Minutes of Meeting of May 14, 2003
Senior Center, Long Pond Room


Present:        David Breen, Chair; Betty Kimball; Lezli Rowell; Ken Granlund;                  Emily Beebe, Health Agent; Erik Mitchell, Assistant Health Agent


Chair Breen called the meeting to order at 7:00 p.m.

Variance Requests:  
Downs, 15 Briar Lane, Map # 14, Parcel # 27. Represented by FELCO, Inc.
·       Alan Cabral of FELCO, Inc. requested a continuance of the hearing to a later date.  The applicant is negotiating with an abutter to relocate the abutter
·       Ms. Rowell moved to continue the hearing to June 11, seconded by Ms. Kimball.  The motion passed 3-0-1 (Breen abstaining)

Schnare, 11 Railroad Avenue, Map # 21, Parcel # 79 . Represented by FELCO, Inc.
·       Ms. Rowell recused herself from the hearing, as her husband had a business relationship with the owner
·       Mr. Breen read letter dated 5/14/03
·       Mr. Cabral stated that the Board previously approved the use of a recirculating sand filter on the site due to the fact that the lot fell within the setbacks to 2 Public Water Supplies (PWS); specifically Just Desserts & the Lobster Hutt.
o       Just Deserts is no longer a PWS. This change in use eliminate 4 out of the 5 previously granted variances, including the requirement for the use of a sand filter and pump chamber.
·       Ms. Beebe supports the revised plan provided that
1.      New Deep Observation Holes and perc tests are performed in the location of the leaching area
2.      the Board of Health receives a copy of the DEP letter regarding the approval for the abandonment of the Public Water Supply
·       The single variance request has already  been approved by the Board
·       Ms. Kimball moved that the Board accept the preliminary plan as Revised 5/12/03 pending receipt of the DEP letter, performance of 1 additional deep observation hole and approval by the Health Agent; Mr. Breen seconded; The motion passed 3-0 (Rowell recused).

Discussion
Stable Regulations
·       Ms. Beebe discussed the meeting held at Barnstable County Extension with Bill Clarke, George Heufelder and a member of the NRCS.  The purpose of the meeting was to gather information on the health issues associated with the keeping of domestic animals and to discuss appropriate regulations regarding stables in the Town of Wellfleet.  The most important stable management practice for protecting public health is manure management; specifically the location of the piles in relation to drinking water wells and wetlands, and the importance of keeping the piles covered to prevent the leaching of nutrients.
·       Mr. Breen inquired as to the number of horses in town.
·       Ms. Beebe indicated there are approximately 20 resident horses in town and that there are likely many more non-resident visitors during the summer season.
·       Ms. Beebe indicated that the Board
·       Ms. Rowell stated that she favors education over regulation and that she would like to read the materials provided by the health agent and to continue discussion on the matter at the next Board of Health meeting.
·       Ms. Beebe indicated that the Board should establish a time frame for the stable permit for Judy Tesson.  Ms. Rowell moved that the stable permit for Judy Tesson be continued until the first meeting in July.  Mr. Breen seconded. The motion passed 4-0.

New Business
·       Mr. Breen announced that on 5/15/03 he will be officially resigning from the Board of Health for personal reasons.

Mr. Breen made a motion to adjourn at 8:00 p.m.; the motion was seconded by Ms. Rowell and passed 4-0.
