Minutes of Meeting of January 9, 2002
Senior Center, Long Pond Room

                Citizens of Wellfleet

Chair David Breen brought the meeting to order at 7:00 p.m.

OLD BUSINESS:
Evelyn Paine, Pilgrim Springs Cottages, 2032 State Highway, Map 29, Parcel 127 bigger pump, one capable of 25 gallons per minute.  She will check with the DEP concerning this.  She added that she might not need a second well if a larger pump could supply adequate water for her total number of bedrooms.   She has gone to the Assessor to determine the number of bedrooms on file with the town; she stated that Mike Quink of the DEP says that the DEP will accept the townquestions concerning brush clearing (ans.: brush will be burned during open burning time) and the water quality (ans.: water was tested by the public water supply operator, Whitewater, quarterly last year).  Betty Kimball commended the thoroughness of the letter of 11/21/01 from Lawrence Dayian of the DEP detailing the inspection findings and recommendations on the Pilgrim Springs Cottages water supply.  Lezli Rowell suggested that a variance to occupancy requirements might be obtained; she asked whether, considering the vintage of the cottages, square foot requirements for occupancy would be pertinent.  Ms. Paine added that her septic system, designed for a 35-bedroom count plus a coin laundry, was installed in April 2001.  Lezli Rowell moved, based on grandfathered use of the cottage colony and a Title 5 approved and installed septic system with a design flow of 35 bedrooms and incorporating laundry use, that occupancy of Pilgrim Springs Cottage Colony is for 2 persons per bedroom, not to exceed 35 bedrooms for bedrooms 90 square feet and greater.  Betty Kimball seconded.  Discussion covered water quantity problems and their possible solutions: the existence of an additional well in the pool house, the possible use of expansion storage tanks.  Chair Breen called for a vote upon the motion; it passed unanimously, 4-0.  Ms. Paine will return to the Board in two weeks with an update.

Variance Requests:
Dalby, 255 Holbrook Avenue, Map 14, Parcel 149approve Felco Engineering Plan #00270, dated 11/1/01, with the requirement that the leachfield be moved towards the western boundary in such a way that construction can be carried out without infringement upon abutters
Mary Reilly, 46 East Commercial Street, Map 15, Parcel 77100
that abutting building on Parcel #78 be included on the plan
that a letter be written by East Cape Engineering stating that in their opinion no additional well exists on Parcel #78 closer than 50 feet to the proposed septic system
that an additional registered letter be sent by East Cape Engineering to the owner of Parcel 78 recommending that he contact the Board of Health or East Cape Engineering within 10 days of the mailing for the purpose of locating the well
that if the well is found to be less than 50
that there be no increase in the number of bedrooms
that corrected copies of the plan be resubmitted to the Board of Health.
The motion passed unanimously, 4-0.
Patrick Whitty, 105 LeCount Hollow Road, Map 30, Parcel 11Rogers Plan #W-01-1740, dated 11/21/01, and to grant four variances requested in the letter from William Rogers II, dated 12/13/01, for the upgrade of the septic system on the property.  The motion passed unanimously, 4-0.

Discussion covered ground water elevations, construction protocol (accessing off town property), performance bonding, and necessity for Board of Selectmen approvals.  David Breen posed questions about the pump system: areas handled by both pumps, circuitry, monitors or event counters, isolation valves, necessity for explosion-proof motors, junction box location.  Questions were invited from the audience; Charles Amsler, representing the abutting Gruber property, asked about regrading (ans: will not be done on the Gruber property) and whether a performance bond would protect abutters and the town.  He stated that he hoped the project would be completed by May 15 and was told that completion was planned for between the end of February and Mid-April.  Building Inspector Asmann stated that the Fire Department is concerned about having access to the back of the church lot.  
Ms. Beebe suggested that there should be preconstruction photographs from Coastal Engineering.  There being no further discussion, Geoffrey Karlson moved and Lezli Rowell seconded that the Board of Health approve Coastal Engineering Plan #C11551, as revised 1/02/02, and to grant all variances requested in the letter from Coastal Engineering, dated 12/31/01, for the upgrade of the septic system on the property cited above, subject to the following conditions:

that property adjoining Parcel #177 not be impacted by construction
that petitioner receive permission from Wellfleet Board of Selectmen to gain access for construction through Parcel #174
that petitioner receive permission from Wellfleet Board of Selectmen for grading slope on to Parcel #174
that petitioner obtain bond protection for abutters and Town
that pre-construction photographs be done
that construction be completed before May 15, 2002
that design flow be restricted to 2000 gallons daily

Karlson moved and Rowell seconded that the Board of Health request that the Health
Agent write a letter to the Board of Selectmen supporting access and grading on
Parcel 174; passed unanimously (4-0).
Housing Authority/Lower Cape Community Development Corporation, 324 Old Kingin nitrogen from the septic system.  He added that the buildings were changed on the original plan because of the 20opinion confirmed by Jeff Stewart of the ZBA, stating that this represented Bob Hankeyprepare and present a revised plan.  Owater storage tank, gas lines, propane tanks, and catch basins to the north of the proposed easement.  The motion was approved unanimously, 4-0.  Chair Breen asked Mr. O
