        Minutes of Meeting of  December 4,  2008
Senior Center, Long Pond Room, 7:00 p.m.

Present:  Richard Willecke, Alex Hay, John O’Hara, Assistant Agent Andrew Petty and Christine Bates, Committee Secretary
Regrets:  Lezli Rowell and Ken Granlund

Chair Willecke called the meeting to order at 7:00 pm.  

1.      Title V Variances Requests
1.      Eurich, 1065 Chequessett. Neck Rd., Map 19, Parcel 91:  Request for extension of time for septic installation.  Don Eurich, the potential owner of the Currier residence, stated they would like to start the project in 2010, and build the house at the same time as the installation of the septic.  Agent Greenberg stated because this property is so sensitive, she agrees that the demolition of the house and the septic installation take place at one time.  She recommended a condition be set during the two year extension that the cesspool be pumped two times.  At the time of property transfer, the extension would commence.  Alex Hay moved to grant an extension of 1 and ½ years from time of closing; seconded by Ken Granlund; passed 4-0.  Conditions:  The cesspool will be pumped by September 30 of each year..

2.      Brandt, 385 Bound Brook Way, Map 6, Parcel 12, Septic Upgrade.  Emily Beebe represented the applicant and gave an overview of the project.  She produced a revised variance request letter for the board.  The dwelling is served by a cesspool and is up for sale.  The well is located in the Town of Truro.  Agent Greenberg asked if the system could be moved away from the fresh water, and Beebe stated it would create several new variances to the foundation and sideline and would require a pump.  The current owners want to upgrade prior to a sale.  Richard Willecke moved to approve the plan number 2025, revised date of 12/03/08 and grant the two variances requested in the Emily E. H. Beebe letter dated December 3, 2008 for the upgrade of a septic system to serve a 3 bedroom structure, under general approval category subject to the following conditions:
a)      Design flow to be limited to 343 gpd to serve three bedrooms.
b)      The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
c)      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.

2.      PJ’s, 2616 State Highway, Map 23, Parcel 40, Septic Upgrade.  David Lajoie represented the applicant and gave an overview of the project.  He stated soil testing is required and they will come back to the Board.  Although there are already two wells on the property, there was discussion regarding installing a new well which would become the primary well.  Lajoie stating a re-circulating sand filter system is less complicated and less expensive.  This is a voluntary upgrade.  There is retail space on the property as well which will be served by the system.  A letter from Slade Associates supported the project.  Richard Willecke moved to approve the Felco Plan 03084 dated 9/20/08 and grant the five variances requested in the Felco, Inc. letter of 11/21/08 for the upgrade of a septic system to serve a 142 seat structure subject to the following conditions:
a)      Design flow to be limited to 5,032 gpd, to serve 142 seats.
b)      The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
c)      The new well shall be connected and put in service under the benefit of proper plumbing and electrical permits, and well shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
d)      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.
e)      Performance monitoring shall be done on a quarterly basis for influent and effluent as required under 310 CMR 15.202.
f)      Soil Evaluation to be performed and submitted with plan for approval.  
       Seconded by John O’Hara; passed 4-0.

g)      Business

III.          Licenses

IV      Minutes
Alex Hay moved to approve the 10/16/08 meeting minutes as presented; seconded by Ken Granlund; passed 3-0.
Alex Hay moved to approve the 11/20/08 as amended; seconded by John O’Hara,   passed 3-0-1.

V.       Correspondence 
         There was no correspondence to review.

The Bookstore Restaurant was discussed regarding their 2009 license.  The Board has not heard anything from them regarding the installation of the septic system.
Therefore, the Board will ask the Bookstore to come to the next meeting.  They are currently operating at risk.  Agent Greenberg stated we have to follow the food code regulations.  
It was learned they do not have insurance coverage at this point.  Because the Bookstore is in noncompliance with State regulations, Richard Willecke moved to refuse them a business license; seconded by Ken Granlund, 3 – 0 (Alex Hay abstaining).

Agent Greenberg gave a report on the activities in her office.  

Alex Hay moved to adjourn at 7:55 pm; seconded by John O’Hara; passed 4-0.
