I.      CALL MEETING TO ORDER BY CHAIRMAN

Chairman Tropeano called the meeting to order at 7:00 P.M.

MOTION: Selectman Fernandes-Abbott moved to appoint Selectman Pillsbury as Clerk Pro-Tem.  Selectman Parola seconded.

VOTE:  Unanimous (4-0-0)

A.      Roll Call

II.     CITIZENS PARTICIPATION

III.    CONSENT AGENDA

C1.  Authorization to sign bills, documents, etc.
(NONE)

C2.  Appointment to the Historical Commission.

MOTION: Selectman Pillsbury moved the Board appoint Angela M. Dunham as an associate member to the Historical Commission to a term to expire 6/30/06.  Selectman Fernandes-Abbott seconded.

VOTE:  Unanimous (4-0-0)

IV.     TOWN ADMINISTRATOR’S REPORT

1.      Oil Spill Prevention Measures.  The Coalition for Buzzards Bay would

like the Board to endorse the attached Statement in Support of Oil Spill Prevention Measures for Buzzards Bay.  It was forwarded to Michael Parola for his comments, which are also attached.  While he has made some personal comments, overall he is in favor of the Town supporting this Statement.

MOTION: Selectman Pillsbury moved the Board support the Statement in Support of Oil Spill Prevention Measures for Buzzards Bay prepared by the Coalition for Buzzards Bay, as attached.  Selectman Parola seconded.

VOTE:  Unanimous (4-0-0)

2.      Vision 2020, SRPEDD.  As the Board is aware, the Zoning By-Law Rewrite Committee has been working to update the By-laws, including making them easier to understand.  To be able to accommodate growth & still maintain the Town’s rural/agrarian character, tow inter-related issues:  Transfer of Development Rights (TDR) & Village District By-laws, need to be addressed.

For assistance on these two issues, the Town is looking to SRPEDD (South Eastern Regional Planning & Economic Development District) & has prepared an application for technical assistance from Vision 2020.  It is expected that the new amendments will be presented to the spring Town Meeting.

Discussion ensued re:  the Board not supporting Vision 2020 in the past, but the Town is a member of SRPEDD.  Selectman Pillsbury feels the Board needs to discuss Vision 2020 & she feels there are ways in which the Town can support it w/out the issues the Board is against.  Chairman Tropeano stated that he will put this matter on a future agenda.

MOTION: Selectman Pillsbury moved the Board approve & authorize the Chair to sign the application to SRPEDD for technical assistance from Vision 2020 to assist the Zoning By-law Rewrite Committee w/ Transfer of Development Rights (TDR) & Village District By-laws.  Selectman Fernandes-Abbott seconded.

VOTE:  Unanimous (4-0-0)

3.      Comprehensive Infiltration/Inflow (I/I) Program.  As the Board is aware, DEP has required that the Town develop a comprehensive I/I program & over the past few months the Town has been working w/ CDM to develop a program.  The program will be broken down into four distinct phases including:

·       I/I Study
·       Sewer System Evaluation Survey (SSES)
·       Corrective Measures Implementation
·       Post Corrective Measures Flow Monitoring

The Board members have received a letter from CDM dated 9/2/04 that outlines in detail the activities w/in each of the four phases.  At this time, the Board is being asked to approve an agreement w/ CDM to complete Phase I of the I/I program.  The cost of completion of this phase shall not exceed $50,000.

MOTION: Selectman Pillsbury moved the Board approve the agreement w/ Camp, Dresser & McKee (CDM) for the Infiltration/Inflow Program, Phase I & the cost of completion of this phase shall not exceed $50,000.  Selectman Parola seconded.

VOTE:  Unanimous (4-0-0)

4.      Harbor Service Permit Rate Increase.  The Board is asked to approve a rate increase for Harbor Service Permits & Moorings for calendar year 2005.  Proposed increases & current rates are noted below:

NOTE:   Non-resident fees are double.

MOTION: Selectman Pillsbury moved the Board approve an increase in Harbor Service Permits & Mooring fees for calendar year 2005 as presented.  Selectman Fernandes-Abbott seconded.

