Board of Health Minutes - 11-09-05

Chair Willecke called the meeting to order at 7:00 p.m.  The meeting was tape-recorded.

Meeting Minutes
Lezli Rowell moved to approve October 12, 2005 meeting minutes as presented; seconded by Ken Granlund; passed 3-0.

Variance Requests

1.      1130 Brown’s Neck Road, Map 7, Parcel 70:  
        Owner:  Jurj and Emanuela Striedter, Engineer:  Emily Beebe, RS, LLC.  Variance request to upgrade septic system.  Emily Beebe explained that due to the topography of the property, the leaching area and septic tank would require a variance to property line setbacks to the as well as a variance for setbacks to the cellar wall.  Lezli Rowell asked whether a full leaching trench configuration had been considered; Beebe replied that the limited space and the sloped areas were the reason for going with a series o fcast leaching units.  Rowell moved to approve the plan dated 10/30/05 and grant the variances requested in the Emily E. H. Beebe, RS, LLC letter of 10/29/05 for the upgrade of septic system to serve a three bedroom dwelling, in compliance with the Nitrogen Loading Limitation, subject to the following conditions:  
1)      Design flow to be limited to 331 gpd, to serve 3 bedrooms.
2)      The new well shall be connected and put in service under the benefit of proper plumbing and electrical permits, and well shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
3)      Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.
        Seconded by Alex Hay; passed 5-0.

New Business

1.      555 Old Wharf Road, Map 35, Parcel 9:  Owner Edward Boratko, Engineers Schoefield Brothers (Laura Schofield).  Laura Schofield and property owner, Edward Boratko explained this is a voluntary upgrade.  Laura explained the dwelling is a seasonal cottage located on a salt marsh.  The dwelling has a cesspool and a plan was presented to the Board of Health in 1998 but was denied due to the proximity of the site to the wetlands.  Discussion took place regarding the potential use of an I/A system with a variance to the marine resource setback, and the lack of year-round occupancy of the dwelling; however, the applicants want to upgrade the system.   The applicant asked the Board how they could upgrade without the cost of an I/A system.  Laura asked if they could come back with the 1998 plans which were denied originally.  Willecke responded that the Board cannot make a recommendation based on the owners using the property 3 months out of the year because they cannot determine what might happen in the future with the use of the property, or enforce seasonality.  Rowell noted that there is no distinction in title V for seasonal or year-round occupancy, and cautioned that in giving informal guidance, the Board cannot guarantee a new plan or any specific variances would be approved.   Rowell recommended the applicant review Wellfleet’s local regulations regarding triggers for advanced treatment, the clauses for seeking relief, and determine what type of system they would like to apply with.    Mr. Boratko was concerned about the water quality.  The board explained that an upgrade would be an improvement for health and environmental reasons.   The applicant will come back with a formal request.  

2.   Infant / Toddler Daycare Program at COA.   Jacqui Wildes Beebe, Council on         Aging Director, came to the table.  She stated she had nothing to add at this time      above her October 19, 2005 letter to the Board.  Agent Greenberg asked the following    questions, with the corresponding answers:
·       If a child had to go to the restroom, would there be stairs available or some way for the child to utilize the restroom?  Yes, there would be steps available both in the bathroom and in the hall.
·       Is there an evacuation plan?  Yes, a plan similar to an elementary school plan.  One of the cribs has wheels and the children would be placed in the crib and be rolled out of the building.  They are required by regulations to have the equipment.  They must have a fire drill once a month.  The current fire alarm automatically dials 911.  
·       Rowell asked why they did not have an exclusive bathroom for the children in the event the child needed cleaning from sickness (such as a tub).  Regulations prohibit bathing a child.  Parents would be called if the child became ill.  If the program is successful, it would be a long term goal to have a designated bathroom.    
·       Do all employees at the Senior Center get CORI-ed?  No, employees are not checked; however, volunteers are.

Agent Greenberg stated an agent from the Early Education Dept. to view the facility on November 15.  Discussion took place regarding the portable sink.  Jacqui Wildes Beebe provided a portable sink cleaning and a hand washing protocol.   Rowell and Willecke stated they would prefer a permanent plumbing solution because there is a viable alternative and it would provide a vehicle to get a permanent bathroom for the children into the plan.  Ms. Beebe stated there are financial issues and feels they cannot have a separate plumbing line.  Greenberg and the Board supported having a permanent sink with the line going to the grease trap in the kitchen.   At that point, Lezli Rowell stated that an interim use of the portable sink would not be appropriate.  Lezli Rowell moved to have Agent Greenberg write a letter on behalf of the Board of Health and Health Department supporting a variance to the State plumbing code, to have the sink waste line go to the grease trap, and to permit the program through review with staff of the provisions relating to health concerns marked in 102 CMR 7.00; Alex Hay seconded; passed 5-0.   Greenberg also stated the number of seats for assembly use of the COA will be decreased in the facility to 126 to accommodate the programs needs in septic design adequacy and occupancy loading, because the building is classified as a function hall.  She had provided a written opinion to the board and applicant regarding the status of the well and septic, noting the new need to sample water supply for soluble metals.  A corrosion control system may become necessary to serve the Seababies program in the COA building.   
        
Other Business and Announcements

Discussion took place regarding licenses required for handling and selling food in the Wellfleet Marketplace, especially the need to date-stamp prepared, to-go items, as well as the board agreeing to have Agent Greenberg sign the paperwork for the Harborside Village Cooperative Corp. on its behalf.
