I. CALL MEETING TO ORDER BY CHAIRMAN

II. CITIZENS PARTICIPATION

Ms. Campbell stated the OPL is considering a dedication bench in honor of Grace Bucan for all she has done for the Town. She asked the BOS to reconsider recycled benches. She

III. WAREHAM HISTORICAL COMMISSION REPORT

Joan Borgatti, Historical Commission
Ms. Pizzalato updated the BOS on the Town’s historical properties survey being undertaken w/ CPA funds, which is currently being conducted by PAL, Inc. of Rhode Island. She stated the survey will include the taking of digital pictures & the recording above ground buildings that
may be included as part of the survey. She stated the survey may help in acquiring other grants. She stated the survey would be completed in the fall.

8. MBTA Representative
Admin. stated that there may be a problem w/ Ms. Ishihara being the Town’s Moderator & representing the Town on the MBTA. Discussion ensued re: special municipal status to be paid by the Town or Ms. Ishihara electing not to be paid as Moderator. Ms. Ishihara stated that if the position of Moderator is on the SBA list there would be no issue. The BOS concurred to make this appointment, but to have Ms. Ishihara wait to submit her invoice for Moderator duties until this matter is cleared up.

3. Hearing - Transfer of liquor license from Brendan J. Crosby, Jr., d/b/a The Raven to Kaimo Corp. d/b/a The Raven, Kevin J. Mahoney, Manager, 2691 Cranberry Highway, Wareham & application for public amusement on weekdays license for live entertainment, dancing, juke box, & 2 pool tables.
Ms. Chamberlain stated that the BOS is not in receipt of all information needed for this transfer to proceed, namely, there are no inspectional reports.

V. TOWN ADMINISTRATOR’S REPORT
1. Commemorative Benches. Admin. briefly discussed revised policy re: commemorative benches for the BOS’s review. The revision includes the use of “recycled plastic, a combination of wood & wrought iron or other material approved by te BOS or their designee” as suitable material for benches.
Discussion ensued re: eliminating iron from the policy. Discussion ensued re: restricting colors. Discussion ensued re: having more uniformity of benches w/in the Town & keeping choices as simple as possible.
The BOS concurred to have the Admin. & Chairman Chamberlain come up w/ choices & report back to the BOS on 7/15.
2. Sewer Connection Permit - Chili’s. Chili’s has applied for permission to connect to the Town’s collection system for their property at 2885 Cranberry Highway. It is the recommendation of David Simmons, WPCF Superintendent, that his be approved pending payment of all appropriate charges. Construction inspections will be done periodically throughout the construction process which will be coordinated w/ the contractor. Admin. stated that the charges will be $9,775.10.
MOTION: Selectman Tropeano moved the BOS approve the application of Chili’s to connect their property at 2885 Cranberry Highway to the Town’s collection system pending payment of all appropriate fees & charges. Selectman Sauvageau seconded.

3. Tedeschi Darman LLC Corporation. An agreement has been made for the roadway & traffic signal improvement project on Rtes. 6 & 28 in conjunction w/ the work being done for Home Depot. This agreement is similar to the one the BOS signed w/ Home Depot in order for them to complete the work required by MA Highway. This work is for the Tedeschi Darman side of the highway.
MOTION: Selectman Tropeano moved the BOS approve an agreement w/ Tedeschi Darman LLC Corporation for the roadway & traffic signal improvement project on Rtes. 6 & 28 in Wareham. Selectman Sauvageau seconded.

4. July 4th Fireworks. Admin. spoke re: traffic restrictions on July 4th commencing at 8:00 P.M.
5. Bid Award - Painting of Traffic Lines & Traffic Control Markings. Bids were received & opened on 5/10/01 for the painting of traffic lines & traffic control markings for a one-year period commencing 6/1/01 w/ renewal options for two additional one year periods. At the recommendation of Mark Gifford, Municipal Maintenance Director, the Admin. awarded the second one year renewal option to Hi-Way Safety Systems, Inc. of Hanover, MA.
6. Annual Antiques Faire - 7/4/03. Admin. has approved the request for the Wareham Historical Society to use Center Park for their 26th Annual Antiques Faire to be held 7/4. The application has been completed by the appropriate depts. & the Certificate of Insurance has been supplied as requested.
7. Bond Anticipation Notes. Bids will be taken on 7/9/03 & the BOS should expect to vote to award the BANS at the 7/15/03 BOS meeting.
8. Alternate Board of Health Member. Admin. reminded the BOS that they need to create an additional alternate BOH membership.

9. Career Center. Effective 7/1/03 the Career Center will be opening up in the Multi-Service Center.

11.Meeting Re: Double Hulled Vessels. A meeting will be held on 7/14/03 at 10:00 A.M. relative to double hulled vessels.

A. To determine if a Year Round Common Victualer All Alcoholic Beverages License issued to International Holding Group, Inc. d/b/a GG’s Restaurant, Georgi K. Georgiev, Manager, 2 West Central Ave., Wareham, MA should be suspended, revoked, or canceled, under the provisions of Chapter 138, Section 77 of the MA General Laws for the year 2003 & the BOS policies.

