1.      Title V Variances Requests
Cote, 74 Holbrook Ave, Map 21, Parcel 99, septic upgrade.  David Lajoie represented the applicant stating the property is for sale.  A new well will be constructed on the south of the lot and the septic upgrade will use an Advantex  I/A system.  The water tests revealed a 6.9 mg/L in nitrates and the Board suggested annual testing of the water due to the water flow on the property, as well as the  possibility of hooking up to the public water system.  There will be no changes to the dwelling.  Lajoie agreed to notify abutters on when construction will take place as well as keep the easement open for the neighborhood.  Lezli Rowell moved to approve Felco Plan #09021 dated and grant the eight variances requested in the letter of 03/31/09 for the upgrade of a septic system to serve a two bedroom structure, grandfathered nonconforming dwelling (with respect to the Nitrogen Loading Limitation) using denitrification technology under the provisional use approval category subject to the following conditions:  
a)      Design flow to be limited to 236.8 gpd to serve two bedrooms.
b)      No increase in habitable area without Board of Health review.
c)      There is to be no conversion of use without Board of Health review.
d)      The new well shall be connected and put in service under the benefit of proper plumbing and electrical permits, and well shall be tested and found potable annually, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
e)      Any replacement of on-site well connection with Municipal Water Supply shall be done under benefit of proper plumbing and electrical permits, and authorization by the Water Commissioners, and in compliance with the Water System rules and regulations.
f)      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuiance of the Disposal Works Permit.
g)      A copy of a 3 year operation and maintenance contract with a certified wastewater operator shall be submitted to the Health Department prior to issuance of the Disposal Works Permit.  The system is to be equipped with a modem and auto dialer programmed to automatically call the maintenance company if alarm conditions occur.  Monitoring shall be quarterly for effluent for the following parameters:  temperature, pH, nitrate, ammonia, BOD, TSS, Total Nitrogen and TKN.  The influent shall be sampled for these parameters biannually.  The schedule for monitoring shall be quarterly for the first two years of operation, semi-annually for the next two years and one sample annually from then on.  If sampling data results exceed maximum effluent discharge limits, a system modification will be required.  The Board of Health will evaluate limits that are exceeded twice in a years time.  Upon transfer of deed this schedule shall be restarted.  All results copied to the Health Department and the Barnstable County of Health and the Environment, with data provided in what format is acceptable to those agents.  Any other sampling per DEP approval.
h)      Water meter to be installed in dwelling with readings to be submitted to the Health Department quarterly.
i)      Abutter notification prior to construction activities and maintain passage of right of way.

Drew, 80 Second Ave, Map 40, Parcels 126 and 131:  septic upgrade.  David Lajoie represented the applicant and stated he had been before the Board in 2008 for the approval for the new septic system.   The applicant has changed the building design and now the septic tank needs to be moved.  The well location will be moved as well.  Lajoie stated he will go back to his client based on the recommendation to place the septic under the driveway.  Lajoe requested a continuation to May 27, 2009.  Richard Willecke moved to continue to May 27, 2009; seconded by Alex Hay; passed 4-0.

2.      Business
DPW – Closure of Transfer on July 4.  The DEP requested a continuation to 5/13/09.  Agent Greenberg stated the transfer station will be open July 4, 2009.
 
Agent Greenberg reported a Certificate of Compliance was given to the Bookstore Restaurant.

III.          Licenses  Several licenses were signed by the Board.

IV      Minutes – Minutes will be reviewed at the May 13, 2009 meeting.

V.      Correspondence  
The Waste Water and Water Commissioners newsletter will be distributed at Town Meeting on 4/27/09.    

Agent Greenberg reported she wrote a letter to Lawrence Bankster, the new owner of Angry Tomato, advising him of all the requirements necessary to open the restaurant, including the requirement for a septic upgrade within 6 months.

Agent Greenberg reported that there are too many animals for the permit at 95 Howes Road.  Their permit is for two horses, and there are currently three horses, nine pigs, and twenty plus chickens.  She reported that theere is no manure management with the pigs, who have access to the garden area .  She is concerned about the well water on the property as well as the abutters’ water and suggested the owners come to the next meeting on 5/13/09.  There is also concern if the pigs will be sold commercially.

Rowell moved to adjourn at 7:40 pm; seconded by Alex Hay; passed 4-0.
