        Minutes of Meeting of October 4, 2007
Senior Center, Long Pond Room, 7:00 p.m.

Present:  Richard Willecke, Lezli Rowell, Ken Granlund, Agent Hillary Greenberg, Assistant Agent Andrew Petty and Christine Bates, Committee Secretary

Chair Willecke called the meeting to order at 7:00 pm.  

I.      Variance
1.              Antinori, 31 East Well St., Map 36, Parcel 156, Septic Upgrade.  Jason Ellis represented the applicant and gave an overview of the project.  He stated this is an existing 3 bedroom house and they will utilize an Advantex under general use.  Lezli Rowell moved to approve J. C. Ellis plan dated 08/16/07 and grant the five (5) variances requested in the 08/31/07 letter for the upgrade of a septic system to serve a three (3)        bedroom structure, a grandfathered nonconforming dwelling using an advantex for denitrification general approval subject to the following conditions:
a)      Design flow is to be limited to 337.12 gpd to serve 3 bedrooms
b)      No increase in habitable area without Board of Health review.
c)      The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
d)      STANDARD CONDITION:  Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.
e)      FOR I/A TECHNOLOGIES:  A copy of a 3 year operation and maintenance contract with a certified wastewater operator shall be submitted to the Health Department prior to issuance of the Disposal Works Permit.  Monitoring shall include testing the effluent for the following parameters:  temperature, pH, nitrate, ammonia and TKN.  The influent shall be sampled for these parameters once annually.  The schedule for monitoring shall be quarterly for the first 2 years of operation, semi-annually for the next 2 years, and 1 sample annually from then on.  Upon transfer of deed this schedule shall be restarted.  All results copied to the Health Department and the Barnstable County Department of health and the Environment, with data provided in what format is acceptable to those agents.  Any other sampling per DEP approval.
               Seconded by Richard Willecke; passed 3-0.
2.      Smart, 308 Alden Rd., Map 24, Parcel 97, Septic Upgrade.   Jason Ellis represented the applicant and gave an overview of the project.  This is for a property transfer.  Agent Greenberg read the letter from the National Park Service dated September 9, 2007.   Lezli Rowell moved to approve the J. C. Ellis plan revised date of August 16, 2007 and grant the two variances requested in the August 23, 2007 letter for the upgrade of a septic system to serve a two bedroom structure, a grand fathered nonconforming dwelling, with respect to nitrogen loading, using denitrificaton technology under general use approval category subject to the following conditions:
a)      Design flow is to be limited to 228.66 gpd to serve 2 bedrooms
b)      No increase in habitable area without Board of Health review.
c)      The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
d)      STANDARD CONDITION:  Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit
seconded by Ken Granlund; passed 3-0.
3.      Hill, 20 & 30 Ryder Court, Map 14, Parcels 11 & 12, Septic Upgrade.  Jason Ellis represented the applicant and gave an overview of the project.  He explained there are two separate properties with common ownership and three 3 dwellings on the property.  The State looks at it as one facility.  If one piece of property were sold, an easement has to be given to each parcel.  Jason recommended they make it one parcel.  The system is in failure.  The upgrade will use Alternative treatment under remedial use with an Advantex system.  There are ten (10) bedrooms total.  The Board stated it was a commendable plan for the lot size and number of bedrooms.  Lezli Rowell moved to approve J. C. Ellis revised plan dated 09/06/07 and grant the five variances requested in the letter of 09/10/07 for the upgrade of a septic system to serve a ten (10) bedroom structure, a grandfathered nonconforming dwelling with respect to nitrogen loading, using an Advantex for maximum denitrification remedial use approval category subject to the following conditions:
a)      Design flow is to be limited to 1100 gpd to serve 10 bedrooms in three structures, two two (2) bedroom dwellings and one one (1) bedroom dwelling on contiguous parcels held in common ownership.
b)      There is to be no conversion of use without Board of Health review.
c)      The new well shall be connected and put in service under the benefit of proper plumbing and electrical permits, and well shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
d)      Any replacement of on-site well connection with Municipal Water Supply shall be done under benefit of proper plumbing and electrical permits, and authorization by the Water Commissioners, and in compliance with the Water System rules and regulations..
e)      STANDARD CONDITION:  Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit

II.     New Business
1.      Summer, 40 Dalmas Trail, Map 13, Parcel 27, Nitrogen credit for 3 bedroom dwelling.  Agent Hillary Greenberg handled the request so it is unnecessary for the Board to review.

2.      DPW – Mark Vincent, Director and Kevin McHugh of Environmental Partners, gave a Wellfleet Transfer Station update.  The power point presentation identified the state the transfer is in now, including safety issues, congestion of both people and vehicles, poor traffic flow, and compacting safety.  There was discussion about providing a loop area to existing traffic, but there is concern with the trailers.  McHugh provided pictures of placeCape towns’ transfer stations.  Wellfleet has an outdated facility, including the roof over the hopper, using a make-shift boom to try and compact the garbage, and stated the life of the trailers is limited due to the damage done by the boom.  He stated the town would require two compacters, a different type of trailer, and redesign the hopper area.  Right now the garbage is exposed to the elements.   There is no shelter for equipment, no ability to perform maintenance onsite, and there is minimal staff facilities.  The recycling location is poor because it is too close to the transfer station, there is not an adequate area for public use or parking, has a poor layout and poor organization of containers.  Vincent stated the transfer station DEP regulations for storage or contamination issues.  It should be paved.  The necessary minimal improvements is to repair the roof, replace the hopper, repave as much area as possible, improve storm water control, meet waste ban requirements, and provide a building for hazardous materials storage.  Vincent stated there has to be a decision to continue investing in the existing facility by upgrading slowly or develop a new, safe environment.  

        Mark stated the upgrades have been put on the back burner due to other issues   with the town.  He stated there will be some new paving done in the near future, and he stated DEP may elect to give fines due to inadequate staffing, and the dumping area is unsafe. DEP wants an inspector for each load.  Richard stated he is concerned about leaching and the automobile accidents that happen on the property (fender benders).    Agent Greenberg suggested asking Marina Brock         from the County to visit as she gives good ideas to upgrade.  Chair Willecke stated he would like the full Board to be aware of the situation before making a   statement.

        Agent Greenberg stated the Water Commissioners want to go before the Board of   Selectmen to suggest a Waste Water Committee be formed.  Emily Beebe is meeting with Hillary on Tuesday to discuss waste water.  Lezli Rowell requested         having a presentation be made to the Board.  There was discussion regarding     water samples, changing nitrate levels, estuary results, receiving a report on the water sampling, and getting a report on the effectiveness of i/a systems in town.  Greenberg wants to work with what we have now before going for more data.  

        Agent Greenberg reported if Danforth’s system is not in by Oct. 21, 2007, the fees and  fines will go into effect.  

        There are 15 establishments participating in the Oyster festival.

        Letters from Ann Hile were distributed regarding Paine Hollow Road.  

        Agent Greenberg reported there is discussion in Town regarding a cluster system         involving the Harbor Master’s office, the Marina, the beach sticker office, the Book Store, and Captain Higgins building.  She stated she would rather see the Town cluster the Town’s uses only with no private entities.   She will engage in the discussion but will not support shared town and commercial sharing.  
   
        Fire Station:  Mike Qlink stated he is concerned about the amount of water they will use for washing their vehicles and the water is the elementary schools water.

        95 Rockwell Ave – no report from DEP.

        N-Star will be visiting at the next meeting regarding the pure tone noise.