VOTE:  Unanimous (4-0-0)

5.      Cable Advisory Committee.  The Cable Advisory Committee needs the Board to extend the deadline to 1/5/05.

MOTION: Selectman Pillsbury moved the Board extend the Cable Advisory Committee deadline to 1/5/05.  Selectman Fernandes-Abbott seconded.

VOTE:  Unanimous (4-0-0)

V.      LICENSES & PERMITS

A.      Application for a Common Victualler’s License by Pizzaboy, LLC, 3101 Cranberry Highway, East Wareham for the year 2004, under the provisions of MGL c.138.

No-one was present to represent the application.

Chairman Tropeano discussed the applicant’s confusion w/ the application process.  He stated the applicant is currently operating w/out this license.

MOTION: Selectman Pillsbury moved the Board approve the application for a Common Victualler’s License by Pizzaboy, LLC, 3101 Cranberry Highway, East Wareham for the year 2004, under the provisions of MGL c.138.  Selectman Fernandes-Abbott seconded.

NOTE:   Brief discussion ensued re:  the correct address of the establishment.  Chairman Tropeano stated he will verify the address at the Board’s office.  

VOTE:  Unanimous (4-0-0)

B.      Renewal of the following Year Round Common Victualer All Alcoholic Beverages Licenses for the year 2005, under the provisions of MGL c. 138:

1.      Margery Kistin Anzalone d/b/a Harbor Watch Inn, Margery Kistin Anzalone, Manager, 167 Onset Ave., Onset;
2.      Welch’s Restaurant & Lounge, Inc. d/b/a Pomodore’s Restaurant & Lounge, Brian Welch, Manager, 2424 Cranberry Highway, East Wareham; &
3.      Kaimo Corp. d/b/a Shooters Restaurant & Sports Bar, Jacqueline M. Hoban, Manager, 2691 Cranberry Highway, Wareham.

MOTION: Selectman Pillsbury moved & Selectman Fernandes-Abbott seconded that the Board approve the renewal of the following Year Round Common Victualer All Alcoholic Beverages Licenses for the year 2005, under the provisions of MGL c. 138:

1.       Margery Kistin Anzalone d/b/a Harbor Watch Inn, Margery Kistin Anzalone, Manager, 167 Onset Ave., Onset;
2.      Welch’s Restaurant & Lounge, Inc. d/b/a Pomodore’s Restaurant & Lounge, Brian Welch, Manager, 2424 Cranberry Highway, East Wareham; &

1.       Welch’s Barnacle Bill’s d/b/a Barnacle Bill’s, 3126 Cranberry Highway, East Wareham.

VOTE:  Unanimous (4-0-0)

D.      Approve an application for a 2:00 A.M. extension on New Year’s Eave for a Common Victualer’s All Alcoholic Beverages License, under the provisions of MGL c. 138:

1.      Margery Kistin Anzalone d/b/a Harbor Watch Inn, 167 Onset Ave., Onset.

MOTION: Selectman Pillsbury moved the Board approve the application for a 2:00 A.M. extension on New Year’s Eave for a Common Victualer’s All Alcoholic Beverages License, under the provisions of MGL c. 138:

1.       Margery Kistin Anzalone d/b/a Harbor Watch Inn, 167 Onset Ave., Onset.

VOTE:  Unanimous (4-0-0)

VI.     ANNOUNCEMENTS

1.      The Annual Christmas Parade begins at 4:15 P.M. at Besse Park on 12/18/04 ending at Memorial Town Hall parking lot.  Santa arrives at Spillane Field, fireworks to follow.  Raindate:  12/19/04.
2.      Next meeting of the Board of Selectmen:  1/4/05.
3.      All street light issues should be directed to Republic Electric at 1-800-LIGHTS ON.

VII.    NEW BUSINESS
(NONE)

VIII.   SELECTMEN’S REPORTS

A.      Selectman Tropeano – Stated that the Board appointments to the Economic & Community Development Authorities need to be contacted.  He stated a letter could be sent to these individuals requesting them to join the committees.  He added if anyone is interested in serving on these committees they can obtain applications in the Board of Selectmen’s office.

