Minutes of Meeting of July 26, 2006
Senior Center, Long Pond Room, 7:00 p.m.
Present: Chair Richard Willecke, Lezli Rowell, Kenneth Granlund, Health Agent Hillary Greenberg, Assistant Health Agent Andrew Petty, and Christine Bates, Committee Secretary

Chair Willecke called the meeting to order at 7:00 p.m. The meeting was tape-recorded.
I. Meeting Minutes
Lezli Rowell moved the meeting minutes of 7/12/06 as amended; seconded by Richard Willecke; passed 3-0.
II. Title V Variances Requests
1. Wellfleet Marketplace,295 Main St., Map 14, Parcel 181: Septic Upgrade
Tim Brady represented the applicant. He reviewed the proposed upgrade which will utilizing an alternative treatment, due to proximity to abutters’ wells and an inland wetland area. Rowell commended the plan for staying out of the public water supply well protective arcs (Zone 1’s) and noted that the replacement SAS maintain essentially the same variance as the failed system held to the well serving parcel 182. Agent Greenberg was satisfied with the design flows, obtained from the revised Title 5 for supermarket use. Scott Planey, an abutter from addressStreetHolbrook Ave, questioned if the new design is an improvement and wondered if nitrogen would affect his property. Brady stated it is an advanced treatment and would reduce the nitrate level contributed
from this properties’ effluent. Rowell acknowledged the plan would represent an improvement in an area impacted generally by soluble nitrogen in the groundwater and that the parcel in particular could not be attributed to Mr. Planey’s well water quality.
Willecke moved to approve East Cape Engineering, Inc. dated 07/19/06 plan number 06-094 and to grant the 5 variance requested in the July 19, 2006 letter with the following conditions:
a) Design flow is to be limited to 509 gpd to serve a retail store.
b) There is to be no conversion of use without Board of Health review.
c) The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
d) Any replacement of on-site well connection with Municipal Water Supply shall be done under benefit of proper plumbing and electrical permits, and authorization by the Water Commissioners, and in compliance with the Water System rules and regulations.
e) Bi-Annual pump out of the existing 1000 gallon septic tank is required, with log of septage disposal copied to the Health Department.
f) Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in placeCityBarnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.
g) A copy of a 3 year operation and maintenance contract with a certified wastewater operator shall be submitted to the Health Department prior to issuance of the Disposal Works Permit. Monitoring shall include testing the effluent for the following parameters: temperature, pH, nitrate, ammonia and TKN. The influent shall be sampled for these parameters once annually. The schedule for monitoring shall be quarterly for the first 2 years of operation, semi-annually for the next 2 years, and 1 sample annually from then on. Upon transfer of deed this schedule shall be restarted. All results copied to t he Health Department and the Barnstable County Department of Health and Environment, with data provided in what format is acceptable to those agents.
Any other sampling per DEP approval.

2. Martha Linares, 50 5th Ave., Map 40, Parcel 49: Septic Upgrade. Emily Beebe represented the applicant. Beebe gave an overview of the project, stating there is a minor change regarding the setback to the abutters’ property line which improves siting with respect to the coastal bank. Lezli Rowell moved to approve Emily E. H. Beebe, R.S., LLC, plan
1224, dated July 10, 2006 and grant the variance requested in the Beebe letter dated July 11, 2006 for the upgrade of a septic system to serve a three bedroom structure, a grandfathered, non-conforming dwelling with respect to the Nitrogen Loading Limitation with the following conditions:
a) Design flow is to be limited to 343 gpd to serve three bedrooms.
b) No increase in habitable area without Board of Health review.
c) The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit
d) Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.
Seconded by Ken Granlund; passed 3-0.
3. Gigi Ledkovsky,353 Wilson Ave., Map 30, Parcel 617: Variance for setback to foundation. Gigi represented herself as the property owner, with plans to put a full foundation under her dwelling, newly creating the variance in the existing septic system. Architectural plans devised a step out in the poured foundation to maintain the setback, but installation would be
costly and difficult compared to matching the full footprint. She stated that David Lajoie of Felco, Inc. prepared the plans presented, utilizing a flow barrier on the foundation to address the variance created. She read two letters from abutters in support of the project. Lezli Rowell stated that such retrofits iwht a barrier are typical, and she has no opposition granting the permit in the Health Department office. Richard Willecke concurred this is a good plan. The Board of Health does not have to approve this plan. Agent Greenberg will provide necessary paperwork from her office.
III. New Business
Chair Willecke proposed having one meeting in the month of August 2006 due to vacation issues and work issues for the Board members. It was agreed the next meeting will be held on August 23, 2006.
Willecke reported he went before the Board of Selectmen with the new tobacco regulations and 4 selectmen approved them. He suggested the Board address the penalties to be imposed in a September 2006 meeting.

V. Correspondence
Agent Greenberg provided copies of letters she sent regarding violations of the Sanitary Code, housing section. Rowell commended Agent Greenberg for her promptness in addressing violations, and professional format of the Notice of Order to Correct Violations. Previous violations by the same property owner were discussed.
There was a notification of vaccinations for DPW employees.
Agent Greenberg reported a visitor from placeStateConnecticut was diagnosed with West Nile Virus (which he contacted in CT).
