I. CALL MEETING TO ORDER
Acting Chairman Sauvageau called the meeting to order at 7:07 P.M.
MOTION: Selectman Pillsbury moved Selectman Fernandes-Abbott be Clerk Pro Tem. Selectman Sauvageau seconded.
VOTE: Unanimous (3-0-0)

III. CONSENT AGENDA
C1. Authorization to sign bills, documents, etc.

C2. Approve minutes of previous meetings: 8/17/04 – Regular Session & 9/14/04 – Regular Session.
NOTE: The meeting minutes of 8/17/04 were deferred to a later date.
MOTION: Selectman Fernandes-Abbott moved the Board approve the regular session meeting minutes of 9/14/04. Selectman Sauvageau seconded.
VOTE: (2-0-1)
Selectman Pillsbury abstained
C3. Appointment to the renamed Southeastern Massachusetts Commuter Rail Task Force.
MOTION: Selectman Fernandes-Abbott moved the Board appoint Cynthia K. Parola as a representative for the Town of Wareham to the Southeastern Massachusetts Commuter Rail Task Force to a term to expire 9/30/06. Selectman Pillsbury seconded.
VOTE: Unanimous (3-0-0)
IV. TOWN ADMINISTRATOR’S REPORT
1. Order of Taking – Weweantic Shores Sewer Project. At the Board’s last meeting the Board approved an Order of Taking for certain properties associated w/ the Weweantic Sewer Project. The Order of Taking issued at that meeting involved properties where the owners had not waived their right to an appraisal & damages. The Board now has a copy of an Order of Taking for the remaining properties associated w/ the project. The property owners involved have waived their rights to damages, thereby making this order a “friendly” taking. The Administrator requested the Board approve & execute the Order
of Taking.
MOTION: Selectman Fernandes-Abbott moved that the Board acting as Sewer Commissioners do hereby take on behalf of the Town perpetual easements over, in, under, along, & through those lands described as “Easement – E3,” “Easement – E4,” “Easement – E6,” & “Easement – E7,” on a plan entitled: “Easement Plan of Land, Marion Road – Route 6, Wareham, MA (Plymouth County),” dated September 19, 2003, & prepared by SMC for Camp, Dresser & McKee, Inc. Selectman Pillsbury seconded.
VOTE: Unanimous (3-0-0)
2. Bryant Farm Assignment. The Board approved the assignment of the Bryant Farm property, but the Chair will not be available for the closing & execution of documents. The Administrator requested that the Board Clerk execute the documents.
MOTION: Selectman Fernandes-Abbott moved the Board authorize Selectman Sauvageau, Board Clerk to execute the documents for the Bryant Farm purchase & sale. Selectman Pillsbury seconded.
VOTE: Unanimous (3-0-0)
V. LICENSES & PERMITS

VI. ANNOUNCEMENTS
1. Selectman Fernandes-Abbott attended the Eagle Scout ceremony for Joshua Roe. She commended him on this tremendous achievement.
2. The Board will need to vote on articles indicated in the Warrant by 10/5/04. The Warrant will go to print on 10/12/04.

MOTION: Selectman Pillsbury moved at 7:15 P.M. to enter into Executive Session for the purpose of discussing the status of litigation. Selectman Fernandes-Abbott seconded.
