Meeting Minutes
Ken Granlund moved to approve August 24, 2005 meeting minutes with recommended amendments; seconded by Alex Hay; passed 3-0.

Variance Requests
1. 1065 Chequessett Neck Road, Map 19, Parcel 91
Owner: Elizabeth Currier, Engineer: Martin Donoghue, PE, Variance request to upgrade subsurface sewage disposal system. Reggie Donoghue of Coastal Engineering Co., Inc. presented a revised proposal which would move the system 100 feet away from the salt marsh. The abutter had no problem with the proposed change in plans. Agent Greenberg requested Coastal Engineering remove the previously requested setback variance from the final plan.
Lezli Rowell moved to approve Coastal Engineering plan revised in compliance with marine resource setbacks, Sheet SS-1 dated 11/09/04 and grant the variances requested in the letter of October 7, 2005 for the upgrade of septic system to serve a four bedroom structure in compliance with the Nitrogen Loading Limitation, with floor plans to be reviewed by the Health Agent, subject to the following conditions:
· The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
Alex Hay seconded the motion; passed 3-0.
2. 420 Lieutenant Island Road, Map 41, Parcel 79
Owner: Bruce Patterson, Engineer: Martin Moran, PE, Variance request to upgrade subsurface sewage disposal system. Marty Moran stated this proposal includes an I/A system for a two bedroom dwelling. Variances requested are for six feet from setback between SAS and lot line and 52 feet between SAS and water-course, to be remediated by the incorporation of the advanced treatment. Rowell questioned whether the Agent was satisfied with the plan groundwater adjustments from the observed, and the vertical separation, or whether monitoring of tidal influence through a lunar cycle should be the substituted methodology; Agent Greenberg stated she is comfortable with the deep hole observation and Frimpter method of adjustment in the area sufficiently set back for tidal influence. Lezli Rowell pointed out this is a voluntary upgrade and commended the homeowner for addressing improvement. Moran stated there have not been any problems with the water supply on this property.
Lezli Rowell moved to approve Moran Engineering revised plan dated 09/26/05 and grant the variances requested in letter of 08/19/05 for the voluntary upgrade of septic system to serve a two bedroom structure in compliance with the Nitrogen Loading Limitation, subject to the following conditions:
· Design flow is to be limited to 228 gpd to serve two bedrooms
· There shall be no increase in habitable area without Board of Health review.
· The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
· Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.
· A copy of a 3 year operation and maintenance contract with a certified wastewater operator shall be submitted to the Health Department prior to issuance of the Disposal Works Permit. Monitoring shall include testing the effluent for the following parameters: temperature, pH, nitrate, ammonia and TKN. The influent shall be sampled for these parameters once annually. The schedule for monitoring shall be quarterly for the first 2 years of operation, semi-annually for the next 2 years, and 1 sample annually from then on. Upon transfer of deed this schedule shall be restarted. All results copied to the Health Department and the
Barnstable County Department of Health and the Environment, with data provided in what format is acceptable to those agents. Any other sampling per DEP approval.
Motion seconded by Ken Granlund; passed 3-0.
3. 489 State Highway, Map 42, Parcel 129
Owner: Gunther C. Back, Engineer: David Lajoie, R.S. Variance request to upgrade subsurface sewage disposal system. David Lajoie explained the existing cesspool has failed. In order to site septic system outside of the 100 foot protective radius, two wells will be relocated.
Lezli Rowell moved to approve Felco Inc. plans dated 09/21/05 and grant variances requested in the letter of 09/28/05 for the upgrade of septic system to serve office space in compliance with Nitrogen Loading Limitation, subject to the following conditions:
· Design flow is to be limited to 212 gpd
· There shall be no conversion of use without Board of Health review
· The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit
· Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.
Seconded by Alex Hay; passed 3-0.
New Business
125 Sarrett Lane, Map 42, Parcel 87.4, Owner: John S. Kelley, Sarrett Lane Realty Trust, Special permit filed with ZBA to convert existing cottages to condominium ownership. David Lajoie represented the applicant. It was determined units 1 and 4 share a 1978 Code system for 4 bedrooms and units 2 and 3 have a 1999 installed system for 4 bedrooms. The Master Deed states each unit has its own septic; language needs to be changed in the document. Agent Greenberg will do a septic inspection and make a site visit to confirm bedrooms. Lezli Rowell moved to forward the Board’s recommendations and conditions for a Special Permit as follows:
· Annual test of well(s) with results copied to the Health Department.
· Septic system(s) to be inspected every two years, and at such intervals as may be required by Title 5 and the Town of Wellfleet, with the 1978 Code system to be inspected immediately, with reports submitted to Health Department.
· There will be no creation of additional bedrooms
· The language of the Master Deed needs to be justified against the septic plans.
Ken Granlund seconded the motion; passed 3-0.
Other Business and Announcements
Agent Greenberg reported Deck II has test holes scheduled for October 13, 2005. She reported all temporary licenses were signed by the Health Department for the Oysterfest.
