Wellfleet Board of Health
        Minutes of Meeting of March 14, 2007
Senior Center, Long Pond Room, 7:00 p.m.

Present:  Chair Richard Willecke, Kenneth Granlund, and Alex Hay , Health Agent Hillary Greenberg, Assistant Agent Andrew Petty and Christine Bates, Committee Secretary

Chair Willecke called the meeting to order at 7:00 pm.  


I.      Title V Variances Requests
1)      Cacchiotti, 180 Commercial St., Map 21, Parcel 91:  Septic System Upgrade
Matt Farrell of Bennett & O’Reilly represented the applicant, along with Jay Horowitz, Architect.  Farrell stated Cacchiotti had appealed the original denial of the septic system and the State gave approval for the septic.  They will be utilizing an Amiphidrone system and are requesting 15 variances.  He gave an overview of the proposed addition to the kitchen with a full foundation.  Willecke read a letter from abutter, Robert Kennedy, requesting the tree on the Cacchiotti property be saved.  Agent Greenberg asked if the water test had been returned and questioned  whether the well could be located if the water is not potable.  Water testing will be required.  Greenberg  requested an additional condition be made that no expansion can take place until the septic is installed and inspected.   Willecke moved to approve Bennett & O’Reilly job number B002-3615 revised 03/19/07 and grant the 15 variances of a septic system to serve a 4 bedroom structure, a grandfathered nonconforming dwelling with respect to the nitrogen loading limitation, using denitrification technology under the Remedial Use approval category  subject to the following conditions:
a)      Design flow to be limited to 440 gpd, to serve 4 bedrooms.
b)      A variance has been granted to allow a reduction in the size of the leach area provided to 348 gpd.  Any functional or hydraulic failure will necessitate upgrade to Title 5 Code LTAR soil absorptions systems calculated to at least 75% of the design flow.
c)      No increase in habitable area without Board of Health review.
d)      There is to be no conversion of use without Board of Health review.
e)      The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
f)      Any replacement of on-site well connection with Municipal Water Supply shall be done under benefit of proper plumbing and electrical permits, and authorization by the Water Commissioners, and in compliance with the Water System rules and regulations.
g)      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.
h)      A copy of a 3 year operation and maintenance contract with a certified wastewater operator shall be submitted to the Health Department prior to issuance of the Disposal Works Permit.  Monitoring shall include testing the effluent for the following parameters:  temperature, pH, nitrate, ammonia and TKIN.  The influent for the following parameters once annually.  The schedule for monitoring shall be quarterly for the first 2 years of operation, semi-annually for the next 2 years, and 1 sample annually from then on.  Upon transfer of deed this schedule shall be restarted.  All results copied to the Health Department and the Barnstable County Department of Health and the Environment, with data provided in what format is acceptable to those agents.  Any other sampling per DEP approval.
i)      The Certificate of Compliance to septic must be issued prior to commencement of further construction.
j)      Tanks to be water tested and witnessed by Health Agent.

Seconded by Alex Hay, passed 3-0.
 
2)      Sanders, 1100 Blackfish Lane, Map 30, Parcel 105:  Septic System Upgrade.  Matt Farrell and Keith Fernandez of Bennett & O’Reilly represented the applicant.  Matt gave an overview of the property, stating the dwelling is located on a coastal bank; therefore, they will also go to the Conservation Commission.  An easement was granted to the Sanders in order to locate the septic system by an abutter.  They will be using a Septitech system.   Agent Greenberg questioned five bedrooms because the only access to the first floor bathroom is to go through a bedroom, which is a “pass through room” and is not considered a bedroom.  An explanation was given regarding the bedroom count of five.  Toni Athans represented the Trustees of Drummers Cove Condo Association and abutters Paula Draper and Canary Burton were interested in getting more information on the project.  They requested information regarding the location of some of the stakes which Farrell explained indicates the leach area and the work zone boundaries.  Athans stated the Condo Association supplies the water to the Sanders property and is deed recorded, and they do not have the ability to supply enough water for 5 bedrooms.  Agent Greenberg suggested if the water is potable, the Sanders drill their own well.  Burton stated the original owner divided the property, which once included the condo’s and the Sanders property.  Discussion took place regarding erosion to the property, potential odor from the septic system, drainage, and parking issues.   Willecke suggested the hearing be continued so determine water issues.  Agent Greenberg will confirm the number of bedrooms.  Chair Willecke moved to continue to 3/28/07, seconded by Alex Hay; passed 3-0.         

II.     New Business
DPW Transfer Station Public Hearing.  Chair Willecke stated the DPW would close the facility on Wednesdays and Thursdays, remain open on Sundays, and be closed on Martin Luther King Day, Presidents Day, Patriots Day, Columbus Day and Veterans Day.  It will remain open on Memorial Day, July 4, and Labor Day.   Ken Granlund moved to approve the schedule; seconded by Alex Hay; passed
3-0.  The new schedule will be effective October 23, 2007.

V.      Correspondence  
·       A letter from Jane Martin regarding the rabies baiting vaccine program – will continue baiting in April.  
·       A letter from Cape Cod Commission regarding the tower.
·       A listing of VNA clinics and support groups per town
·       A letter from the Wellfleet Planning Board regarding the new Catholic Church.  
·       The Juice – septic system failed – may not get their license to open this spring.
·       A letter to Peters regarding installation of a tight tank prior to installation of a new well.

IV.     Meeting Minutes

        No quorum to approve the minutes of 2/28/07.  

Alex Hay motioned to adjourn at 8:45; seconded by Ken Granlund; passed 3-0.