MOTION: Selectman Parola moved the Board appoint the following individuals to the Community & Economic Development Authority to terms to expire 6/30/06:  Jeanne Connontin, Sandra Besse, Meg Kistin, Dave Mackley, & Paul Willard.  Selectman Fernandes-Abbott seconded.

VOTE:  Unanimous (4-0-0)

IX.     RECOGNITION NIGHT – CITIZENS & EMPLOYEES OF THE TOWN    

Present before the Board:       Representative Susan Williams-Gifford
                                Mr. Silva, Senator Pacheco Aide

Selectman Pillsbury presented  Deena Kinsky w/ a Certificate of Recognition for her outstanding service to the Wareham Free Library, in furthering the cause of literacy, as coordinator of the Reading Partners Adult Literacy program.  Her dedication to high standards and strong interpersonal skills have made this fledgling program an integral part of the library’s program of service.  The Town joins the tutors & students Ms. Kinsky has served in wishing her further success as the program grows.  Representative Williams-Gifford & Mr. Silvia presented Ms. Kinsky w/ Certificates of Appreciation.

Selectman Pillsbury presented Craig Chartier w/a Certificate of Recognition for his participation in undertaking many archaeological projects on behalf of the Town of Wareham.  His enthusiasm for this subject knows no bounds & his willingness to share w/ the public, emphasizing that an educated public ensures that Wareham’s history will be preserved.  On behalf of the citizens of the Town of Wareham, the Board of Selectmen thank Mr. Chartier for his generous sharing of knowledge w/ its citizens and for freely giving his time to benefit the community.  Representative Williams-Gifford & Mr. Silvia presented Mr. Chartier w/ Certificates of Appreciation.

Selectman Parola presented James Brogioli w/ a Certificate of Recognition for his participation on 10/13/04 in helping to save the lives of a family from drowning.  The citizens of Wareham are proud that he is a part of the Wareham Harbormaster Department.  The Board of Selectmen thank him for his unselfish act.

Selectman Parola stated that Mr. Brogioli could not attend this evening, but she shared a letter w/ the public from Mr. Brogioli.  Representative Williams-Gifford & Mr. Silvia presented Michael Parola, Harhormaster w/ Certificates of Appreciation for Mr. Brogioli.

Selectman Parola presented R. Garry Buckminster w/ a Certificate of Recognition for his heroic deed on 10/13/04 when he dove into the waters of Buzzards Bay to save the lives of a family from drowning.  His quick thinking and bravery to save another human life is commendable.  The Board of Selectmen are thankful & proud of his unselfish act & that he is a member of the Wareham Harbormaster Department.  Representative Williams-Gifford & Mr. Silvia presented Mr. Buckminster w/ Certificates of Appreciation.  

Selectman Tropeano presented Officer Susan J. Kucinski w/ a Certificate of Recognition for her heroic deed on the afternoon of 10/4/04 following a recent construction detail which could have resulted in serious injury or death to a construction laborer.  Her quick reaction is commendable.  The Town is thankful & proud that she is a member of the Wareham police force.  Representative Williams-Gifford & Mr. Silvia presented Officer Kucinski w/ Certificates of Appreciation.

Selectman Tropeano presented Candice L. Hemenway a Certificate of Recognition for volunteering her personal time to administer CPR Refresher Certification courses and for her enthusiastic approach & willingness to “jump on board” assisting other departments w/ her support of drives, fairs, & clinics is commendable.  In the interest of public health & safety her contribution has assisted the Town in their roles as servants to the public & fellow employees.  Representative Williams-Gifford & Mr. Silvia presented Ms. Hemenway w/ Certificates of Appreciation.

X.      ADJOURNMENT

MOTION: Selectman Fernandes-Abbott moved to adjourn the meeting at 7:35 P.M.  Selectman Parola seconded.

VOTE:  Unanimous (4-0-0)
