MINUTES OF MEETING OF BOARD OF SELECTMEN/SEWER COMMISSIONERS

I.              CALL MEETING TO ORDER BY CHAIRMAN

The meeting was called to order at 6:15 P.M.

        A.  Roll Call

III.            CONSENT AGENDA

C1.  Authorization to sign bills, documents, etc.
(NONE)

C2.  Signing of BAN’s

Present before the BOS: Mary Ann Silva, Town Clerk
                                Dale Zacamy, Town Treasurer

Ms. Zacamy stated the Town is borrowing $8 million in anticipated notes w/ $7.6 million being for the Middle School project & the rest for equipment.  

Brief discussion ensued re: the rate percentage & the interest costs.

MOTION: Selectman Tropeano moved, as Clerk of the Board of Selectmen, and Selectman Pillsbury seconded that the Board of Selectmen approve the sale of $8 million at 1.75% bond anticipation notice of the Town of Wareham dated 6/20/03 payable 6/15/05 to TGH Securities and accrued interest plus a premium of $83,200 and further, that the Board of Selectmen vote to confirm the consent dated 6/11/03 to the financial advisor bidding for the notes.

VOTE: Unanimous (5-0-0)

The BOS members proceeded to sign the documents.

The BOS members were sworn-in by Ms. Silva re: signing.


III.            TOWN ADMINISTRATOR’S REPORT

1.  Liquor License Violation Hearing.  The police have investigated International Holding Group, Inc. d/b/a GiGi’s Restaurant located on 2 West Central Ave. & found it to be closed.  As this is a violation of their Common Victualer License, the BOS will need to schedule a hearing to determine what action should be taken.

2.  Shellfish Relay.  The Harbormaster, Michael Parola, has indicated that the recent oil spill has resulted in the shellfish relay not being able to take place at Tempest Knob, where it was originally scheduled.  Instead, he is asking that the BOS approve closing an area in Onset to allow this relay to take place there.  This is in accordance w/ the State permitting through the Division of Marine Fisheries & involves 900 bushels of quahogs.

MOTION: Selectman Tropeano moved the BOS approve, under the provisions of MA General Law, Chapter 130, Section 54, changing the status of “the waters & flats of that portion of Onset Bay, north of Onset Ave. bridge & easterly of the Main Ave. bridge (Dummy Bridge)” of Management Area #6, East River & Broad Cove, to “CLOSED” to prohibit the taking of shellfish, effective 6/17/03.  Selectman Sauvageau seconded.

VOTE: Unanimous (5-0-0)

3.  Surplus Equipment - School.  The School Dept. has some items from the Middle School they wish to dispose of as surplus or obsolete merchandise.  As per the Town’s By-law’s, Division I, Article V, Land Sale & Sale of Personal Property, Bids, Section 2, the BOS has to give them written approval.  Because no individual item has a value exceeding $500.00, it does not have to be a competitive bid process.

MOTION: Selectman Tropeano moved the BOS send written approval to the School Dept. to allow them to dispose of personal property w/in their control, by sale or otherwise, & authorize the Chair to sign on the BOS’s behalf.  Selectman Sauvageau seconded.

VOTE: Unanimous (5-0-0)
4.  Bid Award - Bituminous Concrete.  Bids were received & publicly opened 6/7/01 for Bituminous Concrete for State Aid Improvements & Town Roads on an as needed basis for one year w/ renewal options for two additional one-year periods.  At the recommendation of Mark Gifford, Municipal Maintenance Director, Admin has awarded the second one-year renewal option to T.L. Edwards; Avon, MA for Class I Bituminous Concrete &U Bituminous Concrete lay in place.  The price reflects a $1.00 per ton increase for Class I Bituminous Concrete &  $3.00 per ton for the sidewalk price.

5.  Bid Award - Bank Run & Processed Gravel.  Bids were received & publicly opened 6/7/01 for the purchase & delivery of bank run & processed gravel for a one year period w/ options available for two additional one year contracts.  At the recommendation of Mark Gifford, Municipal Maintenance Director, Admin. has awarded the second one-year renewal option to P.A. Landers, Inc. & Tlcon Capaldi, Inc.  Price increases are noted.

V.              LICENSES & PERMITS

A.  Hearing - Application for Inflammable Fluids License - Home Depot, USA, Inc., 2994 Cranberry Highway, Wareham, MA.

Present before the BOS: Walter Sterling, Fire Consultant for Home Depot

Mr. Sterling stated when the amount of flammable liquid exceeds a certain amount a permit is needed to store & sell these fluids.  He discussed classes of fluids & the kinds that will be stored for example, Class IB, oil, gas, etc.

No one spoke in favor or against the application.

MOTION: Selectman Tropeano moved to close the hearing.  Selectman Sauvageau seconded.

VOTE: Unanimous (5-0-0)

MOTION: Selectman Tropeano moved the BOS approve the Application for Inflammable Fluids License - Home Depot, USA, Inc., 2994 Cranberry Highway, Wareham, MA.  Selectman Sauvageau seconded.

VOTE: Unanimous (5-0-0)

NOTE:   The meeting proceeded w/ item VIII.  Selectmen’s Reports.

1.      Selectman Chamberlain - Stated she attended the MPO meeting w/ SRPEDD.  She stated she would be
2.      on 6/25.  She stated at the meeting she met w/ three representatives of MA Highway & spoke re: issues of curb cuts.  She discussed what she learned.  Discussion ensued.
Discussion ensued re: the status of the Wareham project.

NOTE:   The meeting went back to item V.  Licenses & Permits - B.  Application for Transfer of Year Round Retail Package Goods Store All Alcoholic Beverages License from Five Stare Liquor, Inc.  to D.J. Sullivan, LLC d/b/a Sullivan Wine & Spirits, Joel C. Sullivan, Manager, 260 Marion Rd., Wareham, MA.

MOTION: Selectman Pillsbury moved to open the hearing.  Selectman Sauvageau seconded.

VOTE: Unanimous (5-0-0)

Mr. Walvernatt stated Mr. Sullivan is purchasing Five Star Liquors store & is looking for a transfer of license.  He stated Mr. Sullivan is purchasing the assets & real estate.  He stated the liquor license would be held by the LLC.  He discussed the proposed hours of operation.  He stated Mr. Sullivan’s son Joel will manage the store & both Sullivan’s have completed TIPS training.  He stated they would be using the interlock I.D. checker.  He stated the closing would be 6/27/03.  He briefly discussed the floor plan of the establishment.  He discussed repairs made per the recommendations of the Water & Fire Depts.  He discussed the Sullivan’s business experience in Town.

No one spoke against or in favor of the application.

MOTION: Selectman Tropeano moved to close the hearing.  Selectman Sauvageau seconded.

VOTE: Unanimous (5-0-0)

Brief discussion ensued re: no CORI report has been received.  

MOTION: Selectman Tropeano moved the BOS approve the application for Transfer of Year Round Retail Package Goods Store All Alcoholic Beverages License from Five Stare Liquor, Inc.  to D.J. Sullivan, LLC d/b/a Sullivan Wine & Spirits, Joel C. Sullivan, Manager, 260 Marion Rd., Wareham, MA contingent upon receipt of a favorable CORI report & final inspections.  Selectman Pillsbury seconded.

VOTE: Unanimous (5-0-0)

1.  Town Meeting reconvenes at 7:00 P.M. on 6/17/03.
