Wellfleet Board of Health
        Minutes of Meeting of  October 28,  2009
Senior Center, Long Pond Room, 7:00 p.m.

Present:   Richard Willecke, John O’Hara, Kenneth Granlund, Alex Hay, and Christine    Bates, Committee Secretary
       Regrets:   Lezli Rowell

        Chair Willecke called the meeting to order at 7:00 pm.  

1.      Title V Variances Requests
Karlson, 295 Cove Rd., Map 29, Parcel 464, Geothermal / well.  Mr. Karlson gave an overview of the project, stating the family owns two abutting properties and they would like to utilize a well located on one of the vacant acres.  Chair Willecke referred to Regulation 504 which states private water wells are to be located on the property served,  and stated the regulation was designed to avoid wells being placed on paper roads.  The Board had no concerns with the project.  The following condition will apply:
a)  Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.  Alex Hay moved to approve the variance; seconded by John O’Hara; passed 4-0.

2.      Business

Fillman/Tesson, 95 Howes Rd., Map 29, Parcel 271, Farm Animal/Stable Permit Amendment (Cont’d from 10/14/09).  Chair Willecke read a letter from Health Agent Hillary Greenberg dated 10/22/09 in which she stated she had concerns regarding the safety of the water for the applicant and abutters and she recommended the Board deny the request.  She also recommended the number of existing animals be reduced until the water becomes potable as well as advising the applicants to not drink the water on the property.  Letters from Ira Ziering, Heinz and Monique Weinman, Anita Pallowletti , Rachael Brown, William Tiller, and Charles Annette all objected to the amendment to add additional animals on the property.  Brent Harold questioned the Board about manure management.  

Judy Tesson arrived at 7:38 pm, Chair Willecke reviewed the letters which were read into the record and informed Ms. Tesson what Agent Greenberg’s recommendations were.  Tesson stated they would take a fourth water test because the levels have been different each time from different locations.  She requested a withdrawal of her application without prejudice.  The Board again encouraged her and family members not to drink the water on the property.  Ken Grandlund stated the Town should consider some property for a community farm that could house animals for the residents.  Chair Willecke moved to accept the request to withdraw without prejudice; seconded by Alex Hay; passed 4-0.


Alex Hay reported he had attended a Waste Water Conference.    
   
Angry Tomato Restaurant:  Attorney Ben Zehnder represented the owner and stated the property is under order to upgrade the septic.  The owner is obtaining quotes from various engineering firms at this time as well as looking at potential funding.  Zehnder requested a 90 day extension.  John O’Hara moved to grant the 90 day extension; seconded by Alex Hay; passed 4-0.

III.          Licenses  - no licenses to sign

IV      Minutes – meeting minutes will be addressed at the next meeting

V.      Correspondence – no correspondence to review at this time.      

Ken Granlund motioned to adjourn at 8:50 pm; seconded by Alex Hay; passed 4-0.
