Minutes of Meeting of September 13, 2006
Senior Center, Long Pond Room, 7:00 p.m.
Present: Chair Richard Willecke, Lezli Rowell, Anne White, Alex Hay, Health Agent Hillary Greenberg, Assistant Health Agent Andrew Petty, and Christine Bates, Committee Secretary

Chair Willecke called the meeting to order at 7:00 p.m. The meeting was tape-recorded.
I. Meeting Minutes
Due to lack of quorum, July 26, 2006 meeting minutes will be approved at a later date.
II. Title V Variances Requests
1. 55 Pine Point Rd, Map 21, Parcel 46: Septic Upgrade
Rowell moved to continue per Applicant’s request; 2nd by Willecke; continued to Sept. 27, 2006.
2. 65 Mill Hill, Map 13, Parcel 95: Septic Upgrade
Emily Beebe represented the applicant. The owners have been using a single cess pool located outside of their property during the summer months due to a failure with their own on their property and under emergency approval. The Board previously ordered an upgrade, and granted an extension of time for Beebe to design the septic system. Variances are requested for setbacks to the cellar, setbacks to locus private well, a reduction to leaching area, and increase in maximum cover allowance.
The locus well was recently installed and shows good quality.
Rowell stated that the plan requires either an I/A system, as triggered by the well variance, or formal request of a variance from local Board of Health regulation 607. She noted the language in the variance letter seemed to address the mitigating factors described in the regulation. Willecke agreed that the local regulation must be addressed. With regard to the Board’s question of why no flow-barrier is proposed to compensate for the reduction to foundation, Beebe stated there is a walk out basement but it is not habitable. It was the Board’s consensus that either barrier must be provided or the SAS configuration relocated, or perhaps designed as trenches, to achieve the minimal separation. Beebe stated the applicant would like to move the driveway location, which drove the
septic siting. The Board suggested continuation to allow Beebe to redesign, and expressed its concern about a 64’ separation from the locus well to the leaching area. Beebe felt that the topography could be used to waive the requirement for advanced treatment. The Board requested more detailed hydrologic evidence, responsive to 607, if the applicant wishes to seek that variance. Rowell noted that the I/A seemed preferable as it would also mitigate the reduction of leaching capacity provided.
Beebe state that she could fully size the leaching area, and that this is not a year round house. She did not feel that an I/A system would work as well. Willecke responded that the Board does not look at seasonality, nor does Title 5, and Rowell noted that was not a permissible criteria for waiving local regulation 607. She also did not feel that there was a choice between fully sizing the SAS or responding to the requirement for I/A, as long as the well separation remained compromised. Agent Greenberg stated the water quality report demonstrated low nitrates, even though there was use of a cess pool during the timeframe taken. Rowell moved to continue to Sept. 27, Willecke 2nd; passed 7-0.
III. New Business
Petty reported he failed Danforth’s septic due to silted aggregate. Stone media has been replaced.
Parkington Subdivision – Agent Greenberg stated the property is of sufficient size for the siting of private wells and son-site septic systems. Willecke moved to approve as presented; Rowell seconded; passed 4-0.
6 Kendrick Ave (Balsh), Deed Restriction Sign-off . Agent Greenberg received a call from the Town Administrator requesting the Board of Health sign off on the deed restriction which would restrict use to one bedroom, in exchange for hook up of the residential unit to the Municipal Water Supply, releasing the property form the water use easement to the Captain Higgins property. The Board signed off and the deed restriction will be recorded.
IV. Licenses -- No licenses to sign.
V. Correspondence
Agent Greenberg’s letter to WHAT regarding a violation: paint disposal to a storm drain, in violation of the Clean Water Act.

A discussion took place regarding the pandemic exercise held in Wellfleet..
Agent Greenberg reported the metal pile at the dump will be contained.
Agent Greenberg stated the private property wells in the placePlaceNameHerring PlaceTypeRiver basin will be tested for sodium to establish a baseline for future monitoring in association with the Herring River Salt Marsh Restoration Project.
Mayo Beach was closed twice during the summer due to precipitation association coliform counts.
Willecke moved to adjourn at 7:35; seconded by Hay; passed 4-0.
