Minutes of Meeting of September 12, 2007, Senior Center, Long Pond Room, 7:00 p.m.

Present:  Acting Chair Alex Hay, John O’Hara, Ken Granlund, Agent Hillary Greenberg, Assistant Agent Andrew Petty and Christine Bates, Committee Secretary

Regrets:  Richard Willecke and Lezli Rowell   

Acting Chair Alex Hay called the meeting to order at 7:00 pm.  

I.      Variance
1.      Crossman, 4 Long Pond Rd, Map 15, Parcel 7, Septic Upgrade.  Chris Wickson of East Cape Engineering represented the applicant, and gave an overview of the project.  Alex Hay moved to approve East Cape Engineering Plan 05-128 dated 7/30/07 and grant the three variances requested in the letter of 7/30/07 for the upgrade of a septic system to serve a three bedroom structure, a grandfathered, non-conforming dwelling subject to the following conditions:
        a)      Design flow is to be limited to 331 gpd, to serve 3 bedrooms.
        b)      No increase in habitable area without Board of Health review.
        c)      There is to be no conversion of use without Board of Health                     review.
        d)      The well water shall be tested and found potable, with results                  copied to the Health Department, prior to issuance of the Disposal                      Works Permit.
        e)      Any replacement of on-site well connection with Municipal Water                         Supply shall be done under benefit of proper plumbing and                               electrical permits, and authorization by the Water Commissioners,                       and in compliance with the Water System rules and regulations.
        f)      Any restriction in design flow and all conditions shall be recorded                     against the deed for the property at the Registry in Barnstable, and                    proof of deed recording shall be submitted to the Health                                Department prior to the issuance of the Disposal Works Permit.
           
      Seconded by Ken Granlund; passed 3-0.

2.      Savage, 400 Nellie, Map 30, Parcel 623, Variance request.  Chris Wickson of East Cape Engineering gave an overview of the project.  This is an existing bioclear treatment system with installation in 1999.  The foundation will go from a crawl space to a full foundation.  A vinyl liner will be installed around the foundation.  It will remain a three bedroom dwelling.  The habitable space will increase by approximately 622 square feet with the addition of the second floor.  Abutter Samuel Genovese expressed concerns regarding the quality of his well water and impact on his septic and feels this project would be detrimental to his property.  Wickson stated his water and septic would not be affected for her family.  Dan Hagen, an abutter, feels there will be a great amount of sand to be removed as well as a large increase in habitable space.  Agent Greenberg stated a septic inspection is made prior to a Certificate of Occupancy being  issued.  Ken Granlund moved to approve East Cape Engineering plan dated 08/10/07 and grant the one variance requested in the 08/10/07 letter for the dwelling reconstruction of an existing septic system to serve a three bedroom structure, a grandfathered, non-conforming dwelling subject to the following standard conditions:
        a)      Design flow is to be limited to 256 gpd, to serve 3 bedrooms.
        b)      No increase in habitable area without Board of Health review.
        c)      There is to be no conversion of use without Board of Health                     review.
        d)      The well water shall be tested and found potable, with results                  copied to the Health Department, prior to issuance of the Disposal                      Works Permit.
        e)      Any restriction in design flow and all conditions shall be recorded                     against the deed for the property at the Registry in Barnstable, and                    proof of deed recording shall be submitted to the Health                                Department prior to the issuance of the Disposal Works Permit.
        f)      A copy of a 3 year operation and maintenance contract with a                    certified wastewater operator shall be submitted to the Health                  Department prior to issuance of the Disposal Works Permit.                      Monitoring shall include testing the effluent for the following                          parameters:  temperature, pH, nitrate, ammonia and TKN.  The                    influent shall be sampled for these parameters once annually.  The                      schedule for monitoring shall be quarterly for the first 2 years of                     operations, semi-annually for the next 2 years, and 1 sample                    annually from then on.  Upon transfer of deed this schedule shall                       be started.  All results copied to the Health Department and the                  Barnstable County Department of Health and the Environment, with data provided in what format is acceptable to those agents.  Any other sampling per DEP approval.
seconded by John; passed 3-0.  

3.      Balch, 275 Paine Hollow Rd., Map 29, Parcel 490, Install Septic.  A letter was requesting a continuation was received. Alex Hay moved to continue indefinitely; seconded by Ken Granlund; passed 3-0.

4.      Historical Society, 258 Main St., Map 15, Parcel 46, Septic Upgrade.  David Lajoie of Felco Engineering gave an overview of the project.  The property line runs through the building.  Ken Granlund moved to approve Felco plan 07088 dated 7/31/07 and grant the seven (7) variances requested in the letter of 8/13/07 for the upgrade of a septic system to serve a five bedroom structure, a grandfathered, non-conforming dwelling using micro fast denitriciation technology under the remedial use approval category subject to the following conditions:
        a)      Design flow is to be limited to 340.4 gpd, to serve 5 bedrooms.
        b)      No increase in habitable area without Board of Health review.
        c)      There is to be no conversion of use without Board of Health                     review.
        d)      The well water shall be tested and found potable, with results                  copied to the Health Department, prior to issuance of the Disposal                      Works Permit.

II.     New Business
1.      Jason, 45 Dale Ave., Stable Permit.  Agent Greenberg stated this is for one horse and there is a manure management plan in place.  Alex Hay moved to approve the Stable Permit; seconded by John O’Hara; passed 3-0.

2.      Chivian / Danforth, 129 Way 657, Stable Permit / Fowl.  Audrey Danforth stated this is for two horses and three turkeys with a manure management plan in place.  John O’Hara moved to approve the stable permit and fowl permit; seconded by Alex Hay; passed 3-0.

III.    Old Business
1.      Smith, 115 Pond Ave., Increase Habitable Space.  Hay read the letter from Smith regarding their plans to increase the habitable space.  Agent Greenberg  stated it is an open floor plan and the plans identify one bedroom.  Letters were received from abutters with their concerns regarding the size of the dwelling on the small parcel .  Ann Hile, direct abutter, read her letter of concerns regarding the size of the proposed dwelling, the undersized lot, and the intensity of use with a dwelling 2400 square feet.   Agent Greenberg advised Hile there cannot be any enforcement regarding the number of people in the house.  She called the State and they did not want to see the plans.  Hay stated the plans are within zoning bylaw regulations as well as Board of Health regulations.    Ms. Hile requested the Board review the progress of the construction.  Agent Greenberg stated the silt fence was to go up when the septic was installed.  Alex Hay moved to approve the increase in habitable space; seconded by Ken Granlund; passed 3-0.     

2.      Reilly, 165 3rd St., Increase Habitable Space.  Alex Hay read the request from Martin Reilly.  The bedroom count will remain the same.  Ken Granlund moved to approve the increase in habitable space; seconded by John O’Hara; passed 3-0.

VI.      Correspondence  - none

VII.     Meeting Minutes – need quorum

Alex Hay recommended  accessible bins and better signage for recycling at the transfer station.  He also requested compost for residents.  

Agent Greenberg reported Pete Crosen, Ocean View Drive, owns a cottage colony and one small lot across the road surrounded by National Seashore.  One of the cottages is in jeopardy of going over the bank.  There is a foundation on the lot.  The first option would be to relocate on the cottage on the lot, or move one or both bedroom cottages on the small lot across the street.  They are trying to tie the two properties with an easement to  make it one parcel so the bedrooms could be moved.  Agent Greenberg asked the Board what they would be comfortable in recommending.  Hay suggested putting a deed restriction on the lot across the street.  

Ken Granlund motioned to adjourn at 8:15 pm; seconded by Alex Hay; passed 3-0.
