330 gpd, to serve three bedrooms.
b.      No increase in habitable area without Board of Health review.
c.      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in placeCityBarnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the disposal Works Permit.
d.      A copy of a three (3) year operation and maintenance contract with a certified wastewater operator shall be submitted to the Health Department prior to issuance of the disposal Works Permit.  The system is to be equipped with a modem and auto dialer programmed to automatically call the maintenance company if alarm conditions occur.  Monitoring shall be quarterly for effluent for the following parameters:  temperature, pH, nitrate, ammonia, BOD, TSS, Total Nitrogen and TKN.  The influent shall be sampled for these parameters biannually.  The schedule for monitoring shall be quarterly for the first two (2) years of operation, semi-annually for the next two (2) years, and one (one) sample annually from then on.  If sampling data results exceed maximum effluent discharge limits, a system modification will be required   The Board of Health will evaluate limits that are exceeded twice in a years time.  Upon transfer of deed this schedule shall be restarted.  All results copied to the Health Department and the Barnstable County Department of Health and the Environment, with data provided in what format is acceptable to those agents.  Any other sampling per DEP approval.
e.      A variance has been granted to allow a reduction in the size of the leach area provided to~177.6 gpd, from the calculations on plan.  Any functional or hydraulic failure will necessitate upgrade to Title 5 Code LTAR soil absorptions system calculated to at least 75% of the design flow.

II.     Business
Farm Animal Regulations
The revised regulations were reviewed by the Board.  After a discussion regarding manure at the Transfer Station, Lezli Rowell moved to strike the words “animal or” from Section 1002; seconded by Richard Willecke; passed 3-0.  Agent Greenberg-Lemos stated the Recycling Commission has been talking about a food composting program at the Transfer Station as well.
The Board discussed adding detailed descriptions of possible violations that would require additional water testing and the Board agreed to keep the wording generic at this point, allowing flexibility.  The Animal Control officer makes site visits and is aware of how many animals people have permitted for their property, and if there are problems, people will be notified to come before the Board. There will be a requirement for water testing when a new Permit is requested, and upon annual renewal for non-compliant, undersized properties.  Agent Greenberg-Lemos stated that the Health Office approves renewal permits and would refer any problems to the Board.  Lezli Rowell moved to approve the revisions to the Farm Animal Regulations; seconded by Richard Willecke; passed 3-0.

V.      Correspondence
Agent Greenberg-Lemos informed the Board she had received a letter from DEP regarding Dunkin Donuts.
“Carry in /Carry out” signs will be posted at the beaches on the ocean side to encourage people to take their garbage with them. Recycling containers will be placed at Mayo Beach.~
Educational mailings were sent to hotels / motels about bed bugs, as well as safety issues for food service establishments and places with swimming pools.
