        Minutes of Meeting of  October 16, 2008
Senior Center, Long Pond Room, 7:00 p.m.

Present:  Lezli Rowell, Alex Hay, Ken Granlund, and John O’Hara; Agent Hillary Greenberg and Assistant Agent Andrew Petty Christine Bates, Committee Secretary
Regrets:  Richard Willecke.
Vice Chair Rowell called the meeting to order at 7:00 pm.  

1.      Title V Variances Requests
        
1.      Glucksman, 165 Commercial St., Map 21, Parcel 118:  Septic Upgrade (Cont’d from 9/18/08).    There was no representation for the applicant; therefore Alex Hay moved to continue indefinitely; seconded by Ken Granlund, passed 4-0.


2.      Wenick/Haskett-Wenick, 120 Aunt Sarah’s Way, Map 42, Parcel 60:  Addition to dwelling.  Allan Cabral from Felco gave an overview of the project.  The variances are requested due to the addition to the dwelling.   The septic has already been installed.  Lezli Rowell moved to approve the Wenick/Haskett plan, numbered 08014 and dated 9/9/08, and grant the two variances requested in the letter of 9/17/08, for the amended septic plans addressing cellar wall setbacks, in compliance with the Nitrogen Loading Limitations, subject to conditions of original variance granting; seconded by Alex Hay; passed 4-0.  

3.      Santos Lord, 121 Indian Neck, Map 28, Parcel 138, Septic Upgrade.  Stephanie Sequin of Ryder Wilcox represented the applicant and gave an overview of the requested variances.  The applicant will be using an Advantex system under Remedial use.  The well is located in the basement and Sequin will advise the owners to monitor the water quality.  Lezli Rowell moved to approve Ryder Wilcox Plan #9979 dated 9/25/08 and grant the three variances requested in the letter of 9/29/08, for the upgrade of a septic system to serve a two bedroom structure, (a grandfathered nonconforming dwelling with respect to the Nitrogen Loading Limitation) using Advantex denitrification technology under the Remedial Use approval category, subject to the following conditions:
a)      Design flow to be limited to 238 gpd, to serve two bedrooms.
b)      No increase in habitable area without Board of Health review.
c)      There is to be no conversion of use without Board of Health review.
d)      The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
e)      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.
f)      A copy of a 3 year operation and maintenance contract with a certified wastewater operator shall be submitted to the Health Department prior to issuance of the Disposal Works Permit.  The system is to be equipped with a modem and auto dialer programmed to automatically call the maintenance company if alarm conditions occur.  Monitoring shall be quarterly for effluent for the following parameters:  temperature, pH, nitrate, and ammonia, BOD, TSS, Total Nitrogen and TKN.  The influent shall be sampled for these parameters biannually.  The schedule for monitoring shall be quarterly for the first 2 years of operation, semi-annually for the next 2 years, and 1 sample annually from then on.  If sampling data results exceed maximum effluent discharge limits, a system modification will be required.  Upon transfer of deed this schedule shall be restarted.  All results copied to the Health Department and the Barnstable County Department of Health and the Environment, with data provided in what format is acceptable to those agents.  Any other sampling per DEP approval.
g)      Tank to be tested with water tightness.

4.      Vulliet, 65 Samoset Ave, Map 28, Parcel 116:  Septic Upgrade.  Matt Farrell represented the applicant.  Lezli Rowell told the Board that the Engineering Company sponsored a  Brewster Little League team, of which she holds a position on the Board of Directors.  The Board consented for her to continue rather than recuse, finding no conflict of interest. Farrell gave an overview of the project and reviewed the variance requests.  The Board voiced several concerns with the proposed plan, including failure to propose advanced treatment in compliance with the local regulations.  Farrell will talk to the applicant with the Board’s concerns.  Ken Granlund moved to continue the hearing to date uncertain; seconded by PersonNameAlex Hay; passed 4-0.   

5.      Cattuccio, 174 Pleasant Point Rd., Map 35, Parcel 113, Septic Upgrade
Matt Farrell represented the applicant and stated this property was served by a cesspool and will be upgrading to Title 5.  It was confirmed the loft is a bedroom area.  The house is on the public water supply.  Rowell suggested that an I/A system is required under the local regulation due to the variances requested. Ken Granlund moved to continue to date uncertain; seconded by John O’Hara; passed 4-0.   

6.      Mac’s Shack/Duck Creek Creative Ctr., Map21, Parcels 128 and 129:  Septic Upgrade.  Alex Hay recused himself.  Lezli Rowell disclosed that she is employed by a tenant in the building, but has no financial interest; the Board consented for her to continue rather than recuse, finding no conflict of interest.  Chris Wickson of East Cape Engineering represented the applicant, stated that there are two adjoining lots that will be served by a shared system.  The proposed plan takes into account the restaurant and the Duck Creek Creative Center uses and associated flows.  There is a public water supply well across the street, serving the property.  Lezli Rowell noted this is a voluntary upgrade, and commended the engineering for avoiding any well variances and presenting advanced treatment.  Lezli Rowell moved to approve the East Cape 08-125 plans dated 10/16/08 and 09/18/08, and grant the seven variances requested in the September 22, 2008 letter for the upgrade of a septic system with a design flow of 3,602 gpd serving a restaurant and mixed commercial uses, in compliance with the Nitrogen LoadingLlimitation, using a recirculating sand filter (RSF) configuration to provide denitrification as permitted under the General Use approval category, with the following conditions:
a)      There is to be no conversion of use without Board of Health review.
b)      The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
c)      Any replacement of serving well connection with Municipal Water Supply shall be done under benefit of proper plumbing and electrical permits, and authorization by the Water Commissioners, and in compliance with the Water System rules and regulations.  
d)      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.

          An Emergency Operations Plan was presented to the Board by Debbie Patellos.

        No meeting minutes were reviewed.

V.       Correspondence 
        Agent Greenberg reviewed the correspondence.  

Due to time limitations, Agent Greenberg asked the Board if they wanted to make recommendations regarding the lead removal at the Boy Scout Camp. The Board stated they were not going to make any recommendations.  

Lezli Rowell moved to adjourn at 8:45 pm; seconded by Ken Granlund; passed 4-0.
