PUBLIC HEARING
CITY COUNCIL & WPC AUTHORITY
November 12, 2013

A PUBLIC HEARING was held by the City Council & WPC Authority in the City Hall Auditorium on
Tuesday, November 12, 2013 to consider the potential sale of the city water supply system to the
Torrington Water Company.

Those in attendance included Mayor Gerald Zordan, Corporation Counsel Raymond Rigat, City
Councilors Gregg Cogswell, Paul Samele, Drake Waldron, Wendy Traub, Marie Soliani and Elinor
Carbone.

Mayor Zordan called the public hearing to order at 6:00 p.m.

City Clerk Joseph Quartiero read the legal notice.

There was no one present who wished to speak; Mayor Zordan closed the public hearing at 6:03 p.m.

SALE OF CITY WATER SUPPLY SYSTEM
On a motion by Councilor Traub, seconded by Councilor Soliani, the Council voted unanimously by roll
call vote to authorize the Mayor to enter into an agreement for the sale of the city water supply system
to Torrington Water Company in the amount of $350,000, and to authorize the Mayor to sign all
documents on behalf of the City.

MINUTES
REGULAR MEETING
CITY COUNCIL & WPC AUTHORITY
November 12, 2013

A REGULAR MEETING was held by the City Council & WPC Authority in the City Hall Auditorium on
Tuesday, November 12, 2013.
Those in attendance included Mayor Gerald Zordan, Corporation Counsel Raymond Rigat, City
Councilors Gregg Cogswell, Paul Samele, Drake Waldron, Wendy Traub, Marie Soliani and Elinor
Carbone. Fire Chief Gary Brunoli, Zoning Enforcement Officer Kimberly Barbieri and Public Works
Director Jerry Rollett were also present.
Mayor Zordan called the meeting to order at 6:04 p.m.

MINUTES
On a motion by Councilor Waldron, seconded by Councilor Samele, the Council voted unanimously to
accept the minutes of the Regular Meeting held October 23, 2013. Councilor Soliani abstained.

OPEN TO THE PUBLIC
On a motion by Councilor Waldron, seconded by Councilor Carbone, the Council voted unanimously to
open the meeting to the public.
Atty. Tom Wall, Jr. spoke on behalf of his clients Stephen & Jacqueline Byrne regarding their
inability to receive a refund from the city's tax collector. He said it is a shame on that office and a
disgrace that these refund payments is not being made. He asked that the city do everything it
can.
Gregg Kinney of Pineridge Road spoke concerning his overpayment of taxes. He said he followed
all the tax collector's procedures, and still hasn't received his $195 refund since May 2013.
Mary Beth Lach of Riverside Avenue also spoke against the tax collector saying she was misled
about how much time her mother had to repay her taxes. She said her mother's home was
sold at auction and questioned how $10,000 worth of taxes could have accumulated.
Donna Isley of Funston Avenue praised Councilor Soliani for her years of service.

TABLED: THS ATHLETIC FIELDS
On a motion by Councilor Waldron, seconded by Councilor Soliani, the Council considered acceptance of
the THS Athletic Fields Complex Building Committee's, or "Turf Committee's" recommendation
regarding land survey bids. Since information on this bid was unavailable, Councilor Cogswell made a
motion to table, seconded by Councilor Traub and unanimously approved.

MUNICIPAL HISTORIAN
On a motion by Councilor Waldron, seconded by Councilor Carbone, the Council voted unanimously to
accept the Mayor's appointment of Kenneth A. Buckbee as a Municipal Historian for a four2" color="#000000" style="font-family:Arial;font-size:6pt;color:#000000;">RESOLVED, that the City of Torrington may enter into, with, and deliver to, the State of Connecticut
Department of Emergency Management and Homeland Security any and all documents which it deems
to be necessary or appropriate; and

FURTHER RESOLVED, that Gerald A. Zordan, as Mayor of the City of Torrington, is authorized and
directed to execute and deliver any and all documents on behalf of the City of Torrington and to do and
perform all acts and things which he deems to be necessary or appropriate to carry out the terms of such
documents, including, but not limited to, executing and delivering all agreements and documents
contemplated by such documents.

WPCA EAST DRAINAGE BASIN
Acting herein as the Water Pollution Control Authority, on a motion by Councilor Cogswell, seconded by
Councilor Waldron, the Council voted unanimously to approve a payment from Fund #490 Sanitary
Sewer Capital Improvement to Weston & Sampson in the amount of $21,320 for Invoice #426165 for
design on Capital Project D" style="text-align:left;">SMALL CITIES PAYMENT
On a motion by Councilor Waldron, seconded by Councilor Soliani, the Council voted unanimously to
authorize a payment of $21.68 from Fund #250 to FedEx for services rendered with regard to the 2013
Small Cities Application.

SMALL CITIES LOAN SUBORDINATION
On a motion by Councilor Soliani, seconded by Councilor Samele, the Council voted unanimously to
accept the recommendation of the Small Cities Committee to approve a loan subordination for 23olor:#000000;">CONSERVATION COMMISSION MEMBER
On a motion by Councilor Waldron, seconded by Councilor Traub, the Council voted
unanimously to approve Piper Reese as a member of the Conservation Commission, replacing
Gary Eucalitto.

EXECUTIVE SESSION
On a motion by Councilor Carbone, seconded by Councilor Traub, the Council voted unanimously
to enter executive session under pending litigation at 6:43 p.m.

OPEN SESSION
On a motion by Councilor Carbone, seconded by Councilor Waldron, the Council voted
unanimously to enter open session at 6:46 p.m.

ADD TO AGENDA
On a motion by Councilor Cogswell, seconded by Councilor Waldron, the Council voted unanimously to
add to the agenda.

ENTER STIP. JUDGMT W/ F.O.I.
On a motion by Councilor Cogswell, seconded by Councilor Carbone, the Council voted unanimously to
approve Corporation Counsel's request to enter into a stipulated judgment with the Freedom of
Information Commission on Docket #HHB00000" style="font-family:Arial;font-size:8pt;color:#000000;">to open the meeting to the pubic on "agenda items" only. There was no one who wished to speak.

BUSINESS BY DEPT. HEADS
On a motion by Councilor Waldron, seconded by Councilor Carbone, the Council voted unanimously
to consider business presented by Department Heads.
Mr. Quartiero thanked Councilor Soliani for all her years of service, and all her support, saying she has
served on Council for 14 of the 20 years he has been City Clerk.
Mr. Rigat agreed that it has been a real pleasure working with Councilor Soliani.

BUSINESS BY MAYOR AND COUNCIL
On a motion by Councilor Soliani, seconded by Councilor Carbone, the Council voted unanimously
to consider business presented by the Mayor and members of the City Council.
Public Safety Commissioner-Elect Glenn McLeod said the City of Torrington owes Councilor Soliani a
great deal of gratitude.
