Council Minutes October 1, 2007
PRESENT:        Chairman Friedman, Councilor Hathaway and Councilor Parker; Manager W. Reed, Office Administrator J. Reed, CEO A. Thomas and Police Chief M. Leonard. Town Auditor Charemon Willey arrived late.  Councilor Perkins and Councilor King were absent and excused.

ITEM 1. The October 1, 2007 Veazie Town Council meeting was called to order at 7:00PM.
        
ITEM 2. Consideration of the Minutes
Motion By:  Councilor Parker—to accept the September 17, 2007 meeting minutes as written.  Seconded: Chairman Friedman. Voted 2-0-1 in favor.

ITEM 3. Consideration of the Agenda
There were no additions to the agenda.
                
ITEM 4a.        Public Hearing – G.A. Ordinance Revisions
Motion By:  Councilor Hathaway —to enter into public hearing to hear public comments on the proposed G.A. Ordinance Revisions.  Seconded:  Councilor Parker, Voted 3-0 in favor.

There were no comments from the public.

Motion By:  Councilor Hathaway—to close the public hearing and reconvene regular session.  Seconded:  Councilor Parker, Voted 3-0 in favor.
                
ITEM 4b.        Halber Easement
Manager Reed outlined that it was discovered that the Town either acquired or was given title to a portion of a subdivision on Brookside Terrace.  The parcel of land was believed to belong to the Halbers and they have paid taxes on the parcel.  Manager Reed stated that the Halbers are trying to sell their home and have requested a municipal release of the triangular section of the parcel.  

The concerns of various departments were discussed.  Manager Reed stated that staff’s recommendation would be to trade the section for an area which would be large enough to build a cul-de-sac or turn around in the future at the end of Brookside Terrace.

The consensus of the Council was to have the Town’s Engineer survey the parcel in question and present a recommendation on a turn around.

ITEM 5B.        Roadwork Update (Taken out of order)
Manager Reed enclosed a copy of the final results of the paving project overages.  At the present time the Town Engineer is reviewing the figures but it seems to be similar to the figures discussed at the last meeting.    
        
Motion By:  Councilor Hathaway—to authorize the payment to Sunrise Materials at a sum not to exceed $159,789.49 for the Town projects completed to date which includes Chase Road, Hobson Avenue, Lemon Street, Olive Street and Silver Ridge.  Seconded:  Councilor Parker, Voted 3-0 in favor.          

ITEM 5a.        Audit Update
Town Auditor Charemon Willey was present to go over the audit with the Council and answer any questions.  She outlined that the Town has a healthy fund balance.  The firm will be issuing a management letter with recommendations in the near future.  

Charemon Willey stated that the School Department does not have a chart of accounts up and running yet.  The deadline is October 15th and if it is not done by then the State will start withholding the subsidy checks.    

It was discussed that if the School Department did not have their chart of accounts done by October 15th that the Town will not pay any vendor bills.  Councilor Hathaway outlined that he did not think the School Board was aware of the magnitude of the situation.  It was decided that Manager Reed would write a letter to the School Board explaining that if the chart of accounts was not completed by a deadline that the Town would pay any of the vendor bills.  

ITEM 6.         Comments from the Public
There were no comments from the public.

ITEM 7. Manager’s Report
a.      The Town Council reviewed a copy of a letter received from Dynegy requesting their TIF reimbursement.

Manager Reed outlined that Dynegy got together with Town staff to discuss the assessed value of the plant.  Manager Reed outlined that there was a breakdown in communication and the value remitted to the Town inaccurate.  It was based on the gross sale of all assets in total and not on the single facility.     

ITEM 8. Requests for Information and Town Council Comments
There were no requests for information or Town Council comments.

ITEM 9. Warrants: Town Warrant 7, Town Payroll Warrant 7, School Warrant 7, School Lunch Warrant 7 and School Payroll Warrant 7 were circulated and signed.  
        
ITEM 10.        Adjournment: Motion: Councilor Hathaway—to adjourn the October 1, 2007 Town Council Meeting. Seconded: Councilor Parker—there was no further discussion. Voted 3-0. Meeting adjourned 8:05pm.
