CITY COUNCIL & WPC AUTHORITY
June 25, 2015

A SPECIAL & TELEPHONIC MEETING was held by the City Council & WPC Authority in the City Hall Auditorium on Thursday, June 25, 2015.

Those in attendance included Mayor Elinor Carbone, Corporation Counsel Raymond Rigat, City Councilors Gregg Cogswell, Christopher Anderson and Drake Waldron.  City Councilors Anne Ruwet and Paul Samele participated by telephone and City Councilor Paul Cavagnero was absent.  


Mayor Carbone opened the meeting at 6:34 p.m. starting with the Pledge of Allegiance.

TAX OVERPAYMENTS
Atty. Rigat explained that on June 8th, a letter was sent to Dr. Crovo’s attorney, Eliot Gersten, demanding that monies held as overpayments for Grand List years 2010 through 2013 be immediately tendered to the City Treasurer.  He said he also demanded that monies collected by way of jeopardy tax collection in 2013 be applied to the 2014 Grand List year and tendered to the current tax collector.  He said the monies total $582,843 and have not been received by the June 19th deadline.

On a motion by Councilor Ruwet, seconded by Councilor Waldron, the Council considered authorizing Corporation Council to take legal action by filing a complaint with Superior Court regarding overpayments and jeopardy tax payments being kept by Dr. Crovo.

Atty. Rigat said that to keep this amount of money where there is no supervision by the City is just not acceptable and is really a problem.  Councilor Cogswell expressed concern that the City owes taxpayers these funds and said he would prefer the City did not have to go to Court.  Atty. Rigat said the Council members are stewards of the City and have a public responsibility to its taxpayers and citizens.  Mayor Carbone said this needs to be addressed as the City is not prepared to refund to taxpayers $582,000 that we have never received.

Councilor Samele was disconnected from the meeting at 6:58.  

The Council voted 4/0 in favor of authorizing Corporation Council to take legal action by filing a complaint with Superior Court regarding overpayments and jeopardy tax payments being kept by Dr. Crovo.

ADJOURNMENT
On a motion by Councilor Waldron, seconded by Councilor Anderson, the Council voted unanimously to adjourn at 6:59 p.m.