All that were to testify were sworn in by Chairman Chamberlain.
Detective Flannery stated on 5/17/03 he conducted alcohol compliance checks & discussed the procedure for liquor license checks.
Mr. Cecchinelli stated that he was out in the kitchen helping on 5/17/03 & was not out front. He stated he has stipulated to all the waitresses that they must check everyone’s identification. He doesn’t know what happened on this date.
Present before the BOS: Lisa LeBlanc, Agent for Wareham Police Dept.
Ms. LeBlanc discussed the circumstances surrounding her ordering alcohol at Franca’s. She stated she is 20 years old & was not asked for identification. She stated she was also w/ someone else that was underage. She described the waitress that served her & identified her in the audience. She stated she had been to Franca’s before, but hadn’t tried to purchase alcohol.
Selectman Tropeano disclosed that the waitress that will be testifying worked for him previously. Selectman Sauvageau disclosed that his younger brother had worked at Franca’s in the past.

Ms. Santi stated she is a new waitress at Franca’s & has worked there the past 2 ½ months. She stated she did wait on Ms. LeBlanc. She stated Ms. LeBlanc & the other customer ordered beers. She stated she gave the order to the bartender who recommended she (Ms. Santi) card the two customers. She stated when she brought the order over to the two customers & attempt to ID them, Ms. LeBlanc was on the phone & stated there was an emergency & she had to leave. She stated the beer was in bottles. She stated since this incident she has been TIPS certified & was reprimanded.
Mr. Byron stated he was TIPS certified two months ago. He stated he did tell Ms. Santi to ID the two customers before giving them the beer. He stated he understands from his training that the waitress can have the alcohol on her/his person as long as the customer does not drink.
Ms. Santi stated it was a busy night & she intended to ask the two customers for ID’s when Ms. LeBlanc got off the phone. She stated Ms. LeBlanc came into Franca’s again some time later & was carded.
Mr. Cecchinelli stated Ms. LeBlanc did not pay for the beer & she didn’t touch the alcohol & no glasses were put on the table. He added that he is trying to run a good business.
Discussion ensued re: previous violations in 200 & 2001.

Mr. Diantomasso discussed the circumstances that occurred that day. He stated the servers & manager have been terminated. He added that other staff would work on getting TIPS certification.

Detective Flannery discussed what occurred at this establishment on 5/17 & how the minor agent purchased alcohol.
Mr. Welch stated he has no excuses for what happened & he will not contest the violations.

Mr. Armstrong apologized for the incident & stated Mr. Vezina has made every effort to train his personnel & avoid this type of situation. He stated the employee that sold to the minor was suspended. He discussed the new program Mr. Vezina has started w/ carding everyone & entering data into the register.

Chairman Chamberlain stated this matter will be handled at the BOS’s 7/15 meeting. Brief discussion ensued re: this matter.
B. Any other business.
1. Class I & Class II Licenses.
Selectman Tropeano discussed Class I & II licenses & the writing in of motorcycles & trailers. He asked if these licenses would handle the selling of cars as well. He feels clarification of these licenses is necessary. Admin. stated he would look into this matter.
2. Double hulled vessels.
Chairman Chamberlain stated that she received response letter from the Town of Westport pertaining to the oil spill. She stated they read the letter addressed to Bouchard re: double hulled vessels.
3. Licensing Seminar.
Chairman Chamberlain updated the BOS on the licensing seminar Admin. Assist. Barbara Ford attended. She discussed what the Town of Chelmsford adopted re: licensing.
4. Advertising Hearings.
Chairman Chamberlain discussed the cost of advertising hearings for violations. She suggested possibly passing on these costs to the violators. Discussion ensued.
5. Cape Verdean Festival.
Chairman Chamberlain stated that the festival is not authorized to use non-profit status now because they are a new entity, but they are working on this matter. She stated for the festival to get a raffle permit they would need non-profit status & they need to have it for two years, but they can’t so as they stand. She discussed what the MA lottery said the BOS could do to waive this two year rule. Brief discussion ensued.
MOTION: Selectman Tropeano moved to waive the two-year rule for the Cape Verdean Festival. Selectman Sauvageau seconded.
VOTE: Unanimous (4-0-0)
6. Zoning Re-Write Committee.
Chairman Chamberlain spoke re: the make-up of the committee. Discussion ensued.
Lengthy discussion ensued.
The BOS members concurred to have another member at large.
MOTION: Selectman Sauvageau moved to go beyond the hour of 10:00 P.M. Selectman Pillsbury seconded.
VOTE: Unanimous (4-0-0)
Chairman Chamberlain stated all applications for this committee need to be in by 7/11/03. She also stated the BOS should meet w/ the applicants.
IX. SELECTMEN’S REPORTS
1. Selectman Pillsbury - Spoke re: the issue of no parking attendants. She feels they are needed. She spoke re: calls received about Little Harbor Beach which is a resident beach only & the use of the beach by non-residents.
Admin. stated the police did ticket non-sticker vehicles at the beach today. Selectman Pillsbury feels the police need to continue doing this & the situation needs to be looked at. Discussion ensued.
Selectman Pillsbury spoke re: the issue of charging for summer festivals. Discussion ensued. Discussion ensued re: possible alternatives to the current charges.
X. ADJOURNMENT
MOTION: Selectman Pillsbury moved at 10:10 P.M. to enter into Executive Session for the purpose of discussing litigation. Selectman Sauvageau seconded.
